HomeMy WebLinkAbout20153187.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO OCTOBER 5, 2015 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, October 5, 2015, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tern Commissioner Sean P. Conway Commissioner Julie A. Cozad Commissioner Steve Moreno Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly • MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of September 30, 2015, as printed. Commissioner Moreno seconded the motion, and it carried unanimously. • AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner Cozad moved to approve the Consent Agenda as printed. Commissioner Freeman seconded the motion, and it carried unanimously. IR PUBLIC INPUT: No public input was given. BIDS: 1) APPROVE BID #B1500160, ELECTION ASSET MANAGEMENT SOFTWARE - ELECTIONS OFFICE: Based on a work session discussion and the need for budgetary considerations, Commissioner Cozad moved to reject bid #61500160. The motion was seconded by Commissioner Freeman, and it carried unanimously. La 2) PRESENT BID #B1500167, CONCRETE MAINTENANCE AND REPAIR CONTRACT - DEPARTMENT OF PUBLIC WORKS: Trevor Jiricek, Director of General Services, presented the four (4) bids received and stated staff will make a recommendation on October 19, 2015. h� g Minutes, October 5, 2015 2015-3187 Page 1 BC0016 NEW BUSINESS: la 1) CONSIDER GRANT OF NON-EXCLUSIVE ACCESS EASEMENT (LOT 2 AND 3) AND GRANT OF NON-EXCLUSIVE EASEMENT FOR WATER CONVEYANCE STRUCTURES ACCESS PROPOSED LOT 4 OF GEISERT PIT SUBDIVISION TO THE CENTRAL COLORADO WATER CONSERVANCY DISTRICT AND AUTHORIZE CHAIR TO SIGN: Bruce Barker, County Attorney, explained it is for the easement that will allow the Central Colorado Water Conservancy District to build an inlet structure for the Geisert Pit. Commissioner Freeman moved to approve said grant of non-exclusive easement and authorize the Chair to sign. Seconded by Commissioner Conway, the motion carried unanimously. la 2) CONSIDER TEMPORARY CLOSURE OF CR 39 BETWEEN CRS 32 AND 28: Janet Lundquist, Department of Public Works, reported the closure will be effective October 5, 2015, through October 22, 2015, for roadway construction as part of the HRP Project. She said staff will use standard road signs and barricades. Commissioner Moreno moved to approve said temporary closure. Seconded by Commissioner Cozad, the motion carried unanimously. 3) CONSIDER TEMPORARY CLOSURE OF CR 44 BETWEEN CRS 41 AND 43: Ms. Lundquist stated the closure will occur from October 12, 2015, through October 23, 2015, and staff will use message boards in advance because of the amount of traffic, as well as, standard road signs and barricades. Commissioner Freeman moved to approve said temporary closure. Seconded by Commissioner Cozad, the motion carried unanimously. 4) CONSIDER EXTENSION OF TEMPORARY CLOSURE OF CR 58 (18TH STREET) BETWEEN FERN AVENUE AND CR 47.5, AND CR 47.5 BETWEEN U.S. HWY 34 AND CR 58: Ms. Lundquist stated the closure is an extension of a closure that was requested in 2014 and the contractor asked for more time to complete the work. Commissioner Moreno moved to approve said extension of temporary closure. The motion was seconded by Commissioner Conway, and it carried unanimously. 12 5) CONSIDER ITEMIZED LIST OF LEGAL HOLIDAYS DURING CALENDAR YEAR 2016: Commissioner Conway made a motion to approve the itemized list of legal holidays. The motion was seconded by Commissioner Moreno, and it carried unanimously. IR 6) CONSIDER CERTAIN EQUIPMENT AS SURPLUS PROPERTY, APPROVE SALE OF SAME AT AUCTION WITH ROLLER AND ASSOCIATES, AND DELEGATE AUTHORITY TO CONTROLLER TO SIGN ANY NECESSARY DOCUMENTS: Barb Connolly, Controller, presented Exhibit"A" as vehicles going to auction and requested a change to the list to replace a vehicle that was recently damaged. Commissioner Freeman moved to declare said equipment as surplus and approve sale of same at auction, with the exception of one item being #15220149. Seconded by Commissioner Conway, it carried unanimously. 12 7) SECOND READING OF CODE ORDINANCE#2015-17, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION, OF THE WELD COUNTY CODE: Commissioner Conway moved to read Code Ordinance#2015-17 by title only. The motion, which was seconded by Commissioner Cozad, carried unanimously. Mr. Barker read the title for the record. Ms. Connolly reported no changes made to this Code from first reading. No public input was offered concerning this matter. Commissioner Cozad moved to approve on Second Reading. Commissioner Moreno seconded the motion, and it carried unanimously. Minutes, October 5, 2015 2015-3187 Page 2 BC0016 E 8) SECOND READING OF CODE ORDINANCE#2015-18, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 3 HUMAN RESOURCES, OF THE WELD COUNTY CODE: Commissioner Cozad moved to read Code Ordinance #2015-18 by title only. The motion, which was seconded by Commissioner Conway, carried unanimously. Mr. Barker read the title for the record. Patti Russell, Director of the Department of Human Resources, stated no changes were made between first and second reading. No public input was offered concerning this matter. Commissioner Moreno moved to approve on Second Reading. The motion was seconded by Commissioner Freeman, and it carried unanimously. PLANNING: 1) CONSIDER RECORDED EXEMPTION, RECX15-0150 - MARLIN AND SHIRLEY NESS: Ryder Reddick, Department of Planning Services, presented the terms of this request, and expressed the City of Greeley would like to purchase the parcel for a public park. Mr. Reddick displayed a photo presentation and maps showing the layout of the parcel. Marlin Ness, resident of Greeley, explained the City of Greeley wants to buy his land for a public park and because it is in a floodplain he has no use for the parcel. Andy McRoberts, Director of Culture Parks and Recreation for City of Greeley, stated this will give the City access to the South Platte River and expand areas of natural resources. Commissioner Conway clarified the reason for the Department of Planning staff's denial is due to the five-year restriction. Commissioner Cozad moved to approve Recorded Exemption, RECX15-1050, and the motion was seconded by Commissioner Conway. Mr. Barker requested language be added to the Resolution to clear up the five-year time frame regulation as follows: "Be It Further Resolved, by the Board that sufficient facts and circumstances exist to waive the five (5) year time frame set forth in the Weld County Code Section 24- 8-40. M, and that the application of Marlin and Shirley Ness for Recorded Exemption, RECX15-0105, be, and hereby is, approved subject to the following. Commissioner Cozad moved to amend the resolution with the new language, and seconded by Commissioner Conway, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinances #2015-17 and #2015-18 were approved on Second Reading.
