WHEREAS, a public hearing was held on October 4, 1976 in the Chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Eldred M. Johnson Tape PC 631 (#2232 - 2360) CASE NUMBER: SUP 306 SUBJECT: Open Cut Gravel Mine APPEARANCE: Mr. Johnson LOCATION: NZ Sec. 21 T5N R65W DISCUSSION: Mr. Johnson explained that he started this application last September. The farm is located in the southeast corner of Greeley. He has approval of the State Highway Department and Soil Conservation Service. The water augmentation plan is in Denver:- It has been sibmitted, but the person that needs to sign it has been out of town. Mr. Johnson has 12 shares of water; he only needs 3 shares. Weld County Planning staff recommends that the request be tabled for the following reason: 1 ) The State Engineer, Division of Water Resources, has recommended this application not be approved at this time since material submitted for his review on the water augmentation plan has not been acceptable. Tom Honn explained that the State Geological Survey has reviewed the request and does not see any serious problems. City of Greeley has indicated that the City has no objections to the application. The request complies with the Weld County Extraction Plan. The Engineering Department and Health Department have no objections to the request. Mr. McWilliams explained that Mr. Johnson submitted the additional materials requested by the State Engineer regarding the water augmentation plan last Thursday. The usual procedure of the State Engineer is to take 8 - 10 days to get necessary signatures on materials. However, the State Engineer has indicated that the plan is acceptable. Mr. Johnson explained that has purchased plenty of water strictly for this purpose, and he is willing to comply with any requests the State may have. Mr. Johnson Is working on a tight schedule because the highway contractor is to start -on August 1 . Mr. Johnson had deeded two shares of his water from him and his wife to him and his wife. Kay McEver explained that Page 1299 , y he has been asked to have the water adjudicated through the water courts because that is the only "enforceable" agreement. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners approval of this request, subject to Mr. Johnson obtaining approval of the water augmentation plan prior to advertisement for the County Commissioner's hearing, and subject to staff and legal recommendations. APPLICANT: John Hochmiller PC 631 (#2360 - 2431 ) CASE NUMBER: SUP 311 SUBJECT: Junk Yard APPEARANCE: Mr. Hochmiller LOCATION: Pt. NE4 Sec. 32 T3N R65W DISCUSSION: Mr. Hochmiller explained that he plans to open a salvage yard. He plans to put a mobile home on it and live in it for the time being. Later he will build a residence and office structure. The property is zoned heavy industrial at this time. Is an existing wrecking yard on the property next door. The property contains 80 acres but Mr. Hochmiller plans to store cars on only 40 acres. Mr. Hochmiller will run this business himself. Mr. Hochmiller will use a 5-foot berm for a buffer. He has recommendations from the Soil Conservation Service regarding what type of trees to plant. The Weld County Planning staff recommends approval for the following reasons: 1 ) The request is in compliance with the permanent industrial zoning which was granted on November 12, 1969, by the Board of County Commissioners; and 2) The Weld County Health Department recommended approval of the request. COMMENT: No response was received from the Weld County School District RE-1 . RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners, approval of this request, subject to the development standards. Seconded by Marge. Yost. SW4 Sec. 2 T5N R67W DISCUSSION: Mr. Hertzke explained that this is a relocation of their present dairy to five miles west of town. One reason is because the City keeps "hassling them" and they also wish to increase the number of milking cows from 125 to 250. Mr. Herzke's father has 1 ,000 acres of irrigated property which makes it a natural place for feeding, purchasing, etc. He proposes two residences with the possibility of a third one in a few years. It is located just southeast of Greeley and next to South Platte River. The purpose of this letter is to propose a Plan of Augmentation to insure that other water users are not damaged by the mining operation. The Water Augmentation Plan is based on information provided by W.G. Wilkinson, Division Engineer, Division of Water Resources at Greeley and his office. The Gravel Mining Operation is shown on the drawing. It will be a phased operation resulting in a final pond area of approximately 21.5 acres. As a result of the mining process, open areas of water will be created that did not exist previously. The aim of this plan of augmentation is to insure that the historic plan of operation is not changed due to the mining operation, This is accomplished by balancing the before and after use. Historic Use The area to be mined is part of a larger holding that has preciously been used for agricultural purposes. It is unlikely that the larger area will remain in agricultural usage. Water Requirements After Reclamation After the area is mined the resultant pond will be approximately 21.5 acres in size. The remaining portion will be in pasture. There also will be a water requirement for the trees and vegetation planted as part of the reclamation plat. Mr. Johnson, the owner of the property to be mined has 12 shares of The Greeley Irrigation Co. total 525 shares of stock. In the early years water can be provided to the pond directly, where it will be lost directly through evaporation. If, in later yea k's water can no longer be delivered through the Greeley No. 3 Ditch it could be returned directly to Poudre at the intake and would replace any water lost by downstream water users of the Platte River. Parish, attorney for the applicant, Eldred M-. Johnson. A request for temporary approval in accordance with 37-92-307 , CRS 1973 was sub- mitted on July 9 , 1976 by Eldred M . Johnson. An amendment to the plan was submitted to the Water Court on July 12 , 1976 . Purpose of the Plan of Augmentation The purpose of the plan of augmentation is to provide replacement water to the South Platte River to augment the river during times when the depletions resulting from evaporation of water from a proposed gravel mining excavation. below the ground water table in the alluvium of the South Platte River could injuriously affect senior vested water rights . The gravel operation is located in the N 1/2 of Section 21, Township 5 North, Range 65 West in Weld County . The gravel mining plan has been approved by the Weld County Planning Commission contingent upon. a satisfactory plan of augmentation. Information Provided by the Applicant In addition to the amended plan of augmentation, several engineering fetter reports have been provided by Freese Engineering of Greeley, Colo- rado. The most recent report estimates the annual evaporation of water from the proposed 21.5 acre gravel pit lake to be 52 acre-feet. The plan proposes to replace the annual evaporation loss from the proposed gravel pit lake by utilizing three shares of Canal No. 3 stock which is a part of the Greeley Irrigation Company system. The yield of one share at the point of diversion of Canal No. 3 is estimated to be 38 acre-feet per year. Canal transmission losses are stated to be between 15 and 20 percent which results in a farm headgate yield of 30 .4 to 32 .3 acre-feet per share . Mr. Freese estimates the farm irrigation efficiency to be 60 percent for the historically irrigated land which results in an estimated historic consumptive use of 18.1 acre-feet per share per year. Therefore , the annual historic consumptive use is estimated to be 54 .3 acre- feet for the three shares . • ,. The land historically irrigated is located on a 47 acre parcel _ with farm buildings on which the 21.5 acre gravel pit lake will be con- structed . The amount of land irrigated on this parcel is estimated to be 40 acres by Mr. Eldred Johnson, the present owner. The entire parcel is to be removed from agricultural production and native dryland type grasses seeded as part of the reclamation plan. The water attributable to the three shares of Canal No. 3 stock is to be diverted into the proposed gravel pit lake . This water will recharge the alluvium of the South Platte River to protect vested water rights from possible injury . Additional Pertinent Information as Determined by this Office The plan of augmentation as proposed will provide replacement water during the period of use of Canal No. 3 which has historically diverted water from the middle of April to the middle of October. This period is the time in which administration of the South Platte River by the Division Engi- neer is normally required. The total amount of replacement water to be made available during this period is that attributable to the annual consumptive use of three shares of Canal No. 3 . The estimate by Freese Engineering is that this amount will average 54 .3 acre-feet per year. This office analyzed the diversion records of Canal No. 3 and found that water has been wasted during recent years which has reduced the actual diversions for irrigation purposes . This office estimates the consumptive use of irrigation water by these three shares to be approximately 53 acre-feet per year which is still in excess of the-estimated evaporation loss . This value is obtained by utilizing canal transmission loss of 15 percent and a field irrigation efficiency of 60 percent. Findings of Fact This office, having reviewed the plan of augmentation and other pertinent information, temporarily approves the plan of augmentation with the following conditions: 1 . However, due to the fact that we have an extra Tuesday in the month of June, we will not be able to schedule it for the Planning Commission any earlier than July 13. Since there could be a question of water service to this property, it might be advisable to not schedule this item until after the City Planning Commission has had a chance to review it. In addition, the Planning Commission reviewed the application for a gravel excavation located at Balsam Avenue and U.S. 34 Bypass for Mountain Aggregates. Outside of our standard concern for the rehabilitation of the land, the Planning Commission has no objections to the excavation. However, it is recommended that, since the excavator shows a two-phase proposal , the rehabilitation plan be reviewed after the completion of the first stage. It is felt that, if this action does take place, there will be additional pressures on the developer to rehabilitate the land. Also, the State Highway Department has indicated they would like to have the haul road location changed to line up with their interchange access. Present were Glenn McDonald, Clifford Clift, Clark Ewald, and Dean Cummins. Absent was Tom Charles. Also present were Sam Sasaki and Bill Neal of the Planning Department. Mr. Sasaki presented a copy of a letter of resignation from Bob Britzman to Mayor George Hall effective June 15, 1976. The Council had accepted the letter of resignation and will be filling the vacancy as soon as possible. I. APPROVAL OF MINUTES E Commissioner McDonald requested that Item IX of the minutes of the June 8, 1976, meeting be changed to read, "the boundaries of the addressing system be extended to coincide with the Greeley rural mail routes." There were no objections to the correction and Dean Cummins moved the minutes be approved as corrected. Clifford Clift seconded, and the motion passed unanimously. The minutes will be changed to reflect the correction. III ALLEY VACATIONS, BLOCK 44 (Greeley National Bank Building) Mr. Sasaki reviewed the item and reported that staff had met with telephone company and bank staff regarding this item. The City has received a letter stating that Mountain Bell has no objection to the vacation since they do have access through conduits for service purposes. There were no objections from the other utilities and no problems with water and sewer lines. Dean Cummins moved the Planning Commission recommend approval of the vacation. Glenn McDonald seconded. REFERRAL FROM WELD COUNTY: SPECIAL USE PERMIT FOR SAND AND GRAVEL OPERATION Location: Projected Balsam Avenue and U.S. 34 Bypass (extended) Mr. Sasaki reviewed the application for an open cut mining permit applied for by Mountain Aggregates. Since the area is zoned industrial which does not permit mining, the application is also for a rezoning to a classification which will permit mining. The mine will be a wet pit due to ground water seepage into the excavation. Mr. Sasaki reviewed for Planning Commission members the state reclamation act which preserves agricultural lands. Since the area does contain gravel deposits, these deposits must be mined before the land can be used for any purpose other than agriculture. The state requires a bond of the applicant to help assure reclamation. The applicant has submitted a rehabilitation plan after mininc is completed. The excavation will be done in stages so the county can see if the property is being reclaimed properly. A separate application for each stage is required. Mr. Bob Patrick of the State Highway Department was present and commented that the state requests that the haul road be aligned with their interchange access. This would be a more direct route for trucks associated with the operation. Commissioner McDonald moved the Planning Commission recommend approval to the County of the application with provision for the access as requested by the State Highway Department rather than as shown on the present plan. Dean Cummins seconded, and the motion passed unanimously. IV. CONSIDERATION OF ZONING FOR LARSON ANNEXATION Location: 4100 Block of 4th Street • Staff has recommended R-1 zoning for all of the annexation. Both R-1 and R-3 are posted on the property since the owner has indicated a possibility of wanting approximately 5 acres zoned R-3. Mr. Sasaki reported that all of the surrounding areas, even the areas in the County, are zoned for single-family residential. This site lies adjacent to the South Platte River in areas mapped as "F4" and "T4" on the Colorado Geological Survey gravel resources map of the Greeley quadrangle. Because of a lack of subsurface and test data, the deposits shown on our map are essentially unevaluated. Although the total area of the site is 47 acres, the actual extraction area is confined to about 22 acres, which lies entirely on F4, flood-plain deposits. Two well logs on our map report gravel thicknesses in excess of 80 ft. Although the Johnson application reports only 25 ft of gravel, it can still be classed as a commercial deposit. I do not see any serious geologic problems involved with this operation or the proposed reclamation plan. Proposed access, haulage route, and ditch alteration appear adequate. Side slopes of pond should be at about 3:1. Top dress the slopes with a minimum of 4 inches of topsoil. Then seed slopes to intermediate wheatgrass and Smooth Bross, This can be broad cast by hand or drilldd in. Plant shrubs (Nanking cherry & Honeysuckle) about 5 fest apart on north and west sides of the pond and approximately twenty fest away from the edges of the pond. For quick growth we suggest planting cottonless cottonwood about 100 fest apart over the remaining portion of the property. A few pine tress planted in clusters of five to seven and planted at random would be beneficial. A seeding of Orchard grass, Brous and Intermediate wheat grass should be seeded over the pasture area for grazing purposes, Seed at approximately 15 pounds per acre.
