RESOLUTION RE: ACTION OF THE BOARD CONCERNING REQUEST TO PURSUE INJUNCTION AGAINST APOLINAR VALLEJO, AND FRANCISCO BARRON FOR VIOLATION OF THE WELD COUNTY CODE (ZCV14-00172) WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Apolinar Vallejo, and Francisco Barron, 12217 County Road 28, Fort Lupton, Colorado 80621, are allegedly in violation of the Weld County Code, and WHEREAS, Weld County, on behalf of the Weld County Department of Planning Services, filed a complaint in the Weld County Court against Defendant Apolinar Vallejo, and Francisco Barron, claiming that the Defendant's property was in violation of the Weld County Code, and WHEREAS, the County Court found the Defendant's property to be in violation of the Weld County Code (ZCV14-00172); specifically, the Defendant is operating a commercial business on the property and has not completed a Use by Special Review Permit allowing the commercial business, and WHEREAS, the Defendant failed to bring the property into compliance with the Weld County Code, and upon Weld County's motion, the County Court ordered Defendant to pay $100.00 for each day that the property remained in violation of the Weld County Code, beginning on April 6, 2015, and WHEREAS, the Defendant paid an amount of$3,100.00 for the accrual of daily penalties and submitted a USR application. WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 12th day of October, 2015, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Apolinar Vallejo, and Francisco Barron, property owner(s), were represented by Veronica Olivas, Business Manager at said hearing, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. Dear Mr.Vallejo and Mr. Barron: You were initially served with a complaint regarding the illegal operation of your business on October 8, 2014. The property in question is located at 12217 County Road 28, Fort Lupton, CO 80621. You then entered into a Consent Agreement on November 13, 2014, and agreed that you would submit a completed Use by Special Review(USR)application by January 8, 2015. This application was not completed and on April 6, 2015 Weld County Magistrate Mark Gonzales ordered a $100.00 a day penalty against your property due to violations of the Weld County Code. It is a residential home that appears to have several vehicles parked in the driveway and in the back of the property at all hours . It appears they have turned this residence into a business . There have been times that they block traffic on CR 28 , while moving vehicles around . I cannot speak for the people who live next door, but as a homeowner that lives on CR 28 , west of this property , I do not appreciate that they have turned this residence into a industrial business . These vehicles are adding to the amount of unwanted additional truck traffic, causing damage to our roads . Working on equipment and making noises at all hours of the night . N umberous vehicles occupying the driveway and shoulder of CR 28 day and night. Which tells me numberous people are living in a single family home . How are Your/Your Property Impacted by this Alleged Violation ? Traffic noise, the use of jack brakes on empty trucks in front of my house on a daily basis, numberous employees or tenants coming and going to the residence racing and hot rodding their cars and trucks in front of my house at a all hours of the day and night. Tearing up our roads, huge pot holes at stop sign onto hwy 85 as well as tons of recent damage to the bridge just west of the property. Their gravel driveway which has pretty large size rocks spill out onto CR 28, has caused a blow out to one of my sons truck tires . When leaving their work yard from the back, many times I have driven by and witnessed them pulling out onto CR 28 without stopping . I myself have had two instances of having to come to a complete stop on CR 28, because they pulled out in front of me . Just a week and a half ago I literally had to slam on my brakes and slide to a stop as a guy pulled out w/o ever stopping or looking . He was driving a white pickup truck with their logo Ultimate Services on the door, pulling a flatbed trailer. He never acknowledged I was even there . I was following my son about 3 months ago, and he too had to slide to a stop to avoid hitting them as they pulled out in front of him onto CR 28 . The other time for me, they pulled out w/o stopping and I did have to come to a complete stop in the road to avoid running into them, but did not have to slam on my brakes. They park so many vehicles out front and in their driveway that it impedes the vision of not only those pulling out of the property onto CR 28, but also to those whom are traveling west on CR 28 . They are parked on the shoulder close to the road and it' s all but impossible to see around the vehicles to see if someone is pulling out, as I know several of them do not stop before entering onto CR 28 . It worries me everyday I have to drive by there . They have no respect for their neighbors whatsoever ! They do what they want, when they want ! The day before and day of the 4th of July, they lite off large loud fireworks till 2 and 3 o ' clock in the morning. Rude and disrespectful to their neighbors as it kept us up all night and we had to work those days w/o much sleep ! They cause a huge concern to the safety and well being to everyone living around them . 1 Where is Your Property in Relation to the Alleged Violation : We are the second house East of their property. I ' m guessing about 300 yards away. Have You Discussed Your Concerns With the Property Occupant? No I have not. But we did confront them last spring as they were riding their atv' s on our property and through the corn field between them and us. As the corn had just sprouted and the were tearing through the field in their atv' s . They did stop doing it, but since then the teenagers race up and down and squeal their tires in front of our house on CR 28 . If Not, Please Explain Why?
