Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Use by Special Review Permit for a Mineral
Resource Development Facility Including Oil and Gas Support (Trucking
Company) in the A (Agricultural) Zone District.
There will be up to 2 on site employees and 15 drivers accessing the site.
The applicant has applied for a residential well and indicates they will re-permit
the well to commercial when the shop is constructed. Water for the business
must come from a commercially permitted well.
A commercially designed septic system will be constructed when the shop is
built.
The following section is from Environmental Health Services, Weld County
Department of Public Health & Environment, Septic Policies.
2.2.K Use of portable toilets and bottled water (revised 5/8/12)
Purpose: To define when portable toilets and commercially bottled water
are allowed.
Policy: Portable toilets and bottled water from a commercial source are
allowed in the following circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per
year (for example recreational facilities, firework stands, farmers
markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2
consecutive hours a day
Note: Records of maintenance and proper disposal for portable toilets shall be
retained on a quarterly basis and available for review by the Weld County
Department of Public Health and Environment. Portable toilets shall be serviced
by a cleaner licensed in Weld County and shall contain hand sanitizers.
As indicated above, it is the policy of this Department that portable toilets are
allowed when employees or contractors are on site for less than 2 consecutive
hours a day and there are two or less employees. As personnel will be on site
for a short duration, in accordance with Environmental Health Services policy the
use of portable toilets is allowed.
The dust abatement plan indicates that all drive and parking surfaces will be
graveled or some sort of recycled material and water will be utilized if necessary.
The waste handling plan indicates that Gator Rubbish and Disposal will provide
trash removal. Used oil and other vehicle fluids generated from vehicle
maintenance will be removed/recycled by Raptor Used Oil Recovery. The
recycling of tires will be done by Tire Recycling Inc. The waste handling plan will
need to be revised to include disposal or recycling of batteries and other scrap
parts generated from vehicle maintenance. The application indicates there will
not be floor drains in the maintenance shop. If vehicle and equipment washing
occurs onsite, the wash water discharge must also be contained for proper offsite
disposal. Any fuel tanks onsite must have secondary containment in case of a
spill.
We have no objections to the proposal; however, we do recommend that the
following conditions be part of any approval:
Prior to recording the plat:
1. The applicant shall submit a revised waste handling plan, for approval, to
the Environmental Health Services Division of the Weld County
Department of Public Health & Environment. The plan shall include
disposal/recycling of batteries and other scrap parts generated from
vehicle maintenance, including the names, telephone numbers and
addresses of the waste handlers and disposal/recycling facilities.
We recommend that the following requirements be incorporated into the permit
as development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites
and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and
removed for final disposal in a manner that protects against surface and
groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is
not meant to include those wastes specifically excluded from the
definition of a solid waste in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended.

3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and
other potential nuisance conditions. The applicant shall operate in
accordance with the approved Waste Handling Plan, at all times.
4. Any vehicle or equipment washing areas shall capture all effluent and
prevent discharges in accordance with the Rules and Regulations of the
Water Quality Control Commission, and the Environmental Protection
Agency.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this
site. The facility shall be operated in accordance with the approved Dust
Abatement Plan, at all times.
6. This facility shall adhere to the maximum permissible noise levels
allowed in the Non-Specified Zone as delineated in Section 14-9-30 of
the Weld County Code.
7. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. For employees or
contractors on site for less than 2 consecutive hours a day and 2 or less
employees, portable toilets and bottled water are acceptable. Records of
maintenance and proper disposal for portable toilets shall be retained on
a quarterly basis and available for review by the Weld County
Department of Public Health and Environment. Portable toilets shall be
serviced by a cleaner licensed in Weld County and shall contain hand
sanitizers.
8. Sewage disposal shall be by septic system for the residence and shop.
Any septic system located on the property must comply with all
provisions of the Weld County Code, pertaining to Individual Sewage
Disposal Systems.
9. A permanent, adequate water supply shall be provided for drinking and
sanitary purposes for the residence and shop. The facility shall utilize the
private water supply.
10.All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling. All chemicals must be stored secure,
on an impervious surface, and in accordance with manufacturer's
recommendations.
11.Process wastewater (such as floor drain wastes) shall be captured in a
watertight vault and hauled off for proper disposal. Records of
installation, maintenance, and proper disposal shall be retained.

12.The applicant shall obtain a Colorado Discharge Permit System or
CDPS permit from the Colorado Department of Public Health and
Environment (CDPH&E), Water Quality Control Division, as applicable.
13.The operation shall comply with all applicable rules and regulations of
State and Federal agencies and the Weld County Code.

Upon review of my case files and computer, an active Zoning Violation (ZCV14-00074)was noted. This
violation was initiated due to the operation of a trucking business without first completing the necessary
Weld County Zoning Permits. This case has not been presented to the Weld County Court Magistrate
through the Violation Hearing process. Since this application was submitted prior to an actual court date
being scheduled, NO investigation fee is required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staff's policy to no longer accept staff initiated complaints.
If this application if approved by the Board of County Commissioners and once a plat is recorded will
correct this outstanding violation. If this application is denied,the commercial vehicles and all operations
shall be removed from the property within 30 (thirty) days of denial or the violation will proceed in court
accordingly.

Comments:
1) Per the 2003 International Fire Code section:
505.1 Address numbers.
New and existing buildings shall have approved address numbers, building numbers or
approved building identification placed in a position that is plainly legible and visible
from the street or road fronting the property. These numbers shall contrast with their
background. Address numbers shall be Arabic numerals or alphabet letters. Numbers
shall be a minimum of 4 inches (102 mm) high with a minimum stroke width of 0.5 inch
(12.7 mm).
2) Per the 2003 International Fire Code:
1011.1 Where required.
Exits and exit access doors shall be marked by an approved exit sign readily visible from
any direction of egress travel. Access to exits shall be marked by readily visible exit signs
in cases where the exit or the path of egress travel is not immediately visible to the
occupants. Exit sign placement shall be such that no point in an exit access corridor is
more than 100 feet (30 480 mm) or the listed viewing distance for the sign, whichever is
less, from the nearest visible exit sign.
3) Portable fire extinguishers shall be installed in accordance with Section 906 of the fire
code and NFPA 10.
4) Per the 2003 International Fire Code section:
1410.1 Required access.
Approved vehicle access for firefighting shall be provided to all construction or
demolition sites. Vehicle access shall be provided to within 100 feet(30 480 mm) of
temporary or permanent fire department connections. Vehicle access shall be provided by
either temporary or permanent roads, capable of supporting vehicle loading under all
weather conditions. Vehicle access shall be maintained until permanent fire apparatus
access roads are available.
5) Per the 2003 International Fire Code section:
503.2.3 Surface.
Fire apparatus access roads shall be designed and maintained to support the imposed
loads of fire apparatus and shall be surfaced so as to provide all-weather driving
capabilities. The fire department will need to have full access to the grounds and
building.
6) Fort Lupton Fire Protection District may require the owner to install a Knox Box or Knox
Paddle Lock for emergency access to the property after business hours. If automated
gates are installed a Knox key switch and override will be required. Please contact the
Fort Lupton Fire Protection District for approved Knox Forms/and or ordering
instructions.
7) Fort Lupton Fire Protection District will need to be contacted to conduct a Fire Safety
Inspection and Certificate of Occupancy Inspection prior to the start of business in the
new structure.
8) Building plans will need to be reviewed by the Fort Lupton Fire District to
determine/confirm building classification and all applicable fire code requirements when
buildings are being added.
9) If determined to be applicable all fire suppression plans and fire alarm plans will need to
be submitted to the Fort Lupton Fire Protection District for review.
10)Fire hydrants will need to comply with the 2003 International Fire Code Appendix C
when a water line is extended to the area.
11)No structures can be within 100 feet of any gas well.

This letter is being sent by Anadarko Petroleum Corporation on behalf of its subsidiary
Kerr-McGee Oil & Gas Onshore LP ("KMG") to inform you KMG is the owner of valid oil
and gas leases underlying all or parts of Section 22, Township 2 North, Range 66 West, for
which Euden Baldenama ("Applicant") is seeking approval of a request for a site specific
development plan and special review permit for a mineral resource development facility
including oil and gas support in the A Zone District on the Property. KMG is submitting this
comment and objection timely, in accordance with State of Colorado and the County's
procedural requirements.
KMG's recorded oil and gas leases are real property interests entitling it to produce oil
and gas from the leased lands. The company has the right to produce from existing wells, to
maintain, rework, recomplete, and fracture those existing wells to enhance production, and to
drill new wells to produce oil and gas, in accordance with applicable Colorado Oil and Gas
Conservation Commission regulations and Colorado Statutes. KMG's oil and gas assets have
significant value, and the company is consequently concerned about any development, surface
use, plan of use, PUD, zoning or rezoning, or other action by the County that would impair or
preclude its ability to develop its property.
KMG's preferred practice is to meet with surface owners and attempt to conclude a
mutually acceptable surface use agreement. In this case, KMG has spoken with the applicant
and will begin negotiations with the surface owner, but an agreement has not yet been reached.
KMG must object to any approval by the County for the Applicant's plans that fail to fully
accommodate KMG's right to explore for, develop and produce oil and gas from its leasehold
interests. KMG requests that the County withhold final plat approval until such time as the
Applicant and KMG have concluded the surface use agreement. Any future surface

Public Service Company of Colorado (PSCo) has determined there is a conflict with the above
captioned project. Public Service Company has an existing electric transmission line and
associated land rights as shown within this property. Any activity including grading, proposed
landscaping, erosion control or similar activities involving our existing right-of-way will require
Public Service Company approval. Encroachments across Public Service Company's
easements must be reviewed for safety standards, operational and maintenance clearances,
liability issues, and acknowledged with a Public Service Company License Agreement to be
executed with the property owner. PSCo is requesting that, prior to any final approval of
the development plan, it is the responsibility of the property owner/developer/contractor to
contact Mike Diehl, Siting and Land Rights Supervisor at (303) 571-7260 or
michael.diehl@xcelenergy.com, to have this project assigned to a Land Rights Agent for
development plan review and execution of a License Agreement.
The property owner/developer/contractor must contact the Builder's Call Line at 1-800-628-
2121 and complete the application process for any new gas tric service, or modification to
existing facilities. It is then the responsibility of the developer to contact the Designer assigned
to the project for approval of design details. Additional easements may need to be acquired by
separate document for new facilities.
As a safety precaution, PSCo would like to remind the developer to call the Utility Notification
Center at 1-800-922-1987 to have all utilities located prior to any construction.

This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-101(10)(a),
C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to
county planning directors, this office will only perform a cursory review of the referral information and provide
informal comments. The comments do not address the adequacy of the water supply plan for this project or
the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the
comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
The application is for a Site Specific Development Plan and Use by Special Review Permit for a
mineral resource development facility including oil and gas support (trucking company). On July 22, 2014 the
Applicant obtained well permit no. 295085 and the use of the ground water from this well is limited to ordinary
household purposes inside three (3) single family dwellings, the watering of the user's own non-commercial
domestic animals, and the irrigation of not more than 1 acre of home gardens and lawns. The Applicant
indicated that the primary use of water on site will be domestic. Supplemental commercial use on the property
will be for one full time employee, the truck drivers (less than 2 hour/day) and the property owner. Since well
permit no. 295085 does not allow for commercial use, the Applicant indicated that at the time of shop
construction an exemption to the existing well permit use will be requested. Also prior to the bolding
construction and permanent sanitary facilities portable toilets will be provided for drivers coming to the site.
This office has no objection to the proposal, provided water from well permit no. 295085 is not used as a
water supply for the proposed mineral resource development facility and its employees unless a new
permit allowing for such commercial use is obtained.
