WHEREAS, it has been determined by the Board of County Com-
missioners, Weld County, Colorado, that Robert D. Hart is the owner of
a parcel of land described as follows:
A portion of the West Half of the Southwest Quarter of Section
3, Township 2 North, Range 67 West of the 6th P. M. , more
particularly described as follows:
Considering the South line of the Southwest Quarter of said
Section 3 as bearing North 90°00'00" East and with all
bearings contained herein relative thereto.
Beginning at the Southwest corner of said Section 3, thence
along the South line of the Southwest Quarter of said Section
3 North 90O00'00" East a distance of 850. 45 feet; thence on
a line parallel to the East line of the West Half of the South-
west Quarter North 00O12'15" East a distance of 330. 00 feet;
thence parallel to the South line of the Southwest Quarter
North 90°00'00" East a distance of 66. 0 feet; thence on a
line parallel to the East line of the West Half of the South-
west Quarter North 00O12'15" East a distance of 602. 73
feet; thence parallel to the South line of the Southwest Quarter
of said Section 3 North 90°00'00" West a distance of 979. 01
feet; thence on the West line of the Southwest Quarter of said
Section 3 South 00°24'56" West a distance of 932. 75 feet to
the TRUE POINT OF BEGINNING, containing 20 acres, more
or less, and
WHEREAS, Mr. Hart is desirous of splitting the hereinabove de-
scribed tract of land into parcels of 12 and 8 acres, and
WHEREAS, it appears that a lot size variance first must be obtained
before the applicant may apply for a Recorded Exemption from the sub-
division regulations of Weld County, as the same is defined in Section 9-4
of the Weld County Subdivision Regulations, and
WHEREAS, in addition to evidence presented by the applicants, the
Weld County Planning Commission Staff has presented evidence and made
representations concerning the desirability of granting said variance, and
WHEREAS, the Board of County Commissioners feels that when
all of the evidence and representations are considered, good cause for grant-
ing a variance as requested from the minimum lot size requirements of the
Weld County Zoning Resolution has been shown.
NOW, THEREFORE, BE IT RESOLVED, that pursuant to the powers
granted to the County under Title 30 C. R. S. 1973 and Section 9-4A (6), Weld
County Subdivision Regulations, as amended; that Robert D. Hart may pro-
ceed to apply for a Recorded Exemption and the lot size variance is conditioned
on the applicant applying for and doing all necessary to obtain said Recorded
Exemption within one (1) year, and said variance is limited to Mr. Robert
D. Hart and will terminate if he sells or otherwise discontinues his interest
in the above mentioned land prior to obtaining approval for and recording the
above mentioned Recorded Exemption.

RE: Request for a Lot Size Variance
Dear Commissioners:
The attached materials are in reference to a request, by Robert D. Hart,
for a lot size variance on a parcel of land described as part of the
Wk of the SWa of Section 3, Township 2 North, Range 67 West of the 6th P.M. ,
Weld County, Colorado. Said Parcel is located three miles south and three
miles west of Platteville northeast of the intersection of County roads
24 and 19. The subject property contains approximately 20 irrigated acres.
The request is to split the property into parcels of 12 and 8 acres.
Each resulting parcel would have a residence and a garage shop building.
The proposed division line follows an irrigation ditch which flows through
the property in a northwesterly direction.
Based upon the information submitted, the Planning Commission staff recommends
approval for the following reasons:
1 . The proposed split conforms with the intent clause (Section 9-2)
of the Weld County Subdivision Regulations, the intent clause for
the Agricultural District (Section 3-3(A) of the Weld County
Zoning Regulations), and the Weld County Comprehensive Plan in that
each resulting parcel would have an existing set of improvements.
The use would be compatible with surrounding agricultural uses.
