RE: APPROVAL OF RECORDED EXEMPTION NO. 340 - MR. AND MRS. GEORGE
ROSENOFF, JR.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 2nd day of October, 1978 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption number 340, being the property of
Mr. and Mrs. George Rosenoff, Jr. , described as part of the West
Half and the West Half of the East Half of Section 29 , Township 6
North, Range 67 West of the 6th P.M. , Weld County, Colorado,
being more particularly described as follows:
The Southwest Quarter of the Northeast Quarter
of Section 29. Excepting therefrom that por-
tion conveyed to the Great Western Sugar Com-
pany by Warranty Deed recorded in Book 388,
page 13, Weld County Records.
That part of the West Half of the Southeast
Quarter of Section 29, described as follows:
Beginning at a point 69 feet West of the north-
west corner of the East Half of the Southeast
Quarter of said Section 29, thence running
West 1,211.51 feet; thence South 2,637 feet;
thence East 1,230 feet; thence North 2,637
feet on a lire parallel to the County road
to the place of beginning.
All that part of the Southeast Quarter Northwest
Quarter and of the Southwest Quarter of the North-
West Quarter and of the Southwest Quarter of
Section 29 described as follows:
Beginning at a point whence the Southeast corner
of the Southwest Quarter of said Section 29 1-flat's

does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land, " pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pursuant
to its authority under Section 30-28-101 (10) (d) , CRS 1973, as
amended, and Section 2-lA(3) of the Weld County Subdivision Regu-
lations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by Mr. and Mrs. George Rosenoff, Jr. , be and
hereby is, exempt from the definition of the terms "subdivision"
and "subdivided land" pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 2nd day of
October, A.D. , 1978 .

Dear Commissioners:
The attached application, plat , and related items are in reference
to a request by Mr. and Mrs. George Rosenoff, Jr. , for a recorded
exemption. Mr. Rosenoff has appointed Mr. Ron Rich to act as his
representative in this matter. The property on which the recorded
exemption has been requested is described as Pt . WI and Wa Ez of
Section 29, T6N, R67W of the 6th P.M. , Weld County, Colorado.
This property is located approximately one mile southwest of the
Town of Windsor. The property contains approximately 227 acres of
Class 1 through 4 irrigated soils and Class 4 and 6 non-irrigated
soils. The request is to split the property into parcels of 2.476
acres and 224. 52 acres.
Mr. Rosenoff desires to sell the 2.476 acre parcel to Mr. Rich.
This parcel presently has an existing residence, mobile home and
other improvements located on it . Mr. Rich is currently living in
the residence and works part time for Mr. Rosenoff. The balance of
the property is in agricultural use (crap farming and pasture) and
has an existing residence and other outbuildings located on it .
Based upon the information submitted and the adopted policy in the
County, the Department of Planning Service Staff recommends the
request be approved for the following reasons:
1. The proposed split conforms with Section 9-2 of the Weld County
Subdivision Regulations (intent clause of the recorded exemption
procedure) , Section 3. 3 A. of the Weld County Zoning Resolution
(intent clause of the Agricultural Zoned District) , and the
Weld County Comprehensive Plan in that each parcel does have an
existing set of improvements. The use will be compatible with
surrounding agricultural uses. The request will allow agri-
cultural and related uses to be the predominant land use.

2. The Windsor Planning Commission has recommended approval of this
request.
3. The request complies with the provisions of Section 9-4 A. of the
Weld County Subdivision Regulations.
On September 28, 1978, the Weld County Board of Adjustment approved
a variance from the requirement of 180 feet of lot frontage onto a
public road as set forth in Section 3.14 of the Weld County Zoning
Resolution and Section 9-4 A. (3) of the Weld County Subdivision
Regulations.

Dear Sirs:
I am writing regarding the request which I have submitted for the exemption
of Lot "A". The total farm contains 2 houses and one mobile hone. I feel
that Lot "A" house and property is isolated from the rest of the farm and I
do not need it.
Ron and Ruth Rich have resided there the past two years. Mr. Rich helps me
as a part time hired hand. They desire to have this for their permanent
home and I would be happy if you would grant this exemption. The Town of
Windsor is also in support of this request.
Water source for both houses and mobile hone located on Lots "A" and "B"
is cistern storage of hauled in water. I feel this is no major problem
as most surrounding neighbors do the same. Lot "B" has an existing well
for livestock use.
A letter has been submitted to Windsor Water Board asking for a tap on the
new water line if possibel as to its location. There has been no decision
yet.

AGREEMENT FOR THE SALE OF REAL ESTATE
) , THIS AGREEMENT, made and entered into this 15th day of May,1978, and

/2 ,e Sellers, and RON RICH and RUTH RICH, hereinafter referred to as Purchasers.
WITNESSEPH:
For and in consideration of the keeping of the covenants and the making
of the payments hereinafter to be kept and made on the part of the Purchasers,
and further subject to contingency hereinafter set forth, Sellers hereby sell
and Purchasers hereby purchase the following described property to-wit:
See Exhibit "A" attached
at and for a total purchase price of Thirty Thousand Dollars ($30,000.00),payable
in a lump sum on date of closing. .
THE FOLIDWING CONDITIONS SHALL ALSO APPLY:
/7. ;,�2. 1. Sellers, at their own expense, shall furnish to Purchasers
a current commitment for title insurance policy in an amount equal to the
' c purchase price on or before June 1 ,1978.
i' 2. General taxes for 1978, water rents, insurance and all utilities
shall be apportioned to date of delivery of Decd and possession.
3. Title shall be merchantable in the Sellers. Subject to payment
or tender as above provided and compliance with the other terms and conditions
hereunder by Purchasers, the Sellers shall execute a good and sufficient general
warranty deed to Purchasers on the date of closing, conveying said property
free and c>var of all taxes,excepting the general taxes for 1978, payable in 1979,
which taxes shall be apportioned to date of delivery of deed, and also excepting
easements, rights of way, mineral reservations, oil and gas leases, restrictive
covenants of record. Any encumbrances required to be paid by Sellers may be
paid from the proceeds of this transaction.

at the office of Robert C. Bosley, Attorney at Law, 520 Main Street, Windsor,

5. Time is of the essence hereof, and if any payment or any other
condition hereof is not made, tendered, or performed by either the Sellers or
the Purchasers as herein provided, then this Agreement, at the option of the
party who is not in default, may be terminated and held of no effect, and both
parties hereto shall thereupon be released from all obligations hereunder. In
the event of such default by the Sellers, and the Purchasers elect to treat the
Agreement as terminated, then all payments made hereunder shall be returned to
Purchasers. In the event of such default by the Purchasers, the the Sellers elect
to treat this Agreement as terminated, then all payments made by the Purchasers
shall be retained by the Sellers as liquidated damages. In the event, however,
the nondefaulting party elects to treat this Agreement as being in full force
and effect then nothing herein shall be construed to prevent its specific
performance.

6. In the event title is not merchantable, Sellers shall have a
reasonable time to correct any defects. If title cannot thereafter be
rendered merchantable, then all the payments made by Purchasers shall be
returned forthwith and the parties hereto shall be released from all
obligations hereof.
ADDITIONAL PROVISION:
This Agreement and all its terms and conditions are specifically
conditioned and contingent upon the purchasers obtaining the required
approval and recorded exemption for this transfer fran the Weld County
Planning Cacmission and any and all other interested State and local
Governmental agencies.
This Agreanent shall bind the parties hereto, their heirs,
personal representatives, and assigns.

GRANT OF EASEMENT FOR INGRESS AND EGRESS
KNOW ALL MEN BY THESE PRESENTS, that the undersigned owners and tenant
of the real estate described in the attached Exhibit "A" , for a valuable
consideration, hereby grant to RONALD RICH and RUTH RICH, husband and wife,
an easement for ingress and egress from Weld County Road #64 over and across
those portions of the lands shown on said Exhibit "A" which are owned and
operated by each of them respectively, which right shall be used by the said
Ronald Rich and Ruth Rich for access to and from their residence which is
designated as Lot "A" on the attached Exhibit "A" and consisting of 2.476 acres,
more or less, in the Southeast Quarter of the Northwest Quarter (SE4/NWI)
and the Southwest Quarter of the Northwest Quarter (SW*/NWj-) and the Southwest
Quarter (SW of Section 29, Township 6 North Range 67 West of the 6th p.m.
in Weld County, Colorado; and further, said right of ingress and egress shall
be exercised by means of an access road faun said Weld County Road #64 over
and along an established access road to said property, which road has boon
r. established and used for more than thirty (30) years and as now described in the
records and files of Weld County, Colorado.
It is understood by all parties hereto that this grant of easement is
given pursuant to a requirement of the Weld County Planning Commission concerning
a recorded exemption for which the said Ronald Rich and Ruth Rich have made
application.

COMMENTS:
There is currently two sets of existing improvements located on both
proposed lots. Proposed lot A contains an existing residence and a
mobile home. The proposed lot B contains an existing residence and
other outbuildings. All of proposed lot B is in agricultural production
including corn and pasture with cattle. Access to the proposed lot A
is over an existing graveled road. All accesses to lot B are existing.
The proposed lot A is at a higher elevation than the rest of the property.
Natural drainage of the property appears to be to the east and northeast .
The proposed lot A is currently not being used for agricultural purposes
other than equipment storage.

The Recorded Exemption as requested by Ron Rich, has been
reviewed by Environmental Health staff and the following
comments are submitted:
1 . Raw sewage has been observed on the ground
as a result of a malfunctioning septic
system. The applicant was informed of
this violation and has since secured a
repair permit from this office. The
stipulations of this permit require
that the owner repair the system to our
satisfaction by October 18, 1978.
2. If the applicant is faithful in this
matter, I have no objections to granting
this Recorded Exemption.
