RE: ACTION OF BOARD CONCERNING USE BY SPECIAL REVIEW PERMIT,
USR14-0043, FOR ANY USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE,
OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE
DISTRICTS (LANDSCAPE TURF INSTALLATION, TRUCKING AND TRUCK REPAIR
SHOP, ALONG WITH OUTSIDE EQUIPMENTNEHICLE STORAGE AND STAGING)
PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR
RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO
ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE
A (AGRICULTURAL)ZONE DISTRICT - KAY COLLINS AND RYAN GALLATIN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 12th day of
November, 2014, at the hour of 10:00 a.m., in the Chambers of the Board for the purpose of
hearing the application of Kay Collins and Ryan Gallatin, 13900 CR 76, Eaton, CO 80615, for a
Site Specific Development Plan and Use by Special Review Permit, USR14-0043, for any Use
permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or
Industrial Zone Districts (landscape turf installation, trucking and truck repair shop, along with
outside equipment/vehicle storage and staging) provided that the property is not a lot in an
approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any
regulations controlling subdivisions in the A (Agricultural) Zone District on the following described
real estate, to-wit:
Lots A and B of Recorded Exemption, RE-2366;
being part of the NW1/4 of Section 32, Township 7
North, Range 65 West of the 6th P.M.,Weld County,
Colorado
WHEREAS, the Board heard all of the testimony and statements of those present and
reviewed the request of the applicant and, having been fully informed, finds that the matter should
be continued to January 7, 2015, at 10:00 a.m., to allow Kay Collins and Ryan Gallatin adequate
time to seek legal counsel and present to a full quorum of the Board.
WHEREAS, the Board of County Commissioners held a public hearing on the 7th day of
January, 2015, at the hour of 10:00 a.m., in the Chambers of the Board for the purpose of hearing
the aforementioned matter. The Board heard all of the testimony and statements of those present
and reviewed the request of the applicant and, having been fully informed, finds that the matter
should be continued again to January 28, 2015, at 10:00 a.m., to allow Kay Collins and Ryan
Gallatin adequate time to meet with staff to discuss options for a feasible time frame to withdraw
the USR permit application and vacate the subject location without legal action and incurrence of
fines.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the abovementioned matter be, and hereby is, continued to
January 28, 2015, at 10:00 a.m.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 7th day of January, A.D., 2015.
