HomeMy WebLinkAbout20152776.tiff RESOLUTION RE: ACCEPT PETITION AND AUTHORIZE VACATION OF A PORTION OF COUNTY ROAD 1 AT ABRAMS LAKE-TOM CAGGIANO, C/O INTERMILL LAND SURVEYING, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Road Petition from Tom Caggiano, 145 Hayrick Lane, Commack, New York 11725, do Intermill Land Surveying, Inc., 1301 N. Cleveland Avenue, Loveland, CO 80537, a copy of said petition and a list of the adjoining property owners marked Exhibit A, being attached hereto and included by reference, requesting vacation of a portion of right-of-way for County Road 1 at Abrams Lake, being more fully described as follows: Being a portion of the Southwest Quarter of Section 6, Township 4 North, Range 68 West of the 6th P.M., Weld County, Colorado, as further described in Exhibit B. WHEREAS, the Department of Public Works has recommended approval of said request since that portion of right-of-way is not needed for the safety and welfare of the traveling public, and WHEREAS, any persons owning dedicated and recorded easements and rights-of-way for the use of the right-of-way to be vacated, if any, may continue such use after formal vacation by Weld County, and WHEREAS, the Board of County Commissioners heard testimony and reviewed all other evidence presented therein by staff and the public, and WHEREAS, the evidence showed that the vacation of that portion of right-of-way which is described above will not leave any land adjoining the roadway without an established public road or private access easement connecting the land with another established public road, and WHEREAS, the Board of County Commissioners deems it advisable to vacate said portion of road right-of-way, with said vacation to become effective upon recording as required below. BE IT FURTHER RESOLVED by the Board that Weld County shall retain any mineral interests it may possess in the area of the vacated right-of-way and that the vacation authorized herein shall in no away affect such mineral interests. Dedication of Road. The original road was dedicated around 1899 along the county line, between 1899 and 1937 the road was re-routed to its current location due to the presence of the lake. Thus the road has been reserved to the county through use for some 78 years by public use and maintenance. This essentially grants us a Dedication by Use. Additionally, each of the adjacent property owners on both sides of the road are in a recorded exemption. In reviewing the plats for each of those RE's, they all include a 60 foot ROW for Weld County Road 1. As a result, I do not think any of the property owners could claim that we do not have a ROW for this road. 2. Reservation of Land to Property Owners. C.R.S. 43-2-302, the vacation statute, outlines that when the right of way is vacated,the land vests in the respective property owners, so as Bruce said it doesn't need to be in the resolution, but it may make sense to include it going forward. 3. Reservation of Mineral rights. Working with Esther and the CTB,they have changed the resolution template for these ROW vacations to include the language regarding reserving our interests, so it should be included in all the resolutions going forward, they have been a huge help.
