HomeMy WebLinkAbout20151746.tiff HEARING CERTIFICATION DOCKET NO. 2015-14 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR14-0079, FOR MINERAL RESOURCE DEVELOPMENT FACILITIES, INCLUDING OIL AND GAS SUPPORT AND SERVICE FACILITIES (COMPRESSOR STATION FOR NATURAL GAS AND ALL RELATED EQUIPMENT, INCLUDING, BUT NOT LIMITED TO, EIGHT (8) COMPRESSORS, VAPOR RECOVERY UNITS, SEPARATORS, DEHYDRATORS, STORAGE TANKS AND A LAYDOWN YARD) AND ONE (1) 70-FOOT IN HEIGHT COMMUNICATION TOWER IN THE A (AGRICULTURAL) ZONE DISTRICT - ANADARKO E & P COMPANY, LP, C/O KERR-MCGEE GATHERING, LLC A public hearing was conducted on June 24, 2015, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Julie A. Cozad Commissioner Steve Moreno Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Brad Yatabe Planning Services Department representative, Diana Aungst Planning Services Engineer representative, Wayne Howard Health Department representative, Heather Barbare The following business was transacted: EI I hereby certify that pursuant to a notice dated May 15, 2015, and duly published May 20, 2015, in the Greeley Tribune, a public hearing was conducted to consider the request of Anadarko E & P Company, LP, do Kerr-McGee Gathering, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0079, for Mineral Resource Development Facilities, including Oil and Gas Support and Service Facilities (compressor station for natural gas and all related equipment, including, but not limited to, eight (8) compressors, vapor recovery units, separators, dehydrators, storage tanks and a laydown yard) and one (1) 70-foot in height Communication Tower in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. Diana Aungst, Department of Planning Services, presented a brief summary of the proposal to include the details of the operation and stated 13 referrals were sent out and 10 did not respond or indicated no concerns. The applicant is proposing a laydown yard for the storage of various equipment related to the business. She further explained it is an unmanned facility that will be operated 24 hours a day, seven (7) days a week, therefore, there will be signage, lighting and fencing; however, no water or septic will be provided and landscaping is not planned for the location. She reported the site is not in a Flood Hazard area, gave the specific location, and explained the adjacent property uses surrounding the site. Staff has received no communications from surrounding property owners. She verified the site is located within the Ci C:CR; : {4{, 7//L/ 2015-1746 PL2324 HEARING CERTIFICATION - ANADARKO E & P COMPANY, LP, 0/O KERR-MCGEE GATHERING, LLC (USR14-0079) PAGE 2 three (3) mile referral area of the Town of Platteville; however, there was no referral response received. She displayed images of the site and surrounding properties and USRs within one (1) mile of the site, and entered the favorable recommendation of the Planning Commission into the record as written. • Wayne Howard, Planning Services Engineer, provided a brief overview of the transportation plans and requirements to include details surrounding the project split between the compressor station and the lay down yard. He explained the current site access for the compressor station is off of County Road (CR) 33, and the access for the future location of the laydown yard is off of CR 26. The applicant is proposing to abandon the site access for the compressor station and only utilize the access from CR 26 for the laydown yard. The agreement to modify the access location is still in process. Mr. Howard stated there are no daily traffic counts for CR 26; however, the applicant provided a traffic narrative that indicated 30-40 personnel with large vehicles would be accessing the site during the period of construction. Once completed, the applicant is projecting daily site visits for maintenance to the compressor site and for the laydown yard, 10-20 truck trips per day to begin with and once the equipment to be stored is in place, that should be reduced to five (5) trips per day. The Access Permit, AP#14-00511, from CR 33 is the one being proposed to be abandoned, and the Access Permit, AP#15-00082, off CR 26 is being proposed as the main access; however, the application needs to include the compressor station. He explained the reqirements for tracking control, for a modified Improvements and Road Maintenance Agreement, and stated the location is not in a Geologic Hazard area. Further, he reviewed the drainage report, and other relevant requirements for Public Works. • Heather Barbare, Department of Public Health and Environment, reviewed the water and sewer provisions stating there will be no permanent employees on the site and with personnel visiting only a couple times per day, the applicant will provide a portable toilet and bottled water. She stated the applicant submitted the required plans to include a Waste Handling Plan, Dust Abatement Plan, Noise Abatement Plan and evidence of an Air Pollution Emissions Notice (APEN) application with the State. She reviewed the other relevant Development Standards (DS) #13-21. In response to Chair Kirkmeyer and Commissioner Conway, Ms. Barbare clarified the noise decibal requirement and cited DS #20 regarding the site requirements. • Tracy Coiling, represented the applicant, presented a PowerPoint presentation and reviewed the site location and business operations to include the compressor station and a laydown yard to store service equipment related to the business. In response to Chair Kirkmeyer, Ms. Coiling explained the laydown yard and the truck traffic generated while getting the equipment there and thereafter. She further stated they will meet all the Colorado Oil and Gas Conservation Commission (COGCC) requirements for the station and they are not planning any further development. Ms. Coiling did not know how often the noise limits are checked on the site and referred to her collegue, Mr. Keiser. Nathan Keiser, stated the noise levels are checked on a regular basis, and there is a call-in number to report concerns. In response to Commissioner Conway, Mr. Keiser stated the noise is typically below the requirements, and below the level of normal conversation. 2015-1746 PL2324 HEARING CERTIFICATION - ANADARKO E & P COMPANY, LP, 0/O KERR-MCGEE GATHERING, LLC (USR14-0079) PAGE 3 In response to Commissioner Moreno, Ms. Coiling stated the lighting fixtures are cast downward to mitigate for neighbors; however, there must be lighting for safety and she reiterated there is the number to call if there are problems or issues. • No public testimony was offered concerning this matter. el Mr. Howard recommended a change to Condition of Approval (COA) #1.A, regarding the Improvements and Maintenance Agreement, to remove the words "at this site during construction". In response to Commissioner Conway, Ms. Coiling explained the traffic being generated would be mostly due to moving equipment to the lay down yard and, thereafter, it is ' � however,hard to give an exact estimate of the truck traffic, far less. Mr. she stated it would be Howard stated this is a standard agreement and protects the County. • After discussion with staff and the Board, Commissioner Cozad made a motion to amend COA #1.A to remove the words, "at this site during construction". Commissioner Moreno seconded the motion. Chair Kirkmeyer called for a role call vote regarding this motion, and the motion did not pass per the 2-3 vote, with Chair Kirkmeyer, and Commissioners Freeman and Conway being opposed. • In response to Commissioner Cozad, Mr. Howard clarified the access from CR 33 will be abandoned and staff is waiting for the canal agreement to be put into place and that will affect the conditions for that access. Chair Kirkmeyer recommended amending COA #1.B and COA #1.C.9 to add, "If necessary" to the beginning of each condition. Commissioner Cozad suggested additional language be added to #1.C.4 to reflect that the Lighting Plan be in accordance with the Weld County Code. El In response to Chair Kirkmeyer, Ms. Coiling, representing Anadarko E & P Company, LP, do Kerr-McGee Gathering, LLC, indicated they have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. Commissioner Conway moved to approve the request of Anadarko E & P Company, LP, do Kerr-McGee Gathering, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0079, for Mineral Resource Development Facilities, including Oil and Gas Support and Service Facilities (compressor station for natural gas and all related equipment, including, but not limited to, eight (8) compressors, vapor recovery units, separators, dehydrators, storage tanks and a laydown yard) and one (1) 70-foot in height Communication Tower in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Moreno, and it carried unanimously. Commissioner Conway expressed his appreciation for the applicant's willingness to pay attention to the noise levels and communicated these types of facilities play an important part in getting product to market. Chair Kirkmeyer encouraged the good neighbor policy regarding the noise levels.
