Staff comments made during this phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Issues of concern must be resolved with the Public Works Department. Our comments and requirements are as follows: COMMENTS: This property is defined as parcel number 070529003002 and is located north of CR76 and east of Northwest Drive near the Town of Windsor. Access is from Northwest Drive which is County Maintained. An access permit has been approved for this site, AP14-000483. The site is also adjacent to CR76 which is annexed by the town of Windsor. The site appears to also access from CR76. Contact the town to discuss their requirements. CONDITIONS OF APPROVAL: The plat shall be amended to delineate the following: Northwest Drive is within the Northwest Estates subdivision and is designated on the Weld County Road Classification Plan as a paved local road which has 60ft of right-of-way. The applicant shall verify the existing right-of-way and the documents creating the right-of-way and this information shall be noted on the plat. These roads are maintained by Weld County. County Road 76 has been annexed by the Town of Windsor. The Town has jurisdiction over all accesses within their jurisdiction. Please contact Town to verify the access permit or for any additional requirement that may be needed to obtain or upgrade the permit. DEVELOPMENT STANDARDS 1. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 2. Department of Public Health and Environment CASE NO.: COZ14-0006 NAME: Northwest Estates, Vicki Lake Environmental Health Services has reviewed this proposal to rezone 1.44 acres from the R-2 (Duplex Residential) Zone District to the R-3 (Medium Residential) Zone District. The parcel is served by North Weld County Water District (acct. 1195003) and two individual on-site wastewater treatment systems for sewer (OWTS). There is one septic system that serves the duplex units (G19710932) and a separate septic system serves the basement unit (SP-0200448). The Department recommends that the following appear as notes on the change of zone plat: 1. Water service shall be obtained from North Weld County Water District. 2. This parcel is not served by a municipal sanitary sewer system. Sewage disposal shall be by septic systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. Activity or use on the surface of the ground over any part of the OWTS must be restricted to that which shall allow the system to function as designed and which shall not contribute to compaction of the soil or to structural loading detrimental to the structural integrity or capability of the component to function as designed. 4. A building permit application must be completed and submitted. Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2006 International Residential Building Code; 2012 International Energy Code; 2006 International 2011 National Electrical Code; and Chapter 29 of the Weld County Code. A plan review shall be approved and a permit must be issued prior to the start of construction.
