The laydown yard will be utilized for storage of various oil and gas support services equipment. The applicant is proposing signage, lighting, and fencing. This is an unmanned facility therefore no water or septic will be installed. The hours of operation are proposed to be 24 hours a day/ 7-days a week. The proposal includes various compression equipment such as compressors, vapor recovery units, separators, dehydrators, launchers, coalescers, storage tanks and additional supporting compression equipment. There is also a 70 foot communication tower proposed to allow the site to be operated remotely. The site is not in a special flood hazard area. DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: 1. The submitted materials are in compliance with the application requirements of Section 23-2- 260 of the Weld County Code. 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 23-2-220 of the Weld County Code as follows: A. Section 23-2-220.A.1. -- The proposed use is consistent with Chapter 22 and any other applicable code provisions or ordinance in effect. Section 22-5-100.A - OG.Goal 1. states, "Promote the reasonable and orderly exploration and development of oil and gas mineral resources" and Section 22-2-80 D - I.Goal 4. states, "All new industrial development should pay its own way." USR14-0079 Page 2 of 10 The applicant, Kerr-McGee, will be paying for all offsite improvements associated with this use as required through the improvements agreement. Section 22-6-20.C.1 - ECON.Policy 3.1. states, "County activities and regulation should protect the rights of private property owners and the public health, safety and welfare, recognizing that these basic rights and protections allow the free market to prosper and grow the local economy." The applicant, Kerr-McGee Gathering (KMG), LLC, is proposing a natural gas compressor station and a laydown yard. The laydown yard will be utilized for storage of various oil and gas support services equipment. The applicant is proposing signage, lighting, and fencing. This is an unmanned facility therefore no water or septic will be installed. The hours of operation are proposed to be 24 hours a day / 7-days a week. Section 23-2-220.A.2. -- The proposed use is consistent with the intent of the A (Agricultural) Zone District Section 23-3-40.A.2 which allows for a Site Specific Development Plan and Use By Special Review Permit for Mineral Resource Development Facilities including Oil and Gas Support and Service Facilities (compressor station for natural gas and all related equipment, including, but limited to, eight (8) compressors, vapor recovery units, separators, dehydrators, storage tanks, a laydown yard, and one (1) seventy-foot in height communications tower) in the A (Agricultural) Zone District. C. Section 23-2-220.A.3 -- The uses which will be permitted will be compatible with the existing surrounding land uses. The adjacent properties are mainly utilized for pastures and crops. The closest residence is approximately one-half mile northwest of the site. There are two (2) USRs located within one mile of this parcel. USR-399 for 200 dairy cows is located northwest of the site and USR-1236 for power lines is located adjacent to the north boundary of the site. The Weld County Department of Planning Services has not received any communication from the surrounding property owners concerning this USR. The application materials include a USR map with lighting, screening, and signage delineated. The Development Standards and Conditions of Approval for this proposal will assist in mitigating the impacts of the facility on the adjacent properties and ensure compatibility with surrounding land uses. D. Section 23-2-220.A.4 -- The uses which will be permitted will be compatible with future development of the surrounding area as permitted by the existing zoning and with the future development as projected by Chapter 22 of the Weld County Code and any other applicable code provisions or ordinances in effect, or the adopted Master Plans of affected municipalities. The site is located within the three (3) mile referral area of the Town of Platteville. The Town of Platteville did not respond with any referral comments. E. Section 23-2-220.A.5 -- The application complies with Chapter 23, Article V, of the Weld County Code. The existing site is within the County-Wide Road Impact Fee Area and the Capital Expansion Impact Fee area. USR14-0079 Page 3 of 10 The site is not in a special flood hazard area. Building Permits issued on the lot will be required to adhere to the fee structure of the County-Wide Road Impact Fee Program. Building Permits issued on the proposed lot will be required to adhere to the fee structure of the County Facility Fee and Drainage Impact Fee Programs. F. Section 23-2-220.A.6 -- The applicant has demonstrated a diligent effort to conserve prime agricultural land in the locational decision for the proposed use. The proposed facility is located on approximately 20 acres of "Prime (Irrigated)" soils and 141 acres of"Other" soils per the 1979 Soil Conservation Service Important Farmlands of Weld County Map. The laydown yard is on about 10 acres of"Prime (Irrigated)" soils and the gas compressor is located on "Other" soils. Once the laydown yard is removed the land can be used again for agricultural purposes. G. Section 23-2-220.A.7 -- There is adequate provisions for the protection of the health, safety, and welfare of the inhabitants of the neighborhood and County. The Design Standards (Section 23-2-240, Weld County Code), Operation Standards (Section 23-2-250, Weld County Code), Conditions of Approval and Development Standards ensure that there are adequate provisions for the protection of health, safety, and welfare of the inhabitants of the neighborhood and County. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. Prior to recording the map: A. An Improvements Agreement and Road Maintenance Agreement is required for offsite improvements at this site during construction. Road maintenance including dust control, damage repair, specified haul routes and future triggers for improvements will be included. (Department of Planning Services-Engineer) B. The applicant shall complete a Nonexclusive License Agreement for the upgrade and maintenance of Weld County Right-of-Way (CR 33). (Department of Planning Services- Engineer) C. The applicant shall submit evidence of an Air Pollution Emission Notice (APEN) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment to Environmental Health Services Division of the Weld County Department of Public Health and Environment. Alternately, the applicant can provide evidence that they are not subject to these requirements. (Department of Public Health and Environment) D. The map shall be amended to delineate the following: 1) All sheets of the map shall be labeled USR14-0079. (Department of Planning Services) 2) The attached Development Standards. (Department of Planning Services) 3) The map shall be prepared per Section 23-2-260.D of the Weld County Code. (Department of Planning Services) 4) The map shall delineate the lighting. (Department of Planning Services) USR14-0079 Page 4 of 10 5) All signs shall be shown on the map and shall adhere to Chapter 23, Article IV, Division 2 and Appendices 23-C, 23-D and 23-E of the Weld County Code. (Department of Planning Services) 6) County Road 26 is designated on the Weld County Road Classification Plan as a local gravel road which requires 60 feet of right-of-way at full build out. The applicant shall verify and delineate on the map the existing right-of-way and the documents creating the right-of-way. All setbacks shall be measured from the edge of future right-of-way. Upon completion of Condition of Approval #1 above, the applicant shall submit one (1) paper copy or one (1) electronic copy (.pdf) of the map for preliminary approval to the Weld County Department of Planning Services. Upon approval of the map the applicant shall submit a Mylar map along with all other documentation required as Conditions of Approval. The Mylar map shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The map shall be prepared in accordance with the requirements of Section 23-2-260.D of the Weld County Code. The Mylar map and additional requirements shall be submitted within one hundred twenty (120) days from the date of the Board of County Commissioners Resolution. The applicant shall be responsible for paying the recording fee. (Department of Planning Services) 3. In accordance with Weld County Code Ordinance #2012-3, approved April 30, 2012, should the map not be recorded within the required one hundred twenty (120) days from the date of the Board of County Commissioners Resolution, a $50.00 recording continuance charge shall added for each additional three (3) month period. (Department of Planning Services-Engineer) B. The applicant shall develop an Emergency Action and Safety Plan with the Office of Emergency Management and the Fire District. The plan shall be reviewed on an annual basis by the Facility operator, the Fire District and the Weld County Office of Emergency Management. Submit evidence of acceptance to the Department of Planning Services. (Department of Planning Services) 7. One month prior to operation: A. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be provided to Environmental Health Services Division of the Weld County Department of Public Health and Environment. The Use by Special Review activity shall not occur, nor shall any building or electrical permits be issued on the property, until the Use by Special Review map is ready to be recorded in the office of the Weld County Clerk and Recorder or the applicant has been approved for an early release agreement. (Department of Planning Services) USR14-0079 Page 6 of 10 SITE SPECIFIC DEVELOPMENT PLAN USE BY SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS Kerr-McGee Gathering, LLC USR14-0079 1. A Site Specific Development Plan and Use By Special Review Permit, USR14-0079, for Mineral Resource Development Facilities including Oil and Gas Support and Service Facilities (compressor station for natural gas and all related equipment, including, but limited to, eight (8) compressors, vapor recovery units, separators, dehydrators, storage tanks, a laydown yard, and one (1) seventy-foot in height communications tower) in the A (Agricultural) Zone District, subject to the Development Standards stated hereon. (Department of Planning Services) 2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld County Code. (Department of Planning Services) 3. This is an unmanned facility as stated by the applicant. (Department of Planning Services) 4. The hours of operation will be 24 hours a day / 7-days a week, as stated by the applicant. (Department of Planning Services) 5. The parking on the site shall be maintained. (Department of Planning Services) 6. All signs shall adhere to Chapter 23, Article IV, Division 2 and Appendices 23-C, 23-D and 23-E of the Weld County Code. (Department of Planning Services) 7. The landscaping/screening on the site shall be maintained. (Department of Planning Services) 8. Co-location of other antennas by other service providers shall be allowed. (Department of Planning Services) 9. The property owner or operator shall provide written evidence of an Emergency Action and Safety Plan on or before March 15 of any given year, signed by representatives of the Fire District and the Weld County Office of Emergency Management, to the Department of Planning Services. (Department of Planning Services) 10. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. (Department of Planning Services-Engineer) 11. The historical flow patterns and runoff amounts will be maintained on the site. (Department of Planning Services-Engineer) 12. Weld County is not responsible for the maintenance of onsite drainage related features. (Department of Planning Services-Engineer) 13. There shall be no parking or staging of vehicles on County roads. On-site parking shall be utilized. (Department of Planning Services-Engineer) 14. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended)shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. (Department of Public Health and Environment) USR14-0079 Page 7 of 10 15. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The facility shall operate in accordance with the accepted "waste handling plan", and with Chapter 14, Article 1 of the Weld County Code, at all times. (Department of Public Health and Environment) 17. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the accepted "dust abatement plan", at all times. Fugitive dust shall attempt to be confined on the property. Uses on the property shall comply with the Colorado Air Quality Commission's Air Quality Regulations. (Department of Public Health and Environment) 18. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. As employees or contractors are on site for less than 2 consecutive hours a day portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. (Department of Public Health and Environment) 19. All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. (Department of Public Health and Environment) 20. A Spill Prevention, Control and Countermeasure Plan, prepared in accordance with the applicable provisions of 40 CFR, Part 112 shall be available on site. (Department of Public Health and Environment) 21. This facility shall adhere to the maximum permissible noise levels allowed in the Non-Specified Zone as delineated in Section 14-9-30 of the Weld County Code, or with all applicable State noise statutes and/or regulations. (Department of Public Health and Environment) 22. The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. (Department of Public Health and Environment) 23. Sources of light shall be shielded so that light rays will not shine directly onto adjacent properties where such would cause a nuisance or interfere with the use on the adjacent properties in accordance with the plan. Neither the direct, nor reflected, light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets. No colored lights may be used which may be confused with, or construed as, traffic control devices. (Department of Planning Services) 24. Building permit maybe required, per Section 29-3-10 of the Weld County Code. Currently the following has been adopted by Weld County: 2012 International Codes; 2006 International Energy Code; 2011 National Electrical Code; A building permit application must be completed and two complete sets of engineered plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted for review. A geotechnical engineering report performed by a registered State of Colorado engineer shall be required or an open hole inspection. (Department of Building Inspection) 25. The property owner or operator shall be responsible for complying with the Design and Operation Standards of Chapter 23 of the Weld County Code. USR14-0079 Page 8 of 10 26. Necessary personnel from the Weld County Departments of Planning Services, Public Works, and Public Health and Environment shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Conditions of Approval and Development Standards stated herein and all applicable Weld County regulations. 27. The Use by Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Substantial changes from the plans or Development Standards, as shown or stated, shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 28. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 29. WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive agricultural counties in the United States, typically ranking in the top ten counties in the country in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with long-standing agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural areas: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well-run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest and gravel roads; odor from animal confinement, silage and manure; smoke from ditch burning; flies and mosquitoes; hunting and trapping activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. It is common practice for agricultural producers to utilize an accumulation of agricultural machinery and supplies to assist in their agricultural operations. A concentration of miscellaneous agricultural materials often produces a visual disparity between rural and urban areas of the County. Section 35-3.5- 102, C.R.S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Water has been, and continues to be, the lifeline for the agricultural community. It is unrealistic to assume that ditches and reservoirs may simply be moved "out of the way" of residential development. When moving to the County, property owners and residents must realize they cannot take water from irrigation ditches, lakes, or other structures, unless they have an adjudicated right to the water. Weld County covers a land area of approximately four thousand (4,000) square miles in size (twice the size of the State of Delaware) with more than three thousand seven hundred (3,700) miles of state and County roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the County, and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. USR14-0079 Page 9 of 10 People are exposed to different hazards in the County than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs and livestock, and open burning present real threats. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. NOISE ABATEM ENT PLAN ,(REVISED 6-1 -2015) _ Formatted: Highlight I ntroduction The Cannon Compressor Station is a proposed Kerr-McGee Gathering, LLC (KMGG) facility located in Weld County. This facility is needed to help transport the increasing amounts of natural gas to processing facilities where it is then prepared for sale to market. KMGG has taken steps to attenuate noise originating from this site and will continue to take the necessary actions to comply with COGCC noise regulation. The following plan outlines how noise is mitigated at the Cannon Compressor Station site. Location and Surrounding Land Use The proposed Cannon Compressor Station access road is located approximately 760 feet north of the intersection of WCR 26 and WCR 33 in an area zoned for agriculture. Proposed I mprovements KMGG is proposing the installation eight (8) compressors. There will be six (6) CAT3606LE/Ariel JGK- 3, and two (2) 3750 HP Electric Units. There will also be one 60,000 gallon slug catcher, two (2) 30 MMscfd and one (1) 50 MMscfd coalescing filter separators, two (2) 30 MMscfd and one (1) 50 MMscfd TEG dehydrator-condenser-VRU's, one condensate pump skid and associated piping and electrical infrastructure. Noise Regulation and Goal There is no equipment presently at the proposed site. Under the current COGCC regulations, permissible noise levels cannot exceed 55 dBA during the day or 50 dBA at night. KMGG will ensure the installed equipment complies with these COGCC regulations. KMGG also has the ultimate goal of not exceeding 50 dBA at all times and will be measured at the fence line of the facility. Effortsto Date KMGG has already begun efforts to reduce noise on-site by designing High Specification Noise Suppression Packages (HSNSP) for the first three Cat3606LE/Ariel JGK-3 compressor/cooler packages. AGREEMENT BETWEEN WELD COUNTY, COLORADO, AND ANADARKO E&P COMPANY LP, FOR A TEMPORARY STAGING AREA THIS AGREEMENT ("Agreement") is made and entered into this 7 ' day of February, 2015, by and through the County of Weld, State of Colorado ("County"), acting through the Weld County Director of Planning Services, and Anadarko E&P Company LP, whose address is 1099 18th Street, Suite 1800, Denver, Colorado 80202. RECITALS WHEREAS, Anadarko E&P Company LP, owns the property described as part of SE4 of Section 34, T3N, R66W of the 6th P.M., Weld County, CO (hereinafter "Property"); and WHEREAS, Anadarko E&P Company LP, wishes to place a temporary staging area ("Temporary Staging Area") on the Property for the temporary storage of drill pipe, iron pipe, poly pipe, fittings, parts of drill rigs, 2 trailer, and rig mats in the A (Agricultural) Zone District in Weld County; and WHEREAS, Section 23-3-40.S of the Weld County Code states in pertinent part that a Use By Special Review Permit is required in the A (Agricultural) Zone District for, "[alto/ use permitted as a Use by Right, an Accessory Use, or a Use by Special Review in the Commercial or Industrial zone districts, provided that the property is not a Lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling subdivisions"; and WHEREAS, although the proposed Temporary Staging Facility falls under Section 23-3- 40.S, because Anadarko E&P Company LP, shall utilize the Temporary Staging Area for six months or less, County believes it is beneficial to the applicant and residents of. Weld County to allow the Temporary Staging Facility to be temporarily placed on the Property without requiring a Use By Special Review Permit. NOW, THEREFORE, in consideration of the foregoing, County consents to allow a Temporary Staging Area to be located on the Property in accordance with the following terms and conditions: 1 . The above recitals are incorporated herein by reference. 2. The Temporary Staging Area can stay on the Property for a maximum period of six months from February cral , 2015. After the initial six months the Director of Planning Services has the ability to extend the temporary staging for an additional six months. After the initial six months, or 12 months if the Director of Planning Services has approved additional time, the Temporary Staging Area shall be removed from the Property or the Applicant shall apply to Amend Use by Special Review permit USR14- 0079 to include the laydown yard. 1 3 . The improvements and equipment associated with the Temporary Staging Area shall be restricted to the temporary storage of drill pipe, iron pipe, poly pipe, fittings, parts of drill rigs, 2 trailers, and rig mats. 4. No permanent disposal of waste shall be permitted at the Temporary Staging Area or Property. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. Waste materials shall be handled, stored, and disposed of in a manner that controls potential nuisance conditions. Before placement of the Temporary Staging Area the applicant will need to submit a waste handling plan to the Weld County Department of Environmental Health for review and approval. The Temporary Staging Area shall operate in accordance with the approved waste handling plan at all times 5. Staging or parking trucks on the public rights of way is prohibited. Nuisance conditions, including, but not limited to, mud, dirt and debris and puddles on publicly maintained roads, are to be prevented and immediately addressed by Anadarko E&P Company LP, at their sole expense, and to the County's reasonable satisfaction. 6. Anadarko E&P Company LP, shall be responsible, at its sole expense, for excavating, repairing, or patching any damage resulting from ingress or egress to the Property from adjacent publically maintained roadways located in the County. The County shall be consulted prior to any work being conducted on any County maintained road. The type and method of repair will be determined by the County and must be performed and completed to the County's reasonable satisfaction. 7. Failure by Anadarko E&P Company LP, to adhere to the terms and conditions of this Agreement, as solely determined by the County, may, at the County's sole discretion, result in the termination of this Agreement. In the event this Agreement is so terminated, Anadarko E&P Company LP, shall have Fifteen (15) days to remove the Temporary Staging Facility and to return the Property to the condition it was in prior to the execution of this Agreement or to a condition approved by the property owner. Failure to do so within the Fifteen ( 15) day period may result in prosecution for violations of the Weld County Code 8. A Construction Storm Water Discharge Permit is required from the Colorado Department of Public Health and Environment (CDPHE) for any person or entity that may surface disturb, grade, construct, or excavate over one (1 ) acre of land. In addition, unless exempted, the Department of Planning Services - Engineering requires a grading permit for any surface disturbance over one (1 ) acre of land. 9. Anadarko E&P Company LP, shall set up and operate the Temporary Staging Area in compliance with all applicable Federal, State, and local statutes, rules, and regulations. 2 10. Anadarko E&P Company LP, acknowledges that the County is a governmental entity that has limited liability in certain situations. No term or condition of this Agreement shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protections or other provisions of the Colorado Governmental Immunity Act §§24-10-101 et seq. , C.R.S., as applicable now orhereafter amended. 11 . It is expressly understood and agreed that the enforcement of the terms and conditions of this Agreement, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties and nothing in this Agreement shall give or allow any claim or right of action whatsoever by any other person not included in this Agreement.
