RE: ACCEPT PROPOSAL AND APPROVE TRANSFER OF TWELVE (12) TAX LIEN SALE
CERTIFICATES FOR THE PURPOSE OF ACQUIRING OWNERSHIP FOR LESS THAN
FACE VALUE -TUSCANY HOMEOWNER'S ASSOCIATION
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a proposal to purchase/transfer twelve
(12) Tax Lien Sale Certificates from the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of the Treasurer's Office, with the total
amount of back taxes being cancelled, in the amount of$10,691.11, as a result of Tuscany, LLC,
bankruptcy court proceedings, and with purchase/transfer for less than face value being more
fully described to include transfer fees of $4.00 each, redemption fees of $7.00 each, and $1.00
tax fees for each, and
WHEREAS, no property taxes have been paid on these properties since 2004, and the
current amount of past due taxes, $10,691.11, now exceeds their market value, as further
detailed in Exhibit A, a copy of which is attached hereto, and incorporated herein.
WHEREAS, the proposed transfer to the Tuscany Homeowner's Association will make the
properties tax exempt and will add them to the non-taxable/non assessed parcels within the
County, and
WHEREAS, after review, and in accordance with Section 39-11-122, C.R.S., the Board
deems it advisable to accept said proposal and approve said transfer.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the proposal from the Tuscany Homeowner's Association, to purchase
twelve (12) Tax Lien Sale Certificates as further detailed in Exhibit A, from the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf
of the Treasurer's Office, being more fully described to include transfer fees of $4.00 each,
redemption fees of $7.00 each, and $1.00 tax fees for each, be, and hereby are, accepted.
BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County,
Colorado, that the total amount of back taxes due for each parcel, be and hereby is, cancelled,
and that the transfer of said Tax Lien Sale Certificates from the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Treasurer's Office, to Tuscany Homeowner's Association, as detailed above, be, and hereby is,
approved.

Tax Lien Sale Certificates were acquired by Weld County at the 2004 and 2005 tax lien sale and
has been held by Weld County from that point until the present time. The Tuscany
Homeowner's Association has made an offer to purchase the tax lien certificates for the sole
purchase of obtaining ownership through the Treasurer's Deed process. They propose to pay
Weld County the $4.00 transfer fee and $7.00 redemption fee plus $1.00 in taxes.
The ownership of the property is listed as Tuscany LLC. This company was dissolved and the
owner filed bankruptcy then moved to another state. The company, owner and the Bankruptcy
Court never addressed the problem of dedicating these parcels to the HOA which would have
made them tax exempt. The taxes on some of these parcels now exceed their market value.
As the Treasurer of Weld County, I am asking for the Board of County Commissioners to
approve and accept this proposal by resolution.
