WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated March 3, 2010, the Board of County Commissioners approved the application of A & W Water Service, Inc., 1892 Denver Avenue, Fort Lupton, Colorado 80621, for a Mineral Resource Development Facility, including Oil and Gas Support and Services (water supply and storage, potash mixing and storage, and production pipe and equipment storage area) in the A (Agricultural) Zone District on the following described real estate, to wit: Part of the E1/2 of Section 31, Township 4 North, Range 66 West of the 6th P.M., Weld County, Colorado, and WHEREAS, on October 18, 2010, the Board of County Commissioners of Weld County, Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for Improvements between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and A&W Water Service, Inc., with terms and conditions being as stated in said agreement, and accepted Performance Bond No. B006081, drawn on U.S. Specialty Insurance Company, 13403 Northwest Freeway, Houston, Texas 77040, in the amount of $145,240.00, and WHEREAS, by Resolution dated November 23, 2011, after staff from the Weld County Department of Public Works conducted a visual inspection and recommended the partial release of said collateral, in the amount of $123,454.00, the Board was presented with and accepted replacement Performance Bond No. B006951, drawn on U.S. Specialty Insurance Company, 13403 Northwest Freeway, Houston, Texas 77040, in the amount of $21,786.00, as warranty collateral. WHEREAS, staff from the Weld County Departments of Public Works and Planning Services have conducted a visual inspection and recommend final release of said warranty collateral. WHEREAS, upon recommendation of staff, the Board deems it advisable to release said collateral. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Performance Bond No. B006951, drawn on U.S. Specialty Insurance Company, 13403 Northwest Freeway, Houston, Texas 77040, in the amount of $21,786.00 be, and hereby is, canceled and released. BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is, directed to return said collateral to the appropriate issuing party. The inspection mainly will involve installation reviews of any drainage and roadway improvements as shown on the final set of"As-built" Plans from CES Consulting. I have the Plans and will basically walk the site, looking for those type of features listed on the plans. I will also note if there is any evidence of erosional or discharge events. I'll look in any culverts, outlets,etc.,to make sure they are clear and that there is no scouring/gullying of the road and ditch slopes.The inspection will take approximately one hour to complete. Although not required, you and whoever else you would like to take part, are welcome to accompany me during the inspection. Let me know if you have any questions. Otherwise, I'll be at the facility access at CR 38.5 and SH 60 on 2/17/15 at 9:00 am to start the inspection. We will have to postpone the inspection, if there is any substantial snow cover on the site. I'll touch base with you the day before if that might be an issue.
