Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Applicant wants to turn second dwelling into a rental property. Roads: The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways. Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970-350-2163) to verify the access permit or for any additional requirements that may be needed. (State Highway 52) No traffic counts are available in the area. Traffic: The applicant does not plan this access to have more than 3-4 vehicle trips/day Access: This project accesses onto CDOT Highway SH 52. Please contact CDOT for access requirements. Tracking Control: NA General Site Plan Requirements: i.e (IA, RMA, IGA, etc..., offsite auxiliary lanes) Geologic hazard Area: This area IS NOT in a Geologic Hazard Area. Floodplain: This area IS NOT in a Floodplain. Drainage Study: A drainage narrative is required and full Drainage Report and detention pond waived because the stormwater drainage impacts of the project will be insignificant. o Narrative: The applicant shall provide a shod description of the historic stormwater flows across the property and how their application will affect those flows. The description shall include but not be limited to: 1. where the water originates if it flows onto the property from an offsite source 2. where it flows to as it leaves the property 3. the direction of flow across the property 4. if there have been previous drainage problems with the property The applicants will be required to maintain historic drainage flows and run-off amounts on the property. CONDITIONS OF APPROVAL: A. The map shall be amended to delineate the following: 1. Show the approved Colorado Department of Transportation (CDOT) access(es)on the map and label with the approved access permit number if applicable. (Planning Engineering) 2. Show and label the accepted drainage features, drainage flow arrows, access turning radii (25ft), and parking and circulation on the map. (Planning-Engineering) DEVELOPMENT STANDARDS (NOTES ON THE SITE MAP) 1. Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. (Planning-Engineering) 2. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized. (Department of Public Works) 3. The historical flow patterns and runoff amounts will be maintained on the site. (Planning-Engineering) 4. Weld County is not responsible for the maintenance of onsite drainage related features. (Planning- Engineering) "86''� MEMORANDUM j��rl - a, ,IEL \ TO: Kim Ogle, Planning Services v2_pU N T r' FROM: Lauren Light, Environmental Health SUBJECT: USR15-0025 Miller DATE: May 5, 2015 Environmental Health Services has reviewed this Site Specific Development Plan and Use by Special Review Permit for one (1) single-family dwelling unit per lot other than those permitted under Section 23-3-20.A. The residence is served by a well which is permitted for 3 dwelling units (permit 249869) and a septic system (SP-1100167) We have no objections to the proposal; however, we recommend that the following requirements be incorporated into the permit as development standards: 1. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 2. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. The facility shall utilize the existing private water supply. 3. Sewage disposal shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code pertaining to On-site Wastewater Treatment Systems. 4. The facility shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. MEMORANDUM tJ . ' 60rj c ' To: Kim Ogle, Planner April 13, 2015 From: Bethany Pascoe, Zoning Compliance Officer Subject: USR15-0025 Referral Upon review of my case files and computer, an active Zoning Violation (ZCV15-00027)was noted. This violation was initiated due to the utilization of a Zoning Permit for a Second Dwelling (ZPSD11-0006)as a rental without first completing the necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court Magistrate through the Violation Hearing process. Since this application was submitted prior to an actual court date being scheduled, NO investigation fee is required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. This violation was initiated on March 9, 2015. If this application if approved by the Board of County Commissioners and once a plat is recorded will correct this outstanding violation. If this application is denied,the second home shall be removed from the property or the applicant shall comply with all conditions outlined in ZPSD11-0006)within 30(thirty)days of denial or the violation will proceed in court accordingly.
