Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: 40x80 foot shop and parking for about 20 semi trucks—Lot B of RE-2400 North of and adjacent to CR 44 and approximately one-half mile east of CR 51 Roads: County Road 44 is a Gravel road and is designated on the Weld County Road Classification Plan as a Collector road, which requires 80 feet of right-of-way at full buildout. The applicant shall verify and delineate on the plat the future and existing right-of-way and the documents creating the existing right-of- way. If the existing right of way cannot be verified it shall be dedicated. All setbacks shall be measured from the edge of future right-of-way. This road is maintained by Weld County. Latest ADT on CR 44 was taken on 6/6/13 between CR 51 and CR 53 which counted 785 vpd with 38% trucks. Traffic: The traffic information provided with the submittal states that the site with have 15 semi trucks on site with 8 employees. Traffic on site is expected to peak between 5-6 am and return between 5-9 pm. 80% of traffic into the site comes from the west while the remaining 20%from the east. Access: An access permit has been approved for the access to the site (AP14-00508). The gate must be set back a minimum of 75 feet from future right-of-way to allow a truck or RV and trailer to pull completely off of the roadway and open the gate after the future road widening. (if applicable) Tracking control is required to prevent tracking from the site onto the County Roadway. o Standard tracking control for accesses onto paved roads includes either 300 feet of pavement onsite OR 100 feet of pavement plus double cattle guards. Other PW Permits: A Right-of-Way Use Permit is required for any work in the Weld County Right-of-Way. Contact Weld County Public Works at 970-304-6496 ext. 3764. General Site Plan Requirements: -Improvements Agreement: Improvements/Road Maintenance Agreement: An example agreement is available at: http://www.co.weld.co.us/Departments/Pla n n i ngZon i nq/Land UseApplicationsAssista nce/ApplicationAssist ance.html c An Improvements Agreement is required for sites with required offsite improvements. Collateral is required to ensure the improvements are made. o Road Maintenance is typically included as a section of the Improvements Agreement when the County feels that the site activities may impact the County roadways. Possible mitigations included in the road maintenance agreement may include but are not limited to: dust control, specified haul routes, damage repairs, and future improvement triggers. An Improvements Agreement between the Applicant and the County will be required for this project. It will detail the approved haul route(s), outline when offsite improvements will be triggered, and include a maintenance agreement for the haul routes. Geologic hazard Area: This area IS NOT in a Geologic Hazard Area. Floodplain: This area IS NOT in a Floodplain. Drainage Study: Detention or Water Quality: Storm Drainage Guidance and related documents (COC, WQCV Calc., WCECC, etc.) for the information described below can be found on the County Website at http://www.co.weld.co.us/Departments/Plannin_gZoninq/Engineerinq.html. A drainage narrative and water quality feature design is required and full Drainage Report and detention pond waived because the stormwater drainage impacts of the project will be insignificant. o Narrative: The applicant shall provide a short description of the historic stormwater flows across the property and how their application will affect those flows. The description shall include but not be limited to: 1. where the water originates if it flows onto the property from an offsite source 2. where it flows to as it leaves the property 3. the direction of flow across the property 4. if there have been previous drainage problems with the property 5. The overall site imperviousness o Water Quality Feature Design: A Water Quality Feature is required onsite downstream of the business activities such as parking, buildings, storage areas etc... The area can be an existing low point or excavated area that will capture the stormwater and contaminants prior to flowing offsite. Methodology for sizing is outlined in Volume 3, Section 3.3.0 of the Urban Storm Drainage Criteria manual. The web site address is as follows www.udfcd.org. The applicants will be required to maintain historic drainage flows and run-off amounts on the property. Grading Permit A Weld County Grading Permit will be required if disturbing more than 1 acre. Contact the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303- 692-3575. CONDITIONS OF APPROVAL: Prior to recording the plat: A. An Improvements Agreement and Road Maintenance Agreement is required for offsite improvements at this site. Road maintenance including dust control, damage repair, specified haul routes and future triggers for improvements will be included. The map shall be amended to delineate the following: A. Show the approved access(es) on the plat and label with the approved access permit number (AP14-0508). C. Show and label standard tracking control onto publically maintained roadways on the map. D. Show the accepted water quality feature on the map with volume and label as WATER QUALITY FEATURE, NO-BUILD OR STORAGE AREA. Prior to Construction: A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to the start of construction. Contact the Planning Department for application information. B. If more than 1 acre is to be disturbed for construction of non pipeline items such as structures, parking lots, laydown yards etc..., a Weld County grading permit will be required prior to the start of construction. DEVELOPMENT STANDARDS (NOTES ON THE PLAT) 1. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 2. The historical flow patterns and runoff amounts will be maintained on the site. 3. Weld County is not responsible for the maintenance of onsite drainage related features. 4. There shall be no parking or staging of vehicles on County roads. On-site parking shall be utilized. Abe MEMORANDUM 1 � ✓EL TO: DIANA AUNGST, PLANNING SERVICES U3 I c T FROM: LAUREN LIGHT, ENVIRONMENTAL HEALTH SUBJECT: USR15-0004 DATE: FEBRUARY 23, 2015 Environmental Health Services has reviewed this proposal for a Site Specific Development Plan and Use by Special Review Permit for any Use Permitted as a Use By Right, an Accessory Use, or a Use By Special Review in the Commercial or Industrial Zone Districts (40x80 square foot shop and parking for about 20 semi trucks), provided that the property is not a Lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. There will be up to 18 employees accessing the site. The shop will be utilized for maintenance. The application indicates a portable toilet will be provided for employees, which is acceptable for drivers and 2 full time on site employees. The property is currently served by a domestic well and a septic system for the existing residence. The well and septic system cannot be used in conjunction with the business or the well may need to be repermitted to commercial and the septic system will have to be reviewed by an engineer to determine if it is adequately sized for the business. The dust abatement plan states that Rams Trucking will supply the water and spray as needed. Please supply contact information for the company as it appears the address supplied in the application is an apartment complex. The waste handling plan indicates that employee waste will be collected by a waste management company; however the name of the company was not supplied. The disposal of fluids, tires, batteries was addressed in the plan. According to the application, there will be no washing of vehicles. If there will be fuel storage onsite that shall be indicated in the waste handling plan and secondary containment is required. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a revised Waste Handling Plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include the name, telephone number and address of the waste handler for employee trash and indicate if there will be fuel storage on site. 2. The applicant shall submit a revised Dust Abatement Plan, with updated contact information, for review and approval, to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved Waste Handling Plan, at all times. 4. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved Dust Abatement Plan, at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Non-Specified Zone as delineated in Section 14-9-30 of the Weld County Code. 2 7. Sewage disposal shall be by septic system when the number of full time on site employees exceeds 2. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to On-site Wastewater Treatment Systems. 8. A permanent, adequate water supply shall be provided for drinking and sanitary purposes when the number of full time on site employees exceeds 2. 9. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. For employees or contractors on site for less than 2 consecutive hours a day and 2 or less full time employees on site, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 10.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling. All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 11. Process wastewater (such as floor drain wastes) shall be captured in a watertight vault and hauled off for proper disposal. Records of installation, maintenance, and proper disposal shall be retained. 12.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. 3 MEMORANDUM 1ti ` ' ; C.= To: Diana Aungst, Planner January 26, 2015 From: Bethany Pascoe, Zoning Compliance Officer Subject: USR15-0004 Referral Upon review of my case files and computer, an active Zoning Violation (ZCV14-00171)was noted. This violation was initiated due to the operation of a commercial trucking operation without first completing the necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court Magistrate through the Violation Hearing process. Since this application was submitted prior to an actual court date being scheduled, NO investigation fee is required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. If this application if approved by the Board of County Commissioners and once a plat is recorded will correct this outstanding violation. If this application is denied,all but 1 (one)Commercial Vehicle shall be removed from the property 30 (thirty)days of denial or the violation will proceed in court accordingly.
