The undersigned, for valuable consideration hereby sells, conveys, transfers and assigns
all right, title, interest and claim in and to Contract No. 75H for 1/4 Rights in The Loveland and
Greeley Reservoir unto Western Equipment & Truck, Inc. Heirs and assigns forever, subject to
the terms and conditions of said contract and to the operation thereunder by The Greeley and
Loveland Irrigation Company.

INSTRUCTIONS UPON TRANSFER: If additional assignment forms are required they should be in
the form and words as above. Public and private Trustees holding title under deeds of trust and
mortgages, should execute complete assignments upon releasing their trusts or mortgages, and
recite book, page or reception number of recording of trust deed or mortgages released.
The By -Laws of the Greeley and Loveland Irrigation Company provide the original
contract, assignment -deed, assignments and/or instruments attached there to, evidencing the
chain of title, shall be kept in a vault provided by the corporation and shall be open to
inspection or copying during business hours by anyone so interested.
Contracts for Rights in The Loveland and Greeley Reservoir are considered in the nature
of real estate, representing 1/300`h interest per right in the appropriations and decrees for
water applying to said reservoir. Being in the nature of real estate, all transfers should be
acknowledged, and on transfers in decedent's estates, in addition to a Colorado Inheritance Tax
Release, transfer is accomplished by accompanying this certificate with certified copy of Decree
of Heirship, or Will and Order admitting same to probate, together with Decree of Discharge of
Fiduciary. On a sale by a representative of the decedent's estate, the same documents to
transfer real estate are required for the contact rights in said reservoir.

The Board of Weld County Commissioners reserves the right to reject any or all bids, to waive any informalities in
bids, and to accept the bid that, in the opinion of the Board, is to the best interests of the Board and of the County of
Weld, State of Colorado. The Board of Weld County Commissioners shall give preference to resident Weld County
Bidders in all cases where the bids are competitive in price and quality. I certify that the above quotation is
exclusive of any federal excise taxes and all other state and local taxes.
The undersigned bidder hereby offers to provide the compensation designated in the attached proposal. If
said proposal is accepted by the Weld County Board of Commissioners and the bid is awarded to the undersigned,
undersigned understands and agrees that all additional costs, including but not limited to freight, postage,
handling, federal, state or local taxes shall be borne by the undersigned.
The undersigned bidder further understands that upon acceptance of the attached proposal by the Weld
County Board of Commissioners, the proposal shall become a contract between the bidder and Weld County
government and that said contract shall be enforceable at law; and further that should Weld County need to
enforce such contract by commencing a legal action, Weld County shall be entitled to reimbursement of its attorney
fees. Further, the undersigned agrees to close on the sale of the water right no later than 30 days following
acceptance of the bid by the Weld County Board of Commissioners. A separate Contract may be required following
award.

In accordance with Section 5-4-170 of the Weld County Code (applicable portion pasted below), I am
recommending the Board of County Commissioners direct staff to enter in contract with Western
Equipment & Truck, Inc., in the amount of $70,000, to sell the County's '/-right of Lake Loveland water.
Sec. 5-4-170. Disposal of surplus property.
A. This procedure shall be used for disposing of all County -owned materialequipment and supplies except for property seized by the
Sheriffs Office.
C. Estimated sales in amounts or estimated amounts of twenty-five thousand dollars ($25.000) or more shall be formally advertised,
sealed bids shall be taken, and the bids received shall be submitted to the Board of County Commissioners for award. Sale by public
auction may be used in lieu of sealed bids. When public auction is used, the Controller and department representatives may establish
a minimum gross amount prior to the auction. Sealed bids or public auction shall be used to the maximum extent possiblehowever.

RESOLUTION
RE: DECLARE CERTAIN WATER RIGHTS AS SURPLUS PROPERTY AND AUTHORIZE
SALE OF SAME TO WESTERN EQUIPMENT AND TRUCK, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, State statute and Section 5-4-170 of the Weld County Code require that all
items disposed of be declared surplus by the Board of County Commissioners, and
WHEREAS, the County has determined that One Quarter (1/4) Right in the Loveland and
Greeley Reservoir Company (Lake Loveland) represented by Certificate No. 386, originally
evidenced by Contract No. 75H, being more fully described in said proposal which is attached
hereto and incorporated herein by reference, is no longer required for County use, and
WHEREAS, the Board has been presented with a bid (B1500104) for purchase of said
Water Right from Western Equipment and Truck, Inc., 2055 1st Avenue, Greeley, Colorado
80631, in consideration of the sum of $70,000.00, and
WHEREAS, the Board deems it advisable to declare said water right as surplus and
accept said bid proposal, and
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the abovementioned water right be, and hereby is, declared surplus.
BE IT FURTHER RESOLVED by the Board that the bid (B1500104) for purchase of said
water right from Western Equipment and Truck, Inc., in the amount of $70,000.00, be, and hereby
is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign any necessary documents.

INSTRUCTIONS UPON TRANSFER: If additional assignment forms are required.
they should be in the form and words as above. Public and Private Trustees holding
title under deeds of trust and mortgages, should execute complete assignments upon re-
leasing their trusts or mortgages, and recite book, page or reception number of record-
ing of trust deed or mortgages released.
The By -Laws of The Greeley and Loveland Irrigation Company provide
the original contract, assignment -deed, assignments and/or instruments attached there
to. evidencing the chain of title, shall be kept in a vault provided by i ie corporation
and shall be open to inspection or copying during business hours by anyone so interested.
Contracts for Rights in The Loveland and Greeley Reservoir are considered in
the nature of real .stare. representing 1/300th interest per right in the appropriations
and decrees for water applying to said reservoir. Being in the nature of real estate, all
transfers should be acknowledged, and on transfers in decendents' estates, in addition to a
Colorado Inheritance Tax Release, transfer is accomplished by accompanying this certif-
icate with certified copy of Decree of Heirship. or Will and Order admitting same to
probate. together wirh Decree of Discharge of Fiduciary. On a sale by a representative
of the decendents estate, the same documents to transfer real estate are required for the
contract rights in said reservoir.
