HomeMy WebLinkAbout760309.tiff r FINDINGS AND RESOLUTION CONCERNING PETITION OF RICHARD AND DONNA CONNELL FOR A LIVESTOCK TRUCK WASH FACILITY The petition of Richard Connell and Donna Connell, husband and wife, Greeley, Colorado, for a special use permit, for a livestock truck wash facility on the following described property, to-wit: Part of the Northwest Quarter (NW4) of the Southeast Quarter (SE4) of Section 11, Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, more particularly described as follows, to-wit: Beginning at the center of said Section 11; Thence North 89°5' East, 330. 00 feet on the East and West centerline of said Section 11; Thence South 1062. 1 feet parallel with the West line of said Southeast Quarter (SE 4) to the place of beginning; Running thence from said point of beginning North 89° East, 316 feet; Thence South 29°20' West, 4. 2 feet; Thence West 23 feet; Thence South 31° West 250. 00 feet; Thence South 89° West 161. 6 feet to a point 330 feet East of the West line of said SE-41; Thence North 217. 9 feet to the place of beginning, came on for hearing on July 7, 1976, and the Board of County Commissioners of the County of Weld, having heard the testimony and evidence adduced upon said hearing, and having considered the testimony, evidence and statements and recommendations of the Weld County Planning Commission filed with said Board, and having made physical inspection of the above-described premises, and having carefully weighed the same, now makes the following findings: 1. The evidence and investigation shows that the inhabitants of the immediate vicinity and of the surrounding area have mixed emotions relative to having a livestock truck wash facility at the location of subject property. 2. The evidence and investigation shows that the proposed use would not be compatible with the surrounding area. 3. The evidence and investigation shows that the proposed use would have a negative impact on the area and that such proposed use would have a negative effect on future development of the area. 4. The evidence and investigation shows that the recycling of water used per day as it relates to the high water table in the area, would add materially to the surface pollution and which is of vital concern of the residents of the immediate area of subject property. 5. The evidence and investigation shows that the area of subject property is inadequate for this type of operation. 6. That each of the preceding findings in and of themselves and in- dependent of each other constitutes a separate and individual ground for denial of the request for a livestock truck wash facility. The applicant has expressed no methods for reduction of odor at times when levels exceed those of the State and County requirements; 2) Water provision has been indicated to be by well . The attached well permit number 83516-A as a replacement well is limited to 15 gpm for domestic use to include irrigation of not over 1 acre of home, gardens and lawns. No indication shows the well for use as water source for truck wash; 3) No methods for storage, pressurizing, and manner of recycling of the water is given. Said methods and facilities should be shown on plans and explained; 4) The property is not sized adequately to allow efficient ingress, egress, and in- ternal traffic flow. The County Engineer has requested information regarding access to and from County Road 58. Without said designs it is difficult to evaluate effective use of the property for the proposed use. The County Engineer has stated that no truck parking should be allowed on County Road 58 -� while waiting to use proposed facilities. It is questionable that this could be avoided considering the offroad parking areas that have been proposed; 5) access from County Road 58 to the subject property crosses the Delta Ditch Lateral . No provision for crossing has been provided. The County Engineer has requested design of the crossing; 6) Locations of waste dis- posal are not identified. These should be reviewed by the Health Department for acceptability and limitations prior to acceptance of this proposal ; 7) Property owners in the area have expressed objections to the proposed use and its impacts on their property; and 8) The Weld County Planning Commission has determined the following in consideration of this application, as given in Sections 3.3. E. 2. and 3. 3. (I) 2. : a)/The proposed use would not be compatible with the surrounding area; b) ,The proposed use would have a negative impact on the area; and c) The proposed use would have, a negative effect on future development of the area. Mrs. Connell stated that she had been fully informed by Glen Paul about what would happen if there were any odor or water problems. Nine signatures in file objecting to this proposal . Two people have signed the petition to grant the request. Mr. Carlson explained that the designated 1 acre is from the middle of the road to the middle of the road. • - Mrs. Connell explained that this proposal is located on the proposed side of the Greeley Sewer. This is one reason they want to locate here. Theodore Dill , neighbor, strongly objects because of size and odor. Chuck Carlson expressed concern regarding reusing the water and spreading disease. Mrs. Connell explained that she would work very closely with Glen Paul regarding any health problems which might occur. RESOLUTION: Be it therefore resolved to recommend to the Weld County Com- missioners denial of this request for a livestock truck wash facility based on staff recommendations. Motion by Chuck Carlson. Seconded by J. Ben Nix. A vote of "aye" by Elliott, Ashley, Heitman, Carlson and Nix. Kountz and Hiatt abstained. Motion Carried. APPLICANT: Amoco Production Company Tape 629 (#2409-2576) CASE NUMBER: Z-273 SUBJECT: Zone change E to A-UD APPEARANCE: John Lang, Lou Gaskins, Amoco Attorney LOCATION: Pt. W'Z SE4 Sec. 6 T1N R66W DISCUSSION: This is a 5 acre unit development requested in order to drill a well . The normal location of the well would be in the NE4 but that location is in Ft. Lupton. Area is floodprone; water backups into lowland. Well will be 8,000 feet deep. Normal trucking activity associated with drilling will take place. Drilling should not take more than about a week or ten days. Area will be enclosed by a chain linked fence which will be kept locked. Mr. Lang anticipates going up 85 across Kay Hill and up on Fulton into an alley during drilling operation. The alley is only about 15 feet wide. Is a possibility of widening this during the drilling operation. This has been presented to the Ft. Lupton Planning Commission and it approves. Weld County Planning staff recommends approval for the following reasons: 1 ) Complies with the Weld County ,Comprehensive Plan in that a use allowed by right in an agricultural district will be promoted by this zone change to Agricultural Unit Development; 2) All items required for a zone change have been submitted and are in order; 3) the Town of Ft. Lupton has recommended approval of the zone change; and 4) the Weld County Health Department has recommended approval . SUBJECT TO: 1 ) The zone change request shall be limited to the plans submitted and governed by the development standards thereon. Any changes to the plans and/or development standards shall require another change of zone procedure before such changes shall be allowed; and 2) Amoco shall oil the private access road to the site prior to construction as a dust abatement measure as requested by the Town of Ft. Lupton. Mr. Lang explained that private access road is adjacent to small stream; he would like to water the road rather than oil it because of the possibility of oil getting into the stream and flowing into the river. Perkins Tape 629 (#1732-1780) CASE NUMBER: VI-29 SUBJECT: Mobile Home Violation APPEARANCE: None LOCATION: WZ Lot 5 Wiesner Subdivision DISCUSSION: Tom Honn read a summary of what has taken place into record. On February 28, 1974, Board of Adjustments granted a variance for one mobile home. March 17, 1976 a complaint was received from a neighbor that Mr. Perkins had moved a second mobile home onto the property. On March 24, 1976 the Zoning Inspector inspected the property and learned that the two mobile homes were going to be attached . A violation notice was issued for the 2nd mobile home. A violation letter was sent certified to Mr. Perkins on April 5, 1976. A second inspection was make on April 12, 1976. On April 5, 1976 the electrical inspector was asked to leave property and was threatened with dogs. The certified violation letter was returned by Post Office unclaimed on April 23, 1976. NWa SEq Sec. 11 T5N R65W DISCUSSION: Mrs. Connell explained that she would like to wash semi trucks on East 18th Street (custom operation) . The water will be funnelled into tanks thru manhole type structures. These structures will not be completely covered. Mrs. Connell stated that she does not have intentions of parking trucks on the highway. She explained that the access onto 58 is not large enough but . it can be made larger. The Weld County Planning staff recommended this be tabled for the following reasons: 1 ) The Weld County Engineering Department has requested that information be sub- mitted on: a) the design of the access to and from County Road 58 and b) the design for crossing the lateral of the Delta Ditch which is the concrete lined irrigation ditch which flows through the subject property; 2) the method of supplying water for the pro- posal needs clarification. A letter from the North Weld County Water District has been submitted stating that water service can be made available. However, the applicant stated on 4/27/76 be- fore the City of Greeley Planning Commission that water for the proposal would be supplied from an existing domestic well located on the property. On that date, documentation on the well was • requested, but nothing has been received; and 3) various other problems with regard to ingress and egress from the property of trucks utilizing the wash facility needs to be clarified: a) parking areas designated on the plans appear to be only minimal . The question arises as to where trucks waiting to be washed will be parked. If trucks are backed up on County Road 58 while waiting to be washed, serious traffic problems could result; and b) there are questions as to whether the proposed 30-foot access is adequate to accomodate the turning movements of the vehicles which will utilize this facility without creating traffic hazards on County Road 58. Mr. Smith, County Engineer, commented that he still needs information as to how they plan to approach on Road 58 and especially how they plan to cross the ditch. The ditch itself will not carry any loading. He is also concerned about the width of the road. Glen Paul , Environmental Health, stated that Health Dept. has approved this because the Connells intend to use a honey wagon. Mr. Elliott field checked the site. He feels the area is too small for this type operation. He also feels that neighboring property owners will object to the smell . These trucks will be approximately 65 feet long - the area is less than one acre in size. It takes approximately 20 minutes to wash one of these trucks out. Ted Dill , a neighbor, presented his objections to the operation. Bill Neal , Greeley City Planning Commission, explained that anything that is within the City Comp thensive Plan is automatically referred by Page 1270 the County Planning Commission to the City. The City Planning Commission was concerned with: 1 ) whether or not that activity can re conducted on tha pr .perty without having adverse effect on the neighbors; 2) wear and tear on County bridge system; and 3) might be a potential methane problem with a totally contained system. The City Planning Commission recommended approval of this activity with the understanding that all these things can be resolved to the satisfaction of Weld County. The City feels it is open to question as to whether or not this is an agricul- tural activity. Mr. Ashley stated that he would like to visit this site. Mr. Carlson (Chuck) also stated that the area is very small . MOTION: By Bill Elliott, to table this request. Seconded by Marge Yost. A vote of "aye" by Elliott, Weigand, Yost, Heitman, Ashley, and Carlson. MOTION CARRIED. Whether or not an exception from the zoning resolution requirements and limitations is warranted by virtue of the design and amenities incorpor- ated in the development plan. 7. That land surrounding the proposed Planned Unit Development car be planned in cornination with the proposed Planned Unit Development. 8. That the proposed change to Planned Unit Development district is in conformance with the general intent of the comprehensive master plan. 9. That the existing and proposed streets are suitable and adequate to carry anticipated traffic within the proposed district and in the vicinity of the proposed district. 10. That existing and proposed utility services are adequate for the pro- posed development. 11 . That the Planned Unit Development creates a desirable and stable environ- ment. 12. REFERRAL FROM WELD COUNTY - APPLICATION FOR SPECIAL USE PERMIT TO CONSTRUCT A LIVESTOCK TRUCK WASH Location: East 18th Street (County Road 58 approximately 1 mile east of the intersection of Fern Avenue) Developer: Mr. Richard C. Connell Route 4, Box 189 Greeley Planning staff members briefed the remainder of the Administrative Review Team on the details of this special use permit application. The facilities as described in the application are a large cement septic facility, which would be completely sealed and contain settling chambers for solids. The solids would be removed regularly and distributed away from the property. The liquid in the process would be recycled and utilized in a livestock truck washing operation. A paved ramp would drain into the septic facility, and the storage tank and pressurizing equipment would be on the property. According to correspondence received from the County, this activity may take place in the agricultural district without rezoning. The development is subject, however, to a special use permit approval by the Board of County Commissioners. Staff members commented that a facility of this type at this location would pose no particular land use problems and would be consistent with the Comprehensive Plan design in this area. If this facility could be planned as an agricultural use and if no truck storage would be allowed on the property, no land use problems would be anticipated. Mr. Alleman, Director of Water and Sewer, commented that from the point of view of sanitary engineering, he had questions as to the effectiveness of such a facility from a functional design point of view. He commented that if well water is to be used for this facility and the runoff from the washing process of manure and other cattle wastes is to be contained within an enclosed system, the possibility for potential explosions at the facility would definitely exist. He further commented that it is extremely difficult in an operation like this to design a filtering process within the system so that the water involved can be self-cleaning and can be reused. Such con- siderations are extremely important in this application and Health Department officials should be directly contacted by the applicant to determine whether or not this process is actually feasible. Present were Glenn McDonald, .ob Britzman, Tom Charles, Dean Cummins, and Clark Ewald. Absent were John Dietz and Clifford Clift. Also present were Sam Sasaki and Bill Neal of the Planning Department. I. APPROVAL OF MINUTES Bob Britzman moved that the minutes be approved as mailed. Glenn McDonald seconded, and the motion passed unanimously. II. AMENDMENT TO LONGMEADOW PLANNED RESIDENTIAL UNIT Location: 23rd Avenue and 16th Street Mr. Sasaki reviewed the original proposal and the first amendment. He also presented the proposed amendment which relocates some parking spaces and would allow for better land- scaping. The proposed amendment does not eliminate any parking area. Mark Goldberg of Midland Federal Savings was present and presented a model of the building they plan to erect. He also presented sketches of landscaping and photographs of their existing facilities in other cities. Lawrence Ashlock, who represents some residents in the area, and Mr. John O'Hagan, a • resident of the area, were present and voiced opposition to the amendment. The residents did not want to deviate from the original plan. They felt that even though the banking facility was permitted in the zone, that it would tend to bring other commerce into tie area, and they were opposed to this. They also expressed concern about traffic flow even though the facility was designed to minimize traffic flow. Mr. O'Hagan made comments of the history of the area and noted that it was an excellent neighborhood. He referred to a letter by Barb Huner of Engineering written in November, 1972, commenting on the amount of traffic at that time and he expressed concern thatthe development as proposed in this area would only increase traffic appreciably. It was noted that with one less apartment building in the area the density would be less, thereby decreasing the traffic in the area. Mr. Sasaki commented that the ingress and egress to 23rd Avenue and 16th Street would be controlled. Mr. McDonald commented that some of the traffic problems in this area existed because there was no de-acceleration lane before the entrance to Heath Junior High. He stated that there would be de-acceleration lanes before the apartment entrances. Glenn McDonald moved that the Planning Commission recommend to the City Council approval of the amendment allowing for the Midland Federal building by removing from the plan one of the apartment buildings and relocating some of the parking spaces. Bob Britzman seconded. There being no further discussion, the motion passed unanimously. III. SPECIAL USE APPLICATION: OUR SAVIOR'S LUTHERAN CHURCH PRESCHOOL Location: 1300 - 21st Avenue Mr. Sasaki reviewed past action taken by the Planning Commission and the City Council on the request by Our Savior's to amend the present zoning ordinance to allow for preschools in R-1 zones by special use permits. Our Savior's Church is now applying for a special use application under the amendment. Mrs. Marcia Oreskovich was present and commented that Our Savior's Preschool was licensed by the State Department of Social Services and met building and fire standards of the City. They are licensed for 37 children at one time. Their present total enrollment is 52, with 26 children at one time. Transportation for the children is provided by parents. Mrs. Oreskovich commented that there is a need in the City for more preschools. They ' don't anticipate amending their license to allow for more children since they do not 'dant to take more rooms in the church. Neither do they anticipate going to an all-day session or going beyond kindergarten age. Mrs. Oreskovich presented a site plan and pointed out parking, play areas and rooms used by the preschool. The school has been in operation since September B, 1975. They currently have two sessions on Mondays, Wednesdays and Fridays from 9 to 11:30 a.m. and from 1 to 3:30 p.m. and one session on Tuesdays and Thursdays from 9 to 11:30 a.m. They operate nine months out of the year. ti f RECORD OF PROCEEDINGS Planning Commission Meeting 2 April 13, 1976 Mr. James Larson of 1810 - 20th Avenue presented a petition signed by people who live directly across from the church on 20th and 21st Avenues and 18th Street. The petition expressed opposition to the preschool. Mr. Larson stated that there had been a definite traffic increase. Mrs. Oreskovich stated that they used their parking lot for delivering children and, since children from different families sometimes rode together, there shouldn't be that much of an increase. Dean Cummins moved that the Planning Commission recommend approval of the special use application subject to further review if the preschool wished to expand beyond 37 students at any one time. Glenn McDonald seconded, and the motion passed unanimously. IV. VACATION OF PLATTED EASEMENT Location: Lots 8 and 9, Block 1 Greeley Industrial Park Subdivision (2035 - 2 Avenue) Mr. Sasaki presented a plat of the area and pointed out the existing easement. He presented letters from the utility companies which stated they had no opposition to vacation of the easement. Bob Britzman moved the Planning Commission recommend approval of vacation of the easement. Dean Cummins seconded. The motion passed unanimously. V. REFERRAL FROM WELD COUNTY: APPLICATION FOR RECORDED EXEMPTION, ELLIOTT PROPERTY Location: 71st Avenue and 20th Street Mr. Neal commented that Weld County Commissioners are currently considering a recorded exemption for this property. Ken McWilliams of Weld County Planning staff was present. The landowner of this property has requested and received three water taps to his property. The Comprehensive Plan outlines a contiguous growth ring policy. The Plan's specific recommendations are that only single-family development be allowed on parcels of ten acres or more and that agricultural uses be allowed. Our own development standards would require that, when single-family lots are platted, they not be platted to have access onto an arterial trafficway. This parcel would have access onto an arterial trafficway. Ken McWilliams reviewed Senate Bill 35 and recorded exemption procedures. He commented that presently there is an old residence on Lot A as well as a residence under construc- tion. Mr. Elliott was present and stated that the old residence would be torn down to obtain a water tap. He had requested and been denied another water tap on Lot A. Bob Britzman moved that the Planning Commission recommend approval to the County Com- missioners if an access could be provided between Lots A and B in the future so that when the City grows out to tnat area access would not be onto an arterial trafficway, and if the owner of the property agreed to use existing water taps and not request more ta•s. .• !4•. • seconded, and the motion passed unanimously. VI. REFERRAL FROM WELD COUNTY: SPECIAL USE PERMIT TRUCK WASH FACILITY Location: East 18th Street (1/2 mile east of Fern Avenue) Mr. Sasaki reviewe• - - --• • a. ' ' as a livestock truck wash. The water would be recycled. The property is zoned agricultural. Staff was concerned that the facility not become a truck stop or storage area. The proposed facility would be one-third of the eventual size if the facility is successful. If approved, we would request that any further expansion be referred to the Planning Commission again. Mr. Alleman, Director of Water and Sewer, had expressed concern in an Administrative Review Team meeting about the creation of methane gas due to decomposition, which would possibly create an explosion. Also, the water would have to be disposed of eventually. Since the facility would be near a river, there could be other environmental problems. Mr. Ewald expressed concern about truck traffic. STAFF REPORT Representatives from Rangeview Homeowners Association, Floyd Oliver and Bob Bischoff, were present to ask questions about annexation and future streets in the Rangeview area. Rangeview homeowners would like to annex but were concerned that a 60-foot right of way would be constructed through their pronerty if they did annex. Such a street would cut , through an area which they would like to preserve as a recreation area for residents of Rangeview. It would also cut through and landlock one resident's most desirable piece , of property. Rangeview homeowners did not want another outside entrance to the area because they do not want traffic to increase. Staff, Commission members and the homeowner representatives discussed possibilities of street arrangement. Staff was concerned about access for emergency vehicles to the area. Mr. 'Smead, City Engineer, recommended the homeowners meet with the Administrative Review Team to discuss the possibilities. • 4 Mr. Sasaki reported that the City Council has requested a review of solar energy problems which could possibly arise as related to building codes, etc. The only city in Colorado at present which has an ordinance pertaining to the use of solar energy is Colorado Springs. Staff is presently reviewing that ordinance. Mr. Kane of Inspections reported that at present Greeley has one house being built which provides for using solar energy. Mr. Sasaki reported that we have received a report from the Council of Governments requesting assistance from the Four Corners Regional Commission for funding for economic development studies on coal trains on the front range in the Fort Collins-Loveland system. Mr. Sasaki had requested that they keep us informed on their study since they could possibly move their route to pass through Greeley. Mr. Sasaki reported that the City Council has approved a sewer tap north of the Poudre River for Container Systems, Inc., which is east of Monfort's packing plant on 6th Avenue. The Council has referred consideration of going north by the river to the Planning Commission. Mr. Sasaki commented that there would be a hearing on the proposed zoning ordinance at 7:30 p.m., April 13, 1976, with the City Council. The meeting adjourned at 3:50 p.m. Secretary Chairman sk Planning Commission Meeting The Planning Commission of the City of Greeley was called to order by Chairman Clark Ewald on Tuesday, April 27, 1976, at 1 :30 p.m. in the City Council Chambers. Present were Glenn M Donald, Bob Britzman, Tom Charles, John Dietz, Clifford Clift and Clark Ewald. Absent was Dean Cummins. Also present was. Bill Neal of the Planning Department. I. APPROVAL OF MINUTES Bob Britzman moved the minutes be approved as mailed. Tom Charles seconded and the motion passed unanimously. `-', II. REFERRAL FROM WELD COUNTY: SPECIAL USE PERMIT FOR A TRUCK WASH FACILITY Location: East 18th Street (1/2 mile east of Fern Avenue) Mr. NeaT reviewed the proposed truck wash facility and past action by the Planning Commission in regard to the facility. He also noted that Mr. Connell , ' applicant for the special use permit, and Mr. McWilliams, Weld County Planning Department, were present to discuss the facility. It was noted the average volume of trucks to use the facility would be approximately five trucks daily and would involve approximately thirty minutes per truck in washing time. Mr. McWilliams stated they were relying on the Weld County Health Department to control potential problems involving environmental regulations. Mr. Connell reported that the facility would be located about four-tenths of a mile from the Poudre River and that waste water would be contained in four iron tanks and would not be allowed to seep into the ground. When the tanks reached full capacity, the contents would be put on surrounding farm lands. Planning Commission members also discussed traffic and ingress and egress to e facility. A problem could exist if there were quite a few trucks at the facility at one time. Mr. Connell stated that he did not intend to execute any contracts with firms to wash alot of trucks. The County trucks also use the road for access to a gravel pit in the vicinity. Mr. Connell explained how the facility would operate and stated that well water would be used for washing and would be recycled. Mr. Britzman wondered if a time limit might be set on the special use permit to ow for review at a later date. Mr. McWilliams stated that, although ere was no time limit by law on a special use permit issued by the County, development standards could be required. He also stated that, although it had not been done in the past to his knowledge, it might be possible to require a review of the facility after a certain length of time. Mr. Neal commented that the Comprehensive Plan provides that agricultural uses only be allowed in this area although residential use on parcels ten acres or larger could be permitted. He also mentioned the possibility of methane gas being created and felt this concern should be expressed to the Weld County Health Department. 2 Mr. Connell commented that he had thought of the potential methane gas problem and stated that the tanks would have to become extremely hot before they would explode. He also stated that he had contacted residents in the area and they had no objections to the facility. Clifford Clift moved the Planning Commission recommend approval to the County ' _Planning Commission subject to Weld County Health Department approval . r Tom Charles seconded. The motion passed unanimously. III. STAFF REPORT Mr. Doug Sears and Mr. Clyde Williams, representatives of the Greeley Board of Realtors, expressed the Board' s appreciation for the Planning Commission's attention to matters of concern to the Board in the proposed zoning ordinance when it was drafted. Mr.' Sears noted that there had been some new items incorporated into the proposed ordinance since he had last talked with the Planning Commission which he would like to ask some questions about. Mr. Neal commented that the introduction and first reading of the ordinance would be at a Council meeting in the near future. Mr. Sears stated that he realized he could propose amendments at that time but that he would like to obtain the Planning Commission's reaction to some of the items. Mr. Sears wanted clarification of Sectiory 23-303 - Restrictions on Lot Cover sset 9- 9-4:ef:cstx ]l. Mr. Sears wondered why sidewalks, tennis courts, swimming pools, signs and fences were included in the maximum 75 percent area which could be covered on a lot. He did not think sidewalks, etc. , would detract from the aesthetics of a property and felt they would add to the convenience of the residents. He suggested that the items sidewalks, signs and fences, tennis courts and swimming pools be deleted from this restriction. He felt that, as stated now, it would not be a problem in R-1 zones but in R-2 and R-3 zones. Mr. Kane of Inspections noted that these items were included mainly to prevent concreting of large areas in R-1 zones for parking of boats, recreational vehicles, etc. Mr. Sears stated that apartment builders should be encouraged to provide their own recreational facilities for their tenants and not rely on the City to provide tennis courts and swimming pools. He felt that this section would discourage that. cZ 2. Mr. Sears wondered why the area from a curb to f4 lot line could not be counted as part of the 25 percent required open space. Mr. Britzman commented that, since this was public property, it could be taken for futu a street. If it were counted as green space to meet the minimum requirement, it could not be replaced if a street were put in since a structure could not be torn down to replace the green space. 3. Mr. Sears expressed concern about restriction of the use of concrete or asphalt if these materials were needed for erosion control or drainage. Mr. Kane commented that the Zoning Board of Appeals could consider an application for variance to supply drainageways or erosion control for such problems which were not self-imposed. 3 4. Mr. Sears pointed out that at present there are no A zoning designa- tions for agricultural lands whose owners want to annex to the City. He hoped that staff would investigate the feasibility of providing an A zone classific, for the City. Mr. Britzman commented that the proposed ordinance would need to be implemented and would require some time for the City to see where amendments would be needed. It was also pointed out that the ordinance could not cover every situation and that the Zoning Board of Appeals would help in that respect. Tom Charles moved that the Planning Commission send Council members minutes of this meeting pointing out items brought up by Mr. Sears and Mr. Williams and include some staff comments on these particular items. Bob Britzman seconded, and the motion passed unanimously. Mr. Neal reported that representatives of the Rangeview Homeowners Association had met with the Administrative Review Team to discuss possible street configurations if the area were annexed. Staff thinks there are a number of alternatives for street arrangement in Rangeview; however, homeowners there are not interested in any additional access to the area. Staff is still concerned about emergency vehicle access. Mr. Neal presented drawings of possible street configuration alternatives and reported that these graphics will be given to the homeowners to see if an agreement can be reached. Mr. Neal commented that the Planning Department would like to schedule a field trip for Commission members to the Reservoir Road project after the next Planning Commission meeting. Mr. Neal asked for Planning Commission direction on how to proceed with work on the Capital Improvements Program. Although the Capital Improvements Program last year made projections for five years, since new priorities are set every year, the program will changer Mr. Ewald commented that he felt we should proceed as last year by departments and then present the Planning Commission's opinion to the City Council . Mr. Britzman felt departments should establish priorities on lists submitted to the Planning Commission. Public input is sought just before the budget is finalized . The possibility of obtaining public input sooner through the Planning Commission was mentioned. Mr. Clift commented that he would like to see the program presented according to a time schedule, also. a Mr. Ewald suggested that at the next Planning Commission meeting, Commission members present their suggestions as to how work on the Capital Improvements Program should proceed.
