RE : DENIAL OF CLAIM OF FRANK BATY AND LOIS BATY AGAINST WELD
COUNTY FOR DIRT, GRAVEL AND PIT RUN FURNISHED TO WELD
COUNTY.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, Frank Baty and Lois Baty, husband and wife, of
29168 West County Road No. 388, Kersey, Colorado 80644 , did ,
on the 13th day of July, 1977 , file a claim against Weld County,
asking for the sum of $4, 000 . 00 to $4 , 700. 00 for some 40 ,000 to
47, 000 cubic yards of dirt, gravel and pit run removed from
property owned by the said Frank Baty and Lois Baty, from
October 8, 1975 through December, 1975, and
WHEREAS, the Board of County ComrLlissioners of Weld County,
Colorado did conduct a public hearing on said claim on the
27th day of July, 1977, at which time evidence was taken both in
support of said claim and in opposition to this claim, and
WHEREAS, the Board of County Commissioners having considered
all of the evidence and the testimony presented at the aforemen-
tioned public hearing, does find that Frank Baty and Lois Baty,
husband and wife, did, in 1975, agree with Weld County through
Mr. Roy Moser, then County Commissioners for the Third Commis-
sioner District of Weld County, Colorado, that Weld County would
remove a certain amount of dirt, gravel, and pit run from the
real estate owned by Frank Baty and Lois Baty, in exchange for
the resultant leveling and improvement of the area from which
the aforementioned dirt, gravel and pit run was removed and,
further, for the consideration of the improvement of a road
across the property owned by Frank Baty and Lois Baty, and
further, for dirt removing services in connection with filling
in around the home located on the Baty property, and for the
further consideration of preparing a retaining wall on said
Baty property.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the claim of Frank
Baty and LoisBaty of 29168 Weld County Road No. 388 , Kersey,ei L

Colorado 80644 , which claim is in the sum of $4, 000. 00 to
$4, 700. 00, be and hereby is denied.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote at a special
meeting of the Board of County Commissioners of Weld County,
Colorado, on the 27th day of July, A.D. , 1977.
