RE: RELEASE OF DEMAND NOTE FOR SONNY VIEW ESTATES UPON RECEIPT
OF A $10, 000. 00 SURETY BOND.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Department of Engineering Services has recom-
mended to the Board of County Commissioners of Weld County,
Colorado that the $43, 557. 70 demand note concerning Sonny View
Estates be released, and
WHEREAS, said release of the demand note is conditional
upon the receipt of a $10, 000. 00 bond from Sonny View Estates.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that it does hereby direct
the Weld County Clerk and Recorder to release said demand note
in the amount of $43, 557 . 50 to Sonny View Estates upon the
receipt of a $10, 000. 00 surety bond from said Sonny View Estates.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 12th day of
March, A.D. , 1979.

Dear Commissioners:
In Regard to your letter January 8, 1979 concerning Sonny
View Estates Subdivision, all streets and drainage systems
have been completed as required. This excludes approximately
300 feet on the north end of Grandview Drive, which is owned
by the Ogilvy Land and Water Company.
If there are further questions concerning Sonny View Estates,
please do not hesitate to contact me.

On demand after date for value received, the undersigned promises t
pay to the order of the Board of County Commissioners, Weld / unt • and 50/10C
Colorado, the sum of Forty three Thousand Five Hundred Fifty D11 ars
($ 43, 557. 50 ) with interest at ten percent (10%) per year from date
of demand until paid. ,
This note is given for the purpose of securing the Board County
Commissioners, Weld County, Colorado, against con), regent liability
by reason of said Board of Commissioners, We oty{ty, Colorado,
granting subdivision rights to one or more of h undersigned within the
County of Weld, Colorado, as outlined in Sub ion Agreement dated
January 19 , 19 72 , and guara mg installation of certain
improvements in said subdivision by /a ry 19 , 19 74 .

Gentlemen:
By order of and for the account of our client, Ogilvy Irrigating and
Land Company, 26002 Weld County Road 60, Greeley, Colorado 80631, we
hereby establish our clean, irrevocable Letter of Credit No. 0132
in your favor for an amount up to but not exceeding the sum of Ten
Thousand Dollars ($10,000.00) effective immediately and expiring
at the offices of the First National Bank, 1025 9th Stn.:a, Greeley,
(blorado 80631, at 3:00 P.M. , Greeley time on October 6, 1981.
Funds under this credit are available to you by your one or more
sight draft(s) drawn on us mentioning thereon this Letter of Credit
No. 0132. Each such draft(s) drawn mist be accompanied by your
signed written statement to the effect that the amount drawn is due
you in connection with the completion of curb, gutter and paving
on five lots at Seeley's Lake owned by Ogilvy Irrigating and Land
Company.
This credit is subject, so far as applicable, to "The Uniform Customs
and Practice for Documentary Credits, 1974 Revision, The International
Chamber of Conmerce Publication No. 290."
This Letter of Credit sets forth in full the terns of our undertaking
and such undertaking shall not in any way be modified; amended or
amplified by reference to any document or instrument referred to
herein or in which this Letter of Credit is referred to or to which this
Letter of Credit relates any such reference shall not be deemed to
incorporate herein by reference any document or instrument.

Dear Mr. Fagerberg : '
Re : Sonny View Estates Subdivision
In a conversation with Commissioner Glenn Billings he in-
formed me that a portion of the streets in Sonny View
Estates have been asphalt paved.
May we have a letter from you requesting inspection to be
made of streets for partial maintenance , 'then we will
be able to accept same for partial maintenance . In nine
months we will make another inspection and if any de-
ficiencies are found you will be notified of such.
After such deficiencies , if any , are corrected this office
will recommend to the County Commissioners to accept said
streets for full maintenance and they will take the nec-
essary action .
