Dear Sir:
This letter is to notify you that the Brighton/Ft. Lupton Landfill has
been in violation of the following provision of the Solid Waste Disposal
Sites and Facility Act on the last two successive inspections conducted
by this department:
"Such sites and facilities. . .shall be kept adequately covered
during their use." (Section 30-20-110(a))
The Colorado Department of health 's interpretation of "adequate cover"
is cover at the end of each day the landfill is in use.
In accordance with Section 30-20-112, C.R.S. 1973 the above listed
violation must be corrected within seven (7) days of receipt of this
letter or it will be necessary to request a hearing before the Board of
County Commissioners regarding revocation or suspension of your Certificate
of Designation.

Dear Sir:
On January 12, 1977, this Department made an inspection of the
Erie and Brighton/Ft. Lupton Landfill . At the time of the inspection,
certain items were in violation of the Solid Waste Disposal Sites
and Facilities Act; specifically, paragraphs e and f of Title 30,
Article 20, Section 110 C.R.S. 1973.
Paragraph e of 30-20-110 states :
11• . solid wastes shall be distributed in the
smallest area consistent with handling traffic
to be conducted . 11
Paragraph f of 30-20-110 states:
"Sites and facilities shall be adequately fenced
so as to prevent waste material and debris from
escaping therefrom . • 11
The violations (see enclosed inspection reports) must be corrected
within 5 days of receipt of this letter or the condition will be
classed as a misdemeanor.
