RE: APPROVE FORM FOR INTERSTATE HIGHWAY CONSTRUCTION (IHC) INSURANCE
CLAIM FORM AND AUTHORIZE CHAIR TO SIGN - PARKWAY PROJECT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Insurance Claim Form between the
County of Weld, by and through the Board of County Commissioners of Weld County, on behalf
of the Weld County Department of Public Works, and Interstate Highway Construction (IHC),
commencing upon full execution of said form, with further terms and conditions being as stated in
said agreement form, and
WHEREAS, after review, the Board deems it advisable to approve the said insurance
claim form, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the insurance claim form between the County of Weld, by and through the
Board of County Commissioners of Weld County, on behalf of the Weld County Department of
Public Works, and Interstate Highway Construction, be and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair, be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 19th day of August, A.D., 2015.

RE: Weld County Parkway Project-IHC Insurance Claim Form
Interstate Highway Construction (IHC), concrete pavement subcontractor for the Weld County
Parkway, has requested Weld County sign and return the attached form and insurance claim
associated with the event which occurred on April 24, 2015 when the concrete pavement placed
was damaged by a vehicle.

RE: Weld County Parkway—IHC Insurance Claim Form

Brief description of the problem/issue:
The concrete pavement subcontractor (IHC) for the Parkway has requested the County sign and return a form
needed to process an insurance claim. The form and insurance claim is associated with an event which occurred
on April 24, 2015 during which concrete pavement being placed by IHC was damaged by a vehicle.
The damaged concrete pavement has now been replaced by IHC at no additional cost to the County. The CAO
(Bob Choate)has reviewed this form.
What options exist for the Board:
Option 1: The Board can choose to sign/retum the attached insurance claim form.
Option 2: The Board can choose to not sign/return the attached insurance claim form.
Option 3: The Board can offer alternative ideas.
Recommendation to the Board:
Public Works recommends the attached insurance form be signed/returned to IHC so they can be paid for the
damages caused.

hundred forty-nine dollars and forty-three cents($99,649.43),to be paid to Interstate Highway
Construction, does hereby acquit and forever discharge Western Equipment& Truck Inc. and its
employees, officers, and directors; Craig Sparrow;and National Indemnity Company for any
and all claims,which the undersigned now has,for property damage,resulting from the accident,
casualty or event which occurred on April 24, 2015 involving Weld County Parkway SH34 to
WCR 60 1/2,project SRP-23.
THE UNDERSIGNED HAS READ THE FOREGOING RELEASE AND FULLY
