NOW,THEREFORE,BE IT RESOLVED BY THE TOWN BOARD OF TRUSTEES OF THE TOWN OF EATON, COLORADO,THAT: Section 1. The Town Board of the Town of Eaton finds that a Petition for Annexation of certain property described on Exhibit A, which is attached hereto and incorporated herein by this reference, filed with the Town Clerk on December 17, 2014, to be known as the "Eaton School Annexation," is in substantial compliance with §31-12-107(1), and that a public hearing should be held to determine if the proposed annexation complies with §§31-12-104 and 31-12-105, C.R.S., or such parts thereof as may be required to establish eligibility pursuant to §31-12-101, et seg.; Section 2. " f S. nature at Owner Date I t Signature of Owner Date For Office Use Only: Date Received: Received By: Fee Paid: Complete Submittal: Statement of Community Need for Proposed Annexation and Zoning PETITION FOR ANNEXATION TO THE TOWN OF EATON, COLORADO The undersigned Petitioner, Eaton School District, in accordance with Article 12, Chapter 31, C.R.S., as amended, herby petitions the Town Board of the Town of Eaton, Colorado, for Annexation to the Town of Eaton, Colorado, for annexation to the Town of Eaton the unincorporated territory more particularly described below, to be known as "Eaton School District Re-2 Annexation", and in support of said Petition the undersigned submits the attached annexation map and states and alleges as follows: 1. It is desirable and necessary that the following described territory be annexed to the Town of Eaton, Colorado. See Exhibit "A" attached hereto and made a part hereof. 2. Not less than(1/6) of the perimeter of the area proposed to be annexed is contiguous with the Town of Eaton, Colorado. 3. A community of interest exists between the territory proposed to be annexed and the Town of Eaton, Colorado 4. The territory proposed to be annexed is urban and will be urbanized in the near future. 5. The territory proposed to be annexed is integrated or is capable of being integrated with the Town of Eaton, Colorado. 6. The signatures of the Petition comprise one hundred percent (100%) of the landowners of the territory to be included in the area proposed to be annexed and said landowners attesting to the facts and agreeing to the conditions herein contained will negate the necessity of any annexation election. 7. No land held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate: a. Is divided into separate parts of parcels without the written consent of the landowners thereof, unless such tracts or parcels are separated by a dedicated street, road or other public way; b. Comprising twenty (20) acres or more and which, together with the buildings and improvements situated thereon has an value in excess of Two Hundred Thousand Dollars ($200,000) for ad valorem tax purposes for the year preceding the annexation, is included within the territory proposed to be annexed without the written consent of the landowner or landowners; 8. No part of the area proposed to be annexed is more than three miles from a point on the municipal boundary, such as was established one year before this annexation will take place; 9. Because the area proposed to be annexed comprises more than ten(10) acres an impact report as provided in Section 31-12-108.5, C.R.S., as amended, is required. 10. Accompanying this Petition are twenty (20)prints of the annexation map containing the following information: a. A written legal description of the boundaries of the area proposed to be annexed; b. A map showing the boundary of the area proposed to be annex, such map prepared and containing the seal of the registered engineer or land surveyor; c. Within the annexation boundary map there is shown the location of each ownership tract in unplatted land, and in part or all of the area is to be platted, then the boundaries and the plat number of plots or of lots and blocks are shown; d. Next to the boundary of the area proposed to be annexed is drawn the contiguous boundary of the Town of Eaton, and the contiguous boundary of any other municipality abutting the area proposed to be annexed; e. The dimensions of the contiguous boundaries are shown on the map. 11. The undersigned agree to the following conditions, which shall be covenants running with the land, and which shall, at the option of the Town appear on the annexation map: a. Water rights shall be provided pursuant to Town ordinance and/or annexation agreement; and 12. Future buildings will include another school(s) (most likely a high school) and possibly a transportation building. As the community within the school district has grown, and will continue to grow, it is apparent that new building will be needed in the near future. The newly approved Eaton Area Park and Recreation District will occupy the northern third of the property and will include a recreation center with adjoining parking lots and athletic fields. The southern two thirds of the property will be the site of a new high school and transportation facility (bus barn)to be built sometime in the future when the Eaton School District decides the time is right (5—15 years) WATER As with all annexations, raw water rights will have to be dedicated to the Town in sufficient quantities to serve the anticipated demand. There are two irrigation wells on the property and these can be used to supply water for the fields and other open space for the rec district and the eventual high school. SEWER The Town built a new sewage treatment plant which was brought on line in 2006. This new plant has a capacity of 750,000 gallons per day and is currently operating at 40% of capacity with a peak flow of 47%. The plant has the capacity to handle the expected flows from the new recreation center and eventual high school. Engineering is currently under way to determine the required main lines along Third Street to serve the rec center. The location of main lines to serve the high school will be determined at a future date. STORM DRAINAGE By ordinance, both the rec district and the school district will be required to submit a drainage plan which will include the location and size of storm sewer lines and detention ponds. The detention ponds will be incorporated into the open space areas around the rec center and high school and will be the responsibility of the districts to maintain. STREETS The annexation includes the entire right of way of WCR 35 from WCR 74 north a half mile. This would become a city street known as Fall Line Road. It is assumed that Third Street would be extended west to Fall Line Road to serve both the rec center and high school. The cost to build all the improvements in this area will have to be negotiated with both districts and will be included in the annexation or development agreements.
