Dear Ms. Mikulas:
This letter is in response to your request for a water service commitment for the proposed
concrete plant, asphalt plans, and Rail unloading facility, in the location described as follows:
PORTIONS OF SEC.18, T5N,R67W -- WELD COUNTY, CO.
The District provides water service within its service area as defined by the District. The
provision of water service by extension of existing water lines of the District to the above property and
the installation of taps for lots is done under the terms of the Rules and Regulations of the District
established by the Board of the District from time to time. You may obtain a copy of the Rules and
Regulations from the District. This letter outlines the provisions of the Rules and Regulations, however
this letter does not change any provisions of the Rules and Regulations. The Board of the District may
alter and amend the Rules and Regulations at any time, and the provisions of this letter are subject to
alteration and amendment based on changes in the Rules and Regulations of the District.
We currently have 12" diameter water lines located along WCR 13 and WCR 15 Therefore, we
can commit to provide service to the above property, subject to the limitations in this letter, for one
Commercial 2" water tap. The following additional limitations on the provision of water service are:
1. All improvements to District facilities required to provide service will be the financial
responsibility of the developer in accordance with the District Rules and Regulations.
2. Little Thompson Water District does not currently accept cash in lieu payments
for water rights for developments. You will be required to provide water rights to
meet the projected needs of the proposed development, both CBT water shares and
several native ditch system water shares can be utilized to meet these needs. You would
need to provide historical usage information to evaluate the ditch shares for dedication
for this project. You will also be responsible for some water share fees and a dry up
covenant for any dedicated native ditch shares. Based on the information provided you
will need to provide 40 acre-Feet of firm yield water for the short term (2016)
development, and potentially up to another 38 acre-Feet to cover the long term
development needs and dust control.
3. There is a $2,000 per hydrant fee that needs to be paid prior to installation of any fire
hydrant. You will be responsible for any improvements or upgrades needed to meet the
required fire flows for your project.
4. You will be required to provide the needed water lines for the proposed project.
5. LTWD can provide water service to meet your proposed, short term (2016)
development, average demands of 56 GPM ( 168 GPM max flow) through the existing
1" tap and an additional 2" tap for the project. It is possible that you will need a second
1 '/x - 2" tap to serve the potential long term and dust control demands for the project in
the future. LTWD can provide service to these potential 2 new 2" taps through the
existing infrastructure with only a loop built between WCR 13 and WCR 15.
6. In order to provide the requested Fire Flow of 1500 GPM, on a peak day, you will be
required to install a significant upgrade to the LTWD system in the area. You would
need to upgrade existing LTWD water lines along LCR 18 from WCR 13 to 1-25 (2.3
miles) with a 16" diameter waterline that will replace the existing 8" diameter line. The
design, installation and total cost of the project will be the responsibility of the
developer. It is possible to deliver up to 1400 GPM with the installation of a
12"diameter line in the same alignment.
I might be worth the time for us to jointly have a meeting with the Fire District about
the situation. On an average (not peak usage) day we have measured 1300 gpm in
available fire flow on WCR 13 just south of your site. This was at hydrant 1839.2 in
May 2008 (120 psi static/ 80 psi flow). It is also might be reasonable to consider
utilizing on site storage for fir suppression. Large diameter water lines just for fire
flow are becoming a problem for us in managing water quality. We need to balance our
line size to meet both water quality needs as well as fire protection needs.
7. Prior to initiating water service, you will need to provide evidence that the property is
included in the Little Thompson Water District and the Municipal Sub District of the
Northern Colorado Water Conservancy District. It looks like at least one parcel will
need to be included in the Little Thompson Water District. We can help you through
that process prior to initiating service to the new tap. You can find information on
having your property included in the Municipal Sub District of the Northern Colorado _.... __
Water Conservancy District at the offices of the Northern Colorado Water Conservancy
District.
8. Prior to initiating service and constructing any water system improvements we will
need to execute a water service agreement that outlines your responsibilities for
dedicating adequate water to cover your need both short term and in the future. The
agreement will also address when you would need to have an additional tap to meet
future service demands.
9. LTWD is able to work with you on the potential transfer of ownership and relocation of
the 4" Magpie tap currently located at WCR 3 and Hwy 60. This tap has been out of
service, at the direction of Weld County, for some time. Our Board of Directors has
approved the potential relocation of this tap in the past. We will work with you to allow
hall credit for the 4" tap (at current value) toward the new tap at the proposed location.
We will need to meet and develop the details of this exchange based on what you
determine to be your final needs for taps and water dedication for the proposed project.
This commitment letter will expire two years from the date of this letter if the tap has not been
purchased, paid for and installed by that date of expiration. YOU ARE HERI±,BY ADVISED THAT

CHANGE WITHOUT NOTICE; AND THIS LETTER IS ISSUED WITH THE SPECIFIC

TARIFFS APPLICABLE TO THE ABOVE PROPERTY AT ANY TIME WITHOUT NOTICE

There is an existing septic system on the west side of the proposed project area that serves the
existing Gerrard facility (SP-0701064, SP-1000036) and there is an existing septic system on the
property at 6433 WCR 56 that serves the existing residence (SE-0000094). Martin Marietta will
be applying for one to two more septic systems at their facility to serve the sanitary sewer needs
of all of the uses within the rail spur loop. The locations of the existing and proposed septic
fields associated with Martin Marietta's facility are all called out on the USR plat map. The
asphalt plant operates on a seasonal basis; therefore, Martin Marietta will use portable toilets to
serve the asphalt plant, similar to Martin Marietta's asphalt operation in Greeley.

TERMS AND CONDITIONS
'A permit fee,as set by separate ordiance of the Board of Weld County Commissioners,shall be required of applicants for new individual sewage disposal
• systems(ISDS),payable at time of application. Permit fees are non-refundable; permit applications are non-transferable. If both a building permit
and an ISDS are issued for the same property and construction is not commenced prior to the expiration date of the building permit,the ISDS permit shall
expire at the same time as the building permit.If an ISDS permit is issued for a property that does not require a building permit,the ISDS permit shall
expire one year after its issuance if construction on the septic system has not commenced.Any change in plans or specifications after the permit has
been issued invalidates the permit unless approval is secured from the Health Officer or his/her designated agent. Expired permits can be renewed by
payment of the permit fee only if:
A.There has been no change in the plans and specifications of the proposed system as set out in the original application or such change is
reviewed and approved by a Division Representative.
B.The surrounding land, its use or zoning has not changed so-as-to cause the original application not to be acceptable under these regulations.
NOTICE
The completeness of this application is conditional upon further mandatory and additional tests and reports as may be required by the Weld County
Department of Public Health and Environment(WCDPHE).The issuance of the permit is subject to such terms and conditions as deemed necessary to
insure compliance with rules and regulations adopted under article 10 title 25,CRS as amended.The applicant cedes that the proposed system will not
be located within 400 feet of a community sewage system.The undersigned certifies that all statements made,information and reports submitted

Septic SP-0701064 was designed for 30 office/shop workers. The shop was built and the septic
system was installed in January of 2008; however, the office building was not built at that
time. On 4/1/2010, I spoke with Nathan Gerard regarding the proposed office building and
informed him that if there is no increase in number of employees, then a minor repair permit
is issued to connect to septic system SP-0701064. Otherwise, if there is an increase in
hydraulic load, then the septic system will need to be evaluated by an engineer.
In regards to the temporary office trailers (while the permanent office building is being
built), the same applies as above. If there is no increase in number of employees, then only
minor repair permits will be required to connect the temporary office trailers
to septic SP-0701064.

On August 29, 2000, an evaluation of the existing individual septic disposal system at, 6433 Weld County
Road 56, Loveland, Colorado; Section 18 Township 5 North, Range 67 West, was conducted by Pam Smith.
Based on all available data, there is not enough information available to determine if the septic system
identified above is of sufficient size to accommodate the structure served by this system.There were no
visible signs of failure at the time of inspection. This evaluation is based on a final treatment capacity for
a 2 bedroom residence.
Be advised, neither the County of Weld nor any of its agents or employees undertake or assume any liability
to the owner of the above property,to any purchaser of the above property or to any lending agency making a
loan on the above property or in the report.
This inspection was conducted for the purpose of determining compliance with current regulations and for
detecting health hazards observable at the time of inspection. This does not constitute a warranty that the
system is without flaw or that it will continue to function in the future. Inspections requested during periods
of snow cover and high soil saturation may be of questionable value to potential buyers due to adverse
conditions. Evaluations based on Statements of Existing(S.O.E.) relies on information the property owner
provides, under oath, indicating current status of the system and representing to the best of his/her knowledge
