RE: APPROVE REQUEST TO MODIFY DEVELOPMENT STANDARDS #28 AND #31 AND
DELETE#18 AND#26 OF USE BY SPECIAL REVIEW PERMIT, USR14-0023 -VARRA
COMPANIES, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on October 1, 2014, the Board of County Commissioners approved the
application of Varra Companies, Inc., 8120 Gage Street, Frederick, CO 80516, for a Site Specific
Development Plan and Use by Special Review Permit, USR14-0023, for a Mineral Resource
Development, including open pit mining (sands, gravels and stones) and Materials Processing,
including concrete or asphalt batch plants and/or recycling operations in the A (Agricultural)Zone
District and the 1-3 (Industrial) Zone District, on the following described real estate, being more
particularly described as follows:
Lot B of Recorded Exemption, RE-3197; being part
of the NE1/4 of Section 10, Township 5 North,
Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, Development Standard #28 and #31 were approved, to read as follows:
"28. The site is located within the FEMA mapped Zone A 100-Year Floodplain
and the floodway. Weld County Code Section 23-5-250 prohibits
development including, but not limited to, the construction of buildings and
the placement of fill (stockpiles) within the floodway." and
"31. The property owner or operator shall be responsible for complying with the
Open-mining Standards of Section 23-4-250, Weld County Code."
WHEREAS, the Board of County Commissioners heard all the testimony and statements
of those present, studied the request of the applicant and the recommendation of the Weld
County Department of Planning Services and, having been fully informed, finds Development
Standards#28 and#31 shall be amended to read as follows:
"28. The site is located within the FEMA mapped Zone AE 100-Year Floodplain
and the Floodway. Weld County Code, Chapter 23, Article XI, states that
"No Rise"Certification is required for all development in the Floodway."and
"31. The property owner or operator shall be responsible for complying with the
Open-mining Standards of Chapter 23, Division 4, of the Weld County
Code."

WHEREAS, the Board of County Commissioners also finds it necessary to remove the
following Development Standards#18 and#26:
18. "No Trespassing" signs shall be posted and maintained on the perimeter
fence to clearly identify the boundaries of the site.
26. Should human remains be discovered during mining activities, the
requirements under State Law C.R.S. part 13 apply and must be followed.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Development Standards #28 and #31 for Use by Special Review Permit,
USR14-0023, on the hereinabove described parcel of land be, and hereby are, amended as
stated above.
BE IT FURTHER RESOLVED by the Board that Development Standards#18 and#26 for
Use by Special Review Permit, USR14-0017, on the hereinabove described parcel of land be,
and hereby are, deleted.
BE IT FURTHER RESOLVED by the Board that all other Development Standards
included in Resolution #2014-3283, approved on October 1, 2014, remain in full force and effect.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 19th day of January, A.D., 2015.

Case History
USR14-0023 was approved by the Board of County Commissioners on October 1, 2014 for a
Site Specific Development Plan and Use by Special Review Permit, USR14-0023, is for a
Mineral Resource Development, including open pit mining (sand, gravel and stone), and
Materials Processing, materials recycling and an asphalt and /or concrete batch plant, in the A
(Agricultural) and 1-3 (Industrial) Zone Districts.
The USR Map has not been recorded pending the outcome of these proceedings.
Post approval by the Board of County Commissioners the Director of Planning Services --
Floodplain Administrator, noted an error in language associated with Development Standard No.
28.
Board approved language states:
"The site is located within the FEMA mapped Zone A 100-Year Floodplain and the
floodway. Weld County Code Section 23-5-250 prohibits development including but not
limited to the construction of buildings and the placement of fill (stockpiles) within the
floodway."
Requested modification for Development Standard No. 28 to state:
"The site is located within the FEMA mapped Zone AE 100-year Floodplain and the
Floodway. Weld County Code, Chapter 23, Article XI states that a "No Rise" Certification is
required for all development in the Floodway."
Planning Staff also requests to modify Development Standard No. 31. Board approved
language states:
"The property owner or operator shall be responsible for complying with the Open-mining
Standards of Section 23-4-250 of the Weld County Code."
Requested modification for Development Standard No. 31 to state:
"The property owner or operator shall be responsible for complying with the Open-mining
Standards of Chapter 23, Division 4 of the Weld County Code."

Planning Staff also requests to eliminate Development Standard No. 18

as it is our opinion that other agencies have oversight for these two conditions and therefore do
not need to be a part of the Resolution.
