Approved with Conditions The Weld County Department of Planning Services has determined through an administrative review that the standards of Section 24-8-40 of the Weld County Code have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of Weld County. 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. The Applicant has proposed a well as the source of adequate water for Lots A and B. Property owners are advised that the quantity of water available for usage may be limited to specific uses, i.e.,"Domestic Use Only," etc. Because each situation is unique, the Department of Planning Services encourages property owners to contact the Office of the State Engineer, Division of Water Resources (1313 Sherman Street, Room 818, Denver, Colorado 80203. Prior to recording the plat: The plat shall be titled: Recorded Exemption No. 0455-17-2 RE-3746 B: The applicant shall re-configure the alignment of Lots A and B to run east-west thereby providing frontage adjacent to County Road 27 a publically maintained road. For reference, a sketch is included with these comments. In accordance with Chapter 8,Article II of the Weld County Code, Lot Aand Lot B shall be grantedone residential/agricultural access. Direct access from a public road shall be limited to one access per legal parcel for residential use, no circle drives or additional accesses shall be granted. The road shall be graded and drained to provide all weather access. Accesses shall be placed in such a location as to have adequate sight distance in both directions, shall not be placed below the crest of a hill or where - physical obstructions are present. © All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved road access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe(CMP)is Weld County's minimum size. If the applicant chooses to place a larger culvert please contact the Weld County Department of Public Works to adequately size the culvert. E County Road 106 is designated on the Weld County Transportation Plan Map in the County Wide Impact Fee Code Ordinance,Section 20-1-30,as a Section Line road. The applicant shall verify the right-of-way and the documents creating the right-of-way shall be noted on the plat. If the right-of-way cannot be verified, it shall be dedicated on the plat. This road is not maintained by Weld County. ,.F' County Road 27 is designated on the Weld County Road Classification Plan as a local gravel road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. A total of 30 feet from the centerline of County Road 27 shall be delineated on the plat as right-of-way. This road is maintained by Weld County. G. The West Greeley Soil Conservation District has provided information regarding the soils on the site. The applicant shall review the information and use it to positively manage on site soils. .H. All vehicles located on the property must be operational with current license plates, or be screened from all adjacent properties and public rights of way, or be removed from the property. All other items considered to be part of a noncommercial junkyard must also be removed from the property or screened from adjacent properties and public rights-of-way. LotA shall comply with the less than thirty-five(35)acre maximum lot size required by Section 24-8-10.B of the Weld County Code. J. The following notes shall be placed on the plat: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. No building or structure as defined and limited to those occupancies listed as Groups A, B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code,shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery or 150-foot radius of any wellhead shall require a variance from the terms of the Section 23-3-10 of the Weld County Code. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Prior to the release of building permits,the applicant shall submit a recorded deed describing the Lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. 4) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that Lots A and B have an adequate water supply of sufficient quality,quantity and dependability. 5) Potential purchasers should be aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. The Weld County Department of Public Health and Environment strongly encourages well users to test their drinking water prior to consumption and periodically there after. 6) Prior to the release of building permits for any structure exceeding 3.600 square feet, the applicant must comply with the requirements of Appendix III-A of the Uniform Fire Code. 7) Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code. 8) The approved configuration of Lot A does not constitute justification for further land splits. 9) Recorded Exemptions on adjacent properties may raise the issue of compliance with the intent of the Recorded Exemption Process.Approval of this Recorded Exemption does not guarantee approval of future applications on adjacent properties. 10) Effective January 1,2003,Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-11) 11) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive agricultural counties in the United States, ranking fifth in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment;slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; and the use of pesticides and fertilizers in the fields,including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size(twice the State of Delaware) with more than 3,700 miles of state and County roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases,will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important,not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 4. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty(60)days from the date the Administrative Review was signed. The applicant shall be responsible for paying the recording fee. 5. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00. The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). This digital file may be sent to maps(c�co.weld.co.us. 6. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application is based on satisfying the Conditions of Approval. I did not record the date of that meeting, but Mr. Carroll's letter to Kim Ogle dated April 6, 2004, references it. At this point, RE-3746 has been approved with conditions. This Recorded Exemption (RE)would divide the north half of the northwest quarter of Section 17 into two parcels. A meeting was held on July 21, 2004 to discuss issues regarding the RE, one of which was the construction of County Rd 106. Those in attendance were Donald Carroll, Kim Ogle, Keith Meyer, Tom Smith of Brunello, and me. At this time we plan to construct County Rd 106 from County Rd 27 east for 0.5 miles with a cul-de-sac at the end. We also noted that we would most likely request approval to construct a County Rd along the half-section line from County Rd 106 to County Rd 104, as we had discussed at the previous meeting between you, Mr. Carroll, and me. On RE-3746 Kim Ogle had originally asked us to reconfigure Lots A and B so they would have access from the county road. I sent an email to Kim Ogle on March 30,2004 saying that if we were allowed to keep the originally proposed configuration, we would construct county road 106 from CR27 to the east for half a mile and put in a cul-de-sac. This would be constructed to county road standards. Don Carroll agreed to this and I believe that Kim Ogle did also. We wish to proceed with the RE's, and need to know how to proceed. Should we just proceed witht the original RE and complete all items requested in the response except for the reconfiguration. Do we need non-exclusive license agreements on anything? There may be County right-of-way, yet note County constructed road (CR 104). Given the issue of non-exclusive license agreements, staff determined this was the best(known)alternative. Please advise on how Public works desires to handle this land use application request. It should also be stated that this applicant(Brunello, LLC purchased the entire section and will be coming back in with back to back to back Recorded Exemptions. I am a"partner"(managing member)in Brunello, LLC with Tom Smith. We have received your response and comments with regard to RE-3746. We noted that your comments suggested that we reconfigure the alignment of Lots A and B to run east-west so as to provide frontage adjacent to County Road 27. We are not adverse to doing that and will be willing to do so if that is the only alternative. However, I believe that some additional information is pertinent. Several months ago we met with Frank Hempen and Don Carroll of the Weld County Public Works Department regarding roads in and adjacent to Section 17(T9N, R66W). We have explored the idea of constructing a road conforming to county road standards along the CR106 ROW (North Section line)for a distance of 0.5 miles east of CR27, and then constructing a road conforming to county road standards along the half section line from CR 106 to CR 104. Although there have been no commitments made, both sides indicated a willingness to work together along those lines to provide a road system that would be in the interest of public health and safety. Not doing so would severely restrict future use of the remaining portion of Section 17 on the east side of the railroad tracks. We believe that the location of the railroad tracks pose a unique situation uncommon to most other locations in Weld County. We would be willing to construct a road conforming to county road standards along the CR106ROW(North Section line)for a distance of 0.5 miles east of CR27 at the present time (as a condition of this RE), and commit to construction of the road along the half-section line from CR 106 to CR 104 if future development of the section proceeds. This, of course, would be predicated on the approval of the configuration of Lots A and B as originally proposed. One distinct advantage of this would be that access to both lots would be off of a low-traffic road and access to CR 27 would be at a conventional county road intersection. This would be a safer situation than direct access from the lots on to CR 27 which is a more heavily travelled road. Road acceptance policy, as follows: Sec. 8-6-150. Road acceptance policy. The County does not maintain private roads, lanes or driveways. (See Article I, Sec. 8- 1-30. Snow Removal Plan A, F., Operations, 7: Snow Policy) The sponsor(s) of the roadway project desiring to obtain County maintenance shall first address such request to the Board of County Commissioners for its consideration at one of its regularly-scheduled business meetings. The sponsor(s) shall be responsible to pay the entire cost of notification to owners and/or occupants of lands lying adjacent to the roadway. Such notification shall include a description of the request and shall set forth the time and place of the Board consideration. Before a public road can be accepted by the Board of County Commissioners for maintenance, the road must meet the following minimum conditions: A. The road right-of-way shall be dedicated or otherwise secured to the satisfaction of Weld County for use by the public and maintenance by the County_ B. The road right-of-way shall be clearly staked and flagged for construction purposes by a licensed land surveyor. The surveyor shall notify the Department of Public Works, in writing, when the staking is completed. C. The width of the right-of-way cannot be less than sixty (60) feet. D. The road shall serve a minimum of three (3) legal lots, which must have residential dwellingsto be considered for acceptance. Properties abutting the intersection of the road under consideration for acceptance and an existing publicly maintained road do not count toward the required three (3) lots. E. The minimum road width shall be a minimum of 26 feet of graveled surface or meet the minimum design guidelines for the anticipated traffic on the roadway segment being considered. F. .The following shall be the minimum acceptable standards before a road is accepted for maintenance: 1. The roadway cross slope, from center line, shall be not less than three percent. 2. Borrow ditches shall be a minimum of 24 inches deep with 3:1 side slopes and graded to provide adequate drainage. 3. All side road borrow ditches shall be sufficient to carry the five-year storm or be a minimum of an 18" diameter culvert as determined by the Director of Public Works. Cross road drainage structures shall be sufficient to carry the ten-year storm or be a minimum of an 18 inches culvert as determined by the Director of Public Works. 4. The Department of Public Works shall test and inspect the roadbed subgrade for structural adequacy and acceptable materials. The subgrade shall be compacted to ninety five (95) percent of AASHTO Standard Proctor T-99 (Method A) or other compaction standards previously approved by the Director of Public Works. F. A minimum of four inches of compacted gravel meeting Colorado Department of Transportation specifications for Class VI material must be provided on the traveled surface. The gravel shall be compacted in accordance with AASHTO Standard Proctor T-99 (Method D) requirements. G. The road cannot be fenced or gated. If cattle have cross access to the roadway, a cattle guard shall be installed in accordance with the County cattle guard policy. H. If a fence exists along the section line on which the road is to be built, relocation of the fence(s) to the road right-of-way lines shall be the responsibility of the sponsor(s) of the roadway project. Reimbursement by the sponsor(s) of the roadway project shall be made for acreage within the road right of way included in an adjacent property Conservation Reserve Program (CRP) crop or which has an unharvested annual crop demolished by the roadway construction project. J. The sponsor(s) of the roadway project shall be responsible for all costs associated with construction of the road. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. WCR 27 is designated on the Weld County Road Classification Plan (FHU) as a local gravel road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. REQUIREMENTS: The Weld County Public Works Department recommends approval of this application. The access shall be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size your culvert. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. Our comments and requirements are as follows: COMMENTS: WCR 106 is designated on the Weld County Road Classification Plan (FHU) as a section line. This road is NOT maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. WCR 27 is designated on the Weld County Road Classification Plan (FHU) as a local gravel road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. REQUIREMENTS: The Weld County Public Works Department recommends approval of this application. The access shall be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size your culvert.
