CO, WHEREAS, Noffsinger Manufacturing Company, Inc., Greeley, Colorado, has submitted an application for the purpose of exempting a tract of land described as follows, to-wit: All of the East Half of the Northeast Quarter of the Northeast Quarter of Section 3, Township 5 North, Range 65 West of the 6th P. M. , Weld County, Colorado, more particularly described as follows: Beginning at the Northeast corner of said Section 3; thence along the East line of the Northeast Quarter of said Section South 0°10'08" West 1217. 32 feet to the Southeast corner of the East Half of the Northeast Quarter of the Northeast Quarter of said Section; thence along the South line of said East Half South 89°14'39" West 659. 91 feet to the Southwest corner of said East Half; thence along the West line of said East Half North 0°11 X24" East 1226. 02 feet to the Northwest corner of said East Half; thence along the North line of the Northeast Quarter of said Section North 89°59'56" East 659. 37 feet, more or less, to the Point of Beginning, from the definition of "subdivision" or "subdivided land" pursuant to C. R. S. 30-28-101, 1973, as amended, and WHEREAS, said petition came on for hearing on December 24 , 1975, and the Board of County Commissioners of the County of Weld, State of Colorado, having heard the testimony and evidence adduced upon said hearing and having considered the testimony, evidence, remonstrances, and recom- mendations of the Weld County Planning Commission filed with said Board, and having carefully weighed the same, now makes the following findings: 1 . The evidence discloses that the applicant failed to sustain the burden of proof as to the need for a recorded exemption, and that good cause has not been shown why such exemption should be granted as required by Section 9 of the Weld County Subdivision Regulations. 2. The evidence discloses that the proposed land division is not in conformance with the intent of the recorded exemption procedure which is defined as "a means whereby non-productive agricultural lands may be de- veloped for higher or more productive uses, insofar as such uses are com- patible with surrounding agricultural uses in areas where such land divisions are proposed". 3. The evidence and investigation show that the property in question is composed of class II and III, irrigated agricultural lands. 4. The evidence discloses that the proposed land division does not conform to the Weld County Comprehensive Plan in that it promotes non- agricultural use of agricultural land. 5. The proposed 2. 98 acre parcel that is proposed to be exempted contains a residence that was issued a permit on the basis that it was con- sidered an accessory structure for a farming operation, as living quarters for persons customarily employed at the principal permitted use; specifically, for care of horses kept on the larger tract from which the smaller parcel is proposed to be severed. 2 / )9'1 ./cr'_ f f/ 760569 The evidence still further discloses that if such development as requested herein were allowed, any residential type development would put airport expansion in a very precarious position, especially, as to any future airport expansion. 5. That each of the preceding finds in and of themselves and inde- pendent of each other constitutes a separate and individual ground for denial of a recorded exemption under Section 9 of the Weld County Subdivision Regulations. RESOLUTION WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, has heard the application of Noffsinger Manufacturing Company, Inc. , of Greeley, Colorado, for recorded exemption under Section 9 of the Weld County Subdivision Regulations, of a parcel of land as hereinabove recited and made a part hereof by reference, and WHEREAS, said Board has made its findings on the evidence and testimony submitted to it, which findings precede this Resolution and by reference are incorporated herein and made a part hereof, and WHEREAS, the Board has carefully considered the petition, the evidence, testimony and remonstrances and the recommendations of the Weld County Planning Commission and have given the same such weight as in its discretion deems proper, and is now fully advised in the premises. NOW, THEREFORE, BE IT RESOLVED, that the petition of Noffsinger Manufacturing Company, Inc. of Greeley, Colorado, requesting a recorded exemption under Section 9 of the Weld County Subdivision Regulations, of a parcel of land indicated above be, and it hereby is denied on each of the grounds set forth in the Board's findings therein. The parcel contains 18. 5 acres of irrigated pasture and the request is to split 2.98 acres. Based on the information submitted and Weld County Regulations, the Planning staff recommends denial for the following reasons: • 1 . The proposed split does not conform with the intent, Section 9-2 of the Weld County Regulations for Recorded Exemptions. The section states: "The intent in establishing the Recorded Exemption procedure is to provide, in accordance with the Weld County Comprehen- sive Plan, a means whereby non-productive agricultural lands may be developed for higher or more productive uses, in-so- far as such uses are compatible with surrounding agricultural uses in areas where such land divisions are proposed. (Rev. 4/17/74)" The proposed 2. 98 parcel contains a residence that was issued a permit on the basis it was considered an accessory structure for the farm operation, as living quarters for persons customarily employed at the principal permitted use. The proposed division would not be in compliance with the Compre- hensive Plan in that the division would promote or encourage premature division of a9rtcolturaiiy oriented dctiytty. ATTENDANCE. Present: President-Phil Brewer, Tom Carter, Harlan Houtchens, Roy Moser, and Warren Terry. Absent: Gordon Johnson, Ernest Martin, Jerry Ratliff, and Jack Shupe. 2. APPROVAL OF MINUTES OF DECEMBER 9, 1975 REGULAR MEETING AND DECEMBER 18, 1975 SPECIAL MEETING AS MAILED TO EACH BOARD MEMBER. Motion by Tom Carter and seconded Roy Moser that the minutes of the December 9, 1975 regular meeting and the December 18, 1975 special meeting be approved as written. Motion carried unanimously. 3. RECOMMENDATIONS CONCERNING RECORDED EXEMPTION AS REFERRED BY COUNTY COMMISSIONERS. The Board discussed the recorded exemption by Noffsinger Manufacturing Company, Inc. which was referred by the Weld County Commissioners for a recommendation. The discussion centered around the possibility of numerous requests in the future for such exemptions and the added cost that this may cause if the Airport is developed in the future and this land will have to be acquired. Motion by Tom Carter and seconded by Harlan Houtchens to recommend to the Weld County Commissioners that the recorded exemption requested by Noffsinger Manufacturing Company, Inc. be denied because of planned future Airport expansion and the possibility of greatly increased costs of acquiring this land for future ex ansion. Motion carried. 4. DECEMBER FINANCIAL REPORT. The December financial report will be presented at a later date. 5. MANAGER'S REPORT.
