RE: APPROVAL OF RECORDED EXEMPTION NO. 365 - JERRY AND LOIS
BIGBEE.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 15th day of January, 1979 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption No. 365, being the property of
Jerry and Lois Bigbee, described as part of the Southwest Quarter
of Section 33, Township 6 North, Range 66 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described as follows :
A tract of land located in the Southwest Quarter of
Section 33, Township 6 North, Range 66 West of the
6th P.M. , Weld County, Colorado, and being more
particularly described as follows:
Corencing at the Southwest Corner of said Section
33, and considering the South Line of the Southwest
Quarter of said Section 33 to bear South 89°35'02"
Fast, with all other bearings contained herein
relative thereto;
Thence North 07°35'13" East, along the centerline
of 71st Avenue, 60.47 feet;

does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land, " pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-1A (3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Jerry and Lois Bigbee be, and hereby is ,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973 , as amended, provided that an additional right-
of-way be dedicated for 71st Avenue and "C" Street as requested by
the City of Greeley.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 15th day of
January, A.D. , 1979 .

RE: Recorded Exemption #365
Dear Commissioners:
The attached application, plat , and related items are in reference to
a request by Jerry and Lois Bigbee for a recorded exemption. The par-
cel of land is described as Pt . SW4 Section 33, T6N, R66W of the 6th
P. M. , Weld County, Colorado. This property is located at 412 North
71st Avenue, 1-1/2 miles northwest of the Greeley city limits. The
property contains 19. 051 acres of Class IV, VI and VII non-irrigated
soils in the Agricultural Zone District . The request is to split the
property into parcels of 8. 231 acres and 10. 820 acres.
It is the applicant ' s intent to sell Lot A. The applicants now reside
on Lot B, which has an existing residence.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons:
1. The request is in compliance with the policies of the Weld County
Comprehensive Plan in that to minimize conflicting land uses, resi-
dential development will be encouraged to locate adjacent to exist-
ing towns and in accordance with the comprehensive plans and stated
wishes of each community. The parcel of land is located within
1-1/2 miles of the City of Greeley and is inside the Greeley Com-
prehensive Plan. The City of Greeley Planning Commission has no
objections to this request .

2. The request is in compliance with the agricultural policies of
the Weld County Comprehensive Plan in that developments that
utilize non-productive agricultural land will be encouraged.
Soils on this parcel are Class IV, VI and VII non-irrigated
soils and have a low utility for agricultural production. The
size, shape and rough terrain of the parcel diminishes the ef-
ficiency of agricultural operations on the parcel .
3. For the reasons discussed above, the request is in compliance
with the intent clause of the recorded exemption procudure
(Section 9-2 of the Weld County Subdivision Regulations) . Said
clause states :
"The intent in establishing the recorded exemption
procedure is to provide a means whereby non-productive
agricultural lands may be developed for higher and more
productive uses insofar as such uses are compatible
with surrounding agricultural uses in areas where land
divisions are proposed (Rev. 4-17-74) . "
The residential use of this parcel is in compliance with the in-
tent clause of the recorded exemption procedure because said
parcel contains non-productive agricultural lands located adjacent
to an existing town. The residential use would appear to be com-
patible with the surrounding agricultural uses.
4. The request complies with Section 9-4 A. of the Weld County Sub-
division Regulations.
The City of Greeley has requested additional right-of-way be dedicated
for 71st Avenue and "C" Street , which are designated as arterial streets
in the City of Greeley Comprehensive Plan. Arterial streets require
100 feet of total right-of-way. The Department of Planning Services
Staff recommends that the recorded exemption plat be amended to show
the additional right-of-way as requested by the City of Greeley.

Please be advised that our office represents JERRY BIGBEE and
LOIS BIGBEE of 412 - North 71st Avenue , Greeley , Colorado 80631 .
Mr . and Mrs . Bigbee are requesting a lot size variance in order
that they might--if the lot size variance is granted--apply
for a Recorded Exemption.
Mr . and Mrs . Bigbee (husband and wife) own the property as
joint-tenants . They have owned considerable other property
adjacent to this property, and have developed the other lands
as J . B. Acres .
Mr . and Mrs . Bigbee occupy the portion , described as Lot "B" ,
for their family residence .
The portion described as Lot "A" , and for which a recorded
exemption is sought , is undeveloped land , and has no useful
purpose other than to be sold as a tract for construction
of a family residence . Said Lot "A" is not , and never has
been, used as productive farm land . Allowing Lot "A" to be
granted a Recorded Exemption would not be removal of productive
agricultural land to residential use, inasmuch as the land is
not presently being used for anything.
You will please find enclosed the survey of said lands , as
performed by Freese Engineering. Also enclosed is a copy of
the applicants ' deed , and proof of availability of domestic
water. Finally, enclosed is check of the applicants in the
sum of $50. 00 , as required .

Re : Bigbee Recorded Exemption at "C" Street and 71st Avenue
At its January 9 , 1979 meeting the Greeley Planning Commission
considered the referral for an 8 . 2 acre recorded exemption and
recommended that it had no objections . It was noted, however ,
that additional right-of-way should be dedicated for 71st Avenue ,
which is designated as an arterial street . Although the request is
located in the Comprehensive Plan' s 2010 growth ring , the lot
split substantially conforms to subdivision interests in that it
has considerable frontage on 71st Avenue and is part of an exist-
ing subdivision.

COMMENTS :
Existing improvements (one residence) are located on the proposed Lot
B. Access to Lot B is from 71st Avenue. Lot A has no existing access.
Access may be via north boundary on 71st Avenue or shared jointly with
Lot B. The parcel is located adjacent to a residential subdivision
in the Agricultural Zone District . Surrounding property to the south,
west and north is agricultural . The parcel appears to be located on
a hill sloping down to the flood plain of the Cache la Poudre River.
The parcel has a natural drainage running through the property. The
property does not appear to be economically efficient for agricultural
production due to the rough terrain. 71st Avenue and "C" Street are
gravel surface roads.
