RE: APPROVAL OF RECORDED EXEMPTION NO. 288 - RALPH CASEY.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 21st day of November, 1977, in the Chambers of the Board
of County Commissioners of Weld County, Colorado, that a certain
parcel of land, being the property of Ralph Casey, located on
the SEa of the SWa of Section 30, Township 5 North, Range 65 West
of the 6th P.M. , Weld County, Colorado, and more particularly
described as follows, to-wit:
All of tots Two (2) , Three(3) , Four (4) , Five (5) , Six (6) ,
Seven (7) , and Eight (8) in the Northeast Quarter (N6 ) of
the Southwest Quarter (SA) ; Lot Eight (8) of the Northwest
Quarter (NW4) of the Southwest Quarter (SWa) ; Trot One (1)
of the Southwest Quarter (SW4) of the Southwest Quarter
(SWW) ; and all of the Southeast Quarter (SE4) of the South-
west Quarter (SWq) , except five (5) acres as described in
Deed recorded in Book 130, Page 344, Weld County Records;
and except parcel of land described in Deed recorded in
Book 1381, Page 20, Weld County Records, and except parcel
of land described in Deed recorded in Book 1456, Page 296,
Weld County Records, and except a parcel of land described
in Deed recorded in Book 1547, Page 478, Weld County Records,
and except parcel of land described in Deed recorded in Book
580, reception #1501530, Weld County Records.
Said described parcel of land is subject to any rights-of-
way or other easements as recorded by instruments of record
or as now existing on said described parcel of land.

"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973 ,

as amended, and Section 2-1A(3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by Ralph Casey be exempt from the
definition of the terms, "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
subject to Lots A and B continuing to utilize the common access
as recommended by the County Engineer.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 21st day of
November, A.D. , 1977 .

RE: Recorded Exemption #288
Dear Commissioners :
The attached application, plat , and related materials are in reference
to a request by Ralph Casey for a recorded exemption. The parcel of
land is described as Pt . of SW* of Section 30, T5N, R65W of the 6th
p.m. , Weld County, Colorado. Said property is located west of Evans
on the north side of the South Platte River. The subject property
contains 31 . 5 acres of Class VI dryland soils. The request is to
split the property into parcels of 27. 523 acres and 3. 977 acres. The
3. 977 acre parcel would contain an existing set of improvements. The
27. 523 acre parcel contains two existing mobile homes. A letter dated
October 27, 1977, submitted jointly by Mr. Edward Venable and the
Casey ' s indicates the reasons for splitting the property in question.
Based upon the information submitted and the adopted Policies in the
county, the Department of Planning Services recommends the request be
approved for the following reasons:
1 . The City of Evans Planning and Zoning Commission has indicated they
considered the request and recommend that it be approved.
2. The proposed split conforms with the intent clause of the recorded
exemption procedure (Section 9-2 of the Weld County Subdivision
Regulations) , the intent clause of the Agricultural District
(Section 3. 3A of the Weld County Zoning Resolution) , and the
Weld County Comprehensive Plan in that each resulting parcel would
have an existing set of improvements, the use would be compatible
with the surrounding agricultural uses, and the request would not
be depleting productive agricultural land since the property in
question contains Class VI soils.

3. The request complies with the provisions of Section 9-4(a)
of the Weld County Subdivision Regulations.

Re: Recorded Exemption Applicants Ralph Casey and Marcella
Casey (joint tenants)
Property: approximately four-acre parcel on the SE �
of the SW ' of Section 30, T 5 N, R 65 W of the 6th
P.M. , Weld County, Colorado.
It has been suggested to me that, in addition to the in-
formation requested in the former application for recorded
exemption, I should submit this letter of further explanation.
The applicants are attempting to secure your approval of
the exemption, in order to allow them to sell what is
designated as Lot A on the plat which is submitted here-
with. They have entered into a contract contingent upon
getting the exemption, with Danny D . Goodale to sell Lot A
upon which the farm residence which they acquired with
their property is situate. Mr. Goodale will use the im-
provements and acreage strictly for residence purposes,
and will have no business affiliations with the operation
of the remaining agricultural property.
There are two mobile homes located on the remaining acreage.
One of them is the permanent home of the applicants, which
was placed on the property in 1958 and has been continuously
occupied in the course of their agricultural endeavors. The
second unit was located on the property in 1975, and is now
occupied by the son of the applicants, who has taken over
the management of the farm and cattle operation. They have
not secured permits for either, since none was required when
the first unit was located, and the applicants understood
that when the second one was placed there, it was for a
tenant and would not require a permit. Of course, they are

willing to cooperate with anything which the Commissioners
request. I appreciate your consideration of the application,
and am available to respond to any questions which you may
have.

4. Certificate of previous conveyances since August,
1972, completed by Chicago Title Insurance Company;
5. Copy of letter from Central Weld County Water Dis-
trict relating to the water supply available on

6. Copy of deed from McMillan Well Works, Inc. , to
Mr. and Mrs . Casey, recorded in Book No. 1517 at
Page 15;
7 . Copy correction deed between the same parties,
recorded in Book No. 1517 , at Page 180;
8. Copy of deed from Mr. and Mrs. Casey to Max Torrez
conveying to him a part of the land they acquired
from McMillan Well Works, Inc . , this deed being

extending the time for closing and terminating
Mr. Walker' s interest in the contract.
12. Mrs . Casey' s check, payable to Planning Commission

Recorder for $4.00.
14. Two copies of a letter dated October 20, 1977 ,
addressed to County Commissioners and signed by

Dear Mr. Casey:
Your application and related materials for the above described request
are complete and in order. I have scheduled a meeting with the Board
of County Commissioners for November 21 , 1977, at approximately 9: 30 a.m.
Said meeting will take place in the County Commissioners ' Hearing Room,
First Floor , Weld County Centennial Center, 915 - 10th Street , Greeley,
Colorado. It is recommended that you and/or a representative be there
to answer ally questions the Board might have with respect to your appli-
cation .
It is the policy of Weld County to refer an application of this nature
to an; municipality lying within 3 miles of the property in question.
Therefore, our office will forward a copy of the materials to the City
of Evans for their review and comment on the proposed land split. Please -
contact the City of Evans for details pertaining to any Planning Com-
mission or Town Board meeting that the town might convene in order to
comment and review on this application.
