Subject : Sole Source Approval of B1500130
I am requesting approval of a sole source purchase of chairs (2 different types) from Office
Scapes for the Human Services ( HS) Department in the amount of $30 , 222 . 72 . Per the Weld
County Code ( pasted below) , the Board of County Commissioners ( BOCC) must approve any
sole source purchase over $25 , 000 .
HS routed around a " Pass Around " ( attached ) concerning the purchase of these chairs during
the week of May 18 , 2015 . Due to their need for a high-quality , durable chair , HS has requested
a specific type of SteelCase chair. SteelCase chairs are only sold by Office Scapes ( in
Colorado and Wyoming ) qualifying this purchase as sole source .
I am comfortable that we are receiving competitive pricing as we are purchasing these chairs via
a NJPA cooperative agreement and confirmed that pricing by requesting a quote from Pear
Workplace Solutions . We purchase other office furniture from Pear via a cooperative
purchasing agreement and their pricing came in slightly higher for a comparable chair .

Weld County Code , Sec . 5-4-90 . Sole Source Purchases
Purchases may be exempt from the quote and bid process if there is only one appropriate vendor. Some
equipment designation effectively eliminates competition . so support documentation will be required on the requisition
to explain why only a particular brand or service is acceptable . A sole source situation could arise because of
compatibility with existing equipment due to the fact that the product or service is patented or copyrighted . Such
purchases . when identified and justified by the requesting department and upon concurrence of the Purchasing
Director, shall be exempt from the quote and bid process . The Purchasing Department will maintain records of all
sole source justifications . Any sole source purchase over $25 . 000 will require approval from the Board of County
Commissioners .

Services Request for Purchase of Chairs
This Memorandum provides a summary of the following:
• Departments' Employment Services Request for Purchase of Chairs
Please review this and indicate if you would like a work session.
Request Board Approval for Employment Services to purchase chairs. Employment
Services of Weld County (ESWC) is seeking approval to update chairs in the Greeley and Ft
Lupton locations. Updates would include two conference rooms, the Assessment and Learning
Lab and Resource Rooms in Greeley and the Assessment and Learning Lab/Resource Room
combo in Ft Lupton. The approval of this purchase will provide an increased professional
atmosphere for the Workforce Development Board and Committee meetings as well as
increased comfort for customers working toward increasing skills to reenter the workforce. High
volume and customer chairs will not have fabric thus increasing the ability to clean and
maintain chairs while eliminating concerns that may arise such as bed bugs.
Chairs that will be primarily utilized in high volume and with customers have been selected,
with the support of the County Purchasing Department, by bid (Attachment 1 ). Per Section 5-4-
90 of the Weld County Code—"Any sole source purchase over $25,000 will require approval
from the Board of County Commissioners."The majority of ESWC programs include budgets
ending on June 30, 2015. Current program year budgets have remaining funds to support this
purchase without compromising the delivery of services to customers.
I do not recommend a Work Session. I recommend approval of this Purchase.

local law,and that the laws of the State of Colorado shall govern this agreement.
2. Upon request Bidder shall submit a certificate of insurance.
3. All items shall be shipped FOB destination, unless otherwise specified. Weld County reserves the right
to cancel due to delay. All deliveries must be received before December 31, unless otherwise noted.
4. Bidder shall indemnify,defend, and hold harmless Weld County against all damages and claims arising
from defects of the item, or Bidder's acts or omissions.
5. Weld County reserves the right to inspect the items. Payment shall not constitute acceptance and buyer
reserves the right to reject the items upon discovery of a defect.
6. All goods shall remain the property of the seller until delivered to and accepted by Weld County
