HomeMy WebLinkAbout20152110.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JULY 15, 2015 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, July 15, 2015, at the hour of 9:00 a.m. J ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tern Commissioner Sean P. Conway - EXCUSED Commissioner Julie A. Cozad Commissioner Steve Moreno Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly • MINUTES: Commissioner Moreno moved to approve the minutes of the Board of County Commissioners meeting of July 13, 2015, as printed. Commissioner Cozad seconded the motion, and it carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda as printed. Commissioner Cozad seconded the motion, and it carried unanimously. • PUBLIC INPUT: No public input was given. COMMISSIONER COORDINATOR REPORTS: Commissioner Cozad thanked Toby Taylor, Director of Buildings and Grounds, for meeting her at the old library in Frederick to discuss a better use for the site She attended the Mead Town Board and learned about projects that include new water lines and updated roads. Chair Kirkmeyer stated she would appreciate if Commissioner Cozad would present her ideas about the Frederick Library property to the Board. NEW BUSINESS: 1) CONSIDER GRANT AGREEMENT FOR JUVENILE DIVERSION PROGRAM AND AUTHORIZE CHAIR TO SIGN: Kirsta Britton, District Attorney's Office, stated under this agreement the District Attorney's Office will receive funds from the Division of Criminal Justice. Commissioner Cozad moved to approve said grant agreement and authorize the Chair to sign. Commissioner Cozad stated this is a great intervention program and it is beneficial for kids. HEALTH: Ei 1) CONSIDER SUSPENSION OF COLORADO RETAIL FOOD ESTABLISHMENT LICENSE - KING WAH ASIAN FOOD: Deb Adamson, Department of Environmental Health, introduced Robert Chow, interpreter from Language Line Solutions Linguistical Services to assist with interpretation. She explained that King Wah has been assessed three (3) civil penalties in a twelve (12) month period. The restaurant owners need to work with a consultant and get training for staff, and staff will allow the owner to use the assessed civil penalties to come into compliance. She stated that staff recommends a short-term license suspension to assure that the issues have been resolved, and appear before the Board again if the violations are repeated. O Dan Joseph, Environmental Health, presented a slide show, and explained the main reasons for inspections are to prevent illness and protect the public. He reported that King Wah Asian Food had six inspections since June of 2014, and each time they were cited for an improper cold holding violation. He presented a summary of the inspections and demonstrated of the 33 violations, 21 of them were critical. Mr. Joseph cited the various violations and stated he had interpretation services provided by Language Lines interpret the actions regarding violations and made suggestions for compliance. He stated at a follow up inspection it was discovered the refrigerator was not working properly. He was told a repairman had been contacted but no corrective action was being done to save the food. = Mr. Joseph outlined the summary of recommendations stating staff is seeking a short term suspension, utilizing a consultant with two (2) follow-up inspections to verify compliance with no violations. The owner may use the $1,000 penalty to defray the cost of achieving compliance, which would include hiring a consultant and any expense incurred for purchasing new equipment. • Dou Ping Zhang explained she obtained her certificate of training from the website for cold handling, and it was issued to her July 13, 2015. She requested that the Board not suspend her business license because she received the training certificate. She explained she had a difficult time finding a consultant to train employees. Jeanie Reese and Janet Brown, Consultants, contacted Mr. Joseph to get a summary of the violations. In response to Chair Kirkmeyer, Mr. Joseph doesn't believe there is a language barrier as they were able to help Ambrosia Bistro. • Chair Kirkmeyer asked Ms. Zhang if she would like to add any additional comments to why the Board should not suspend her business license. She stated that she hired someone to fix the problems with the refrigerator, and will hire the consultant to make sure employees comply with health issues. • Ms. Zhang expressed that all five (5) employees will take the training, and she would like her employees to go on the website and get the certificate. Mr. Joseph said it generally takes one to two hours to complete the training, and the training module on the website has Chinese. = Chair Kirkmeyer expressed concerns that the owner is not able to demonstrate knowledge and asked Ms. Zhang if she understood the violation of improper cold holding is not a result of the refrigerator not working. Ms. Zhang responded to Chair Kirkmeyer stating she will get a new refrigerator that works. Chair Kirkmeyer asked that the improper cold holding pictures be displayed. Ms. Zhang explained she put ice underneath the pan. • Chair Kirkmeyer disclosed she picked the three (3) violations that were offensive to her. She questioned how Ms. Zhang plans on fixing the infraction of lack of knowledge of hygienic practices. Ms. Zhang replied that she is going to get more training and ask the consultant to assist her. Mr. Joseph explained the employees were observed using a common towel above the sink to wash their hands. Chair Kirkmeyer reiterated that employees need to wash their hands and dry them with paper towel and employees can't eat or drink in the food preparation area. = Chair Kirkmeyer made known Minutes, July 15, 2015 2015-2110 Page 2 BC0016 the third most offensive violation to her is the cross contamination of food. She pointed out the storing of raw food over ready to eat food. Ms. Zhang explained how they do it now is put raw meat under the ready to eat food. Ms. Zhang responded that the food was waiting to be disposed of. El Chair Kirkmeyer expressed she can tell Ms. Zhang has a desire to be a good restaurant owner, unfortunately she lacks the tools or the knowledge to keep people from getting sick, the problem has been on-going for a year. Ms. Zhang asked the Board if there is a way to get trainin. without suspending the license because the public hasn't complained and no one has gotten sick. Commissioner Moreno asked Ms. Zhang how many of the employees who are working now, worked in 2013. Ms. Zhang replied two (2) of her current employees. Commissioner Cozad commented that she agrees with comments made, and explained people might get sick and not complain because symptoms can take 6 to 8 hours to present. Ms. Zhang stated the restaurant fixed the refrigerator, and she now has a certificate showing she completed the food safety training. = Commissioner Freeman agreed with previous comments and that Ms. Zhang doesn't have the ability to train her employees. He commented it is important to suspend the license and get employees trained. He reassured Ms. Zhang that a consultant can train employees with the business still open. el Mr. Joseph stated a consultant can be contacted quickly within the next day or two. He also expressed his concerns that there may still be a language barrier. In response to Chair Kirkmeyer, Mr. Joseph outlined the process the consultant will use to teach the owner and have her demonstrate her knowledge before she is in compliance. Chair Kirkmeyer explained to Ms. Zhang that the Health Department will go in and do follow-up inspections. = Commissioner Moreno moved to suspend the license, which was seconded by Commissioner Cozad and, it carried unanimously. Chair Kirkmeyer presented the requirements to Ms. Zhang and stated it's now up to her to get a consultant, get the training, and meet a certain level of knowledge. She made known the Board waived the $1,000 civil penalty fee so Ms. Zhang can pay the consultant.
