RESOLUTION
WHEREAS, a public hearing was held on October 20, 1975, in the
chambers of the Board of County Commissioners, Weld County, Colorado,
for the purpose of hearing the petition of David Farley, Route 1, Box 10,
Platteville, Colorado, requesting a change of zone from "A" Agricultural
District to "C" Commercial District, and
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the change of zone, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the
request of the petitioners and studied the recommendations of the Weld
County Planning Commission as submitted, and having been fully informed;
; ", NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the petition of David Farley, Route 1, Box 10, Platte-
ville, Colorado, for change of zone from "A " Agricultural District to "C"
Commercial District, said area being more particularly described as
follows:
All that part of the Southwest Quarter (SW++-)
of the Southeast Quarter (SE 'i) of Section Eighteen
(18), in Township Three (3) North, Range Sixty-
six (66) West of the 6th P. M. , which was described
before vacation as Lots Nine (9), Ten (10), Eleven
(11), Twelve (12), Thirteen (13), Fourteen (14),
Fifteen (15), Twenty-five (25), Twenty-six (26),
Twenty-seven (27), Twenty-eight (28), Twenty-
nine (29), Thirty (30), and Thirty-one (31), in
Block Seven (7), S. F. Nuckolls Subdivision, formerly
in the Town of Platteville, Weld County, Colorado, and
is hereby granted under the conditions following:
1. That any water and sanitation facilities to be installed shall be
approved by the State Health Department,
2. All applicable subdivision regulations and zoning regulations shall
be followed and complied with in accordance with the zoning resolutions of
Weld County, Colorado,
3. That said change of zone herein granted is conditional only for a
period of twelve months from date hereof, on condition that developer proceed
with due diligence to begin development of the area rezoned and submit plans
for such development for the approval of the Weld County Planning Commission
within six (6) months from date hereof as required by Section 8. 4 of the Weld
County Zoning Resolution; and that major construction shall commence thereof
within said twelve (12) month period; otherwise, the County may take action to
rezone the property to its present classification.

to have a fire line run in front of the cabins. -Do have plans to expand
possibly to have a separate operation for girls. Will probably use
pressure pump for the lake for fire protection. There are State regu-
lations regarding fire safety; schooling; etc. , that will be met.
Weld County Planning staff recommends approval for the following reasons:
(1 ) It -agrees with the Weld County Comprehensive Plan and Weld County
Zoning Resolution in promoting agricultural uses of the land; (2) -Health
Dept. recommends approval . Subject to: (1 ) Lagoon location being shown
on the plans; (2) Approval of fire protection plan by the County Engineer;
(3) Construction beginning within one years' time from date of approval
by the Board of County Commissioners and limited to the revised plans to
be submitted.
RESOLUTION: Be it therefore resolved to recommend approval to the Board of
County Commissioners subject to Planning staff recommendations. Motion
• by Mr. Weigand , seconded by Mr. Anderson. A vote of "Aye" by Watson,
Nix, Anderson, Weigand and Heitman. Motion carried.

SUBJECT: Zone Change "A" to "I"
LOCATION: Pt SW% SE- Sec 18 T3 R65
APPEARANCE: Mr. Farley; Allen Jost, representing Platteville
DISCUSSION: He needs the zoning because there is already a pipe yard there.
Did not realize that his zoning was inadequate. Access from Railroad
Right-of-Way. Mr. Jost stated that the Platteville Planning Commission
had heard a request from Mr. Farley for multiple family dwellings.
The -Planning Commission, however, did not approve this type use, but
stated they would recommend the Industrial use. This parcel at one time
was in the city limits of Platteville, tut has since been deannexed.
There is some problem with the access . Not sure if it has been vacated
yet. There is a right-of-way lease on the railroad _property. Need to
renegotiate a lease with the railroad regarding uses on the property.
This was considered and left up to the Town of Platteville whether or
not it should be a Pun or straight zoning. They stated they would support
straight "I" zoning. Is located in their comprehensive planning -area.
Weld County Plannin-g staff recommends this request be tabled for the
following reasons: (1 ) -Although Platteville t,as shown support for this
application, there is a need for Mr. Farley to renegotiate with the
Union Pacific Railroad. The new lease should eliminate the restriction
to agricultural use and -also should _provide access to the property. Also,
at this point, the lease does not describe the entire parcel ; it falls
short. The parcel is about. 450' deep. If he goes to an I-UD, he would
first have to go before the Board of Adjustment for a variance on lot
1057
size. It was felt that it would be better for all if it would go through
an I-UD instead of straight 1 zoning. This will give better control re-
garding what could be put into the area.
MOTION: By Mr. Heitman, to table and recommend the procedures be followed for
an "I-UD" . Seconded by Mr. Nix. A vote of "Aye" by -Watson, Nix, Anderson,
Weigand and Heitman. Motion carriea.
DISCUSSION: What the "I-UD" is and involves was explained to Mr. Farley. An
"I-UD" will limit the uses; mainly as to what Mr. Farley wants . Any
changes will have to be reviewed by the Board again.

Planning staff recommends approval because it agrees with
land use policy ; agrees with surrounding land use and zoning ;
agrees with _Johnstown ' s Proposed Land Use ; and required by
the Federal _Government to control water pollution . Approval
subject to : A new legal description b-eing submitted and ap-
prove-d -by the County Attorney ; Health Deft . comments ; Soil
Conservation report and use being limited -to plans submitted .
Milliken and J-ohnstown both were notified and they sent no
comments .

Be it therefore resolved to recommend site approval -to
the Board of County Commissioners subject to Planning staff
recommendations . Motion by Mr . Anderson , seconded by Mr . Nix .

Mr. Hollaway says he has applied for a permit for the sewer end the
water is -already there. Mr. Rank asked if Mr. Hollaway is planning
to put the mobile home on a foundation. Mr. Hollaway said yes.

APPEARANCE: Mr. Farley
DISCUSSION: Mr. Farley stated that he already has the pipe yard there
now, but the area is agricultural zoned. He wants to get it
industrial zoned. He said he had applied for a zone change at
one time for high density housing and had-been told it was for
industrial use. Mr. Carlson asked if -he should have five acres
before he can apply for _planned unit development without the
variance. Mr. Adams sai-d yes. Mr. Rank asked how many acres are
in the alfalfa field to the south of Mr. Farley. Mr. Farley
said it was about 4 acres, which is about the same amount he owns.
He said the railroad has a 200' right-of-way. Mr. Dorsey asked
how much land Mr. Farley owns now. Mr. Farley said around 2 or
3 acres , not counting the r-ailroad right-of-way. N. Carlson asked
Mr. Farley it he has leased the railroad right-of-way from the
railroad company. Mr. Farley said yes. Joe -Hellewell asked
