SUBJECT: USR15-0047 JM Trucking
The Weld County Department of Planning Services-Engineering has reviewed this proposal. Staff
comments made during this phase of the application process may not be all-inclusive, as other issues may
arise during the remaining application process.
COMMENTS:
General Project Information/Location:
This project is proposing to use the site to park and maintain trucks that haul construction equipment.
This project is east of CR 31 and is south of CR 6. Parcel number 147127200005. Access is from CR 6 from
a flagpole access.
Roads:
County Road 6 is a gravel road and is designated on the Weld County Road Classification Plan as a local
road, which requires 60 feet of right-of-way at full buildout. The applicant shall delineate on the site plan
the future and existing right-of-way. If the existing right of way cannot be verified it shall be dedicated. All
setbacks shall be measured from the edge of future right-of-way. This road is maintained by Weld County.
Traffic:
Latest ADT on CR6 was taken on 12/19/13 which counted 216 vpd with 14% trucks.
The traffic narrative indicated approximately 10 round trips per day of semi-truck and tandem trucks and 12
total passenger vehicle round trips/day. The traffic is expected to be between the site and HWY85.
Access:
An Access Permit application was submitted with the application materials. Public Works will review the
application and provide an access permit and permit number if approved. Questions concerning access
requirements can be directed to Public Works access permit division.
An access easement currently exists providing access to the property to the south per RECX14-0065
reception #4048533 recorded 9/25/2014.
Turning radii of 60ft is required to safely accommodate semi-trucks turning into and out of the site.
TRACKING CONTROL:
Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are
listed below. Temporary Tracking Control shall be used during construction unless permanent tracking
control is installed ahead of construction activities.
Tracking control requirements for access onto gravel roads for 4 to 10 round truck trips/day (tandem or
semi-trucks) include recycled asphalt or road base on all driving surfaces. The project proposes to provide
road base on all driving surfaces.
Improvements and Road Maintenance Agreement:
No improvements agreement will be required as the anticipated traffic is less than 21 round truck trips/day
or 50 round passenger vehicle trips/day. A development standard will be applied to the recorded plan
indicating any impacts to the road must be mitigated by the owner. There shall be no tracking from the site
onto publically maintained roads. The applicant is responsible for mitigation of any damage or offsite
tracking and upgrading and/or maintaining onsite tracking control.
Drainage Requirements:
A water quality feature is planned for this site. Suzette Schaff, PE35692 prepared the calculations and
stamped and signed a drainage narrative indicating the design and location would not have any negative
downstream impacts.
Grading Permit
A grading permit was submitted concurrently with the land use application. The applicant has completed
the bulk of the over-lot grading. The grading permit is being held until the land use hearing is complete. If
the project is approved the grading permit will be reviewed and a permit provided to complete the work.
Geologic Hazard Area:
This area IS NOT in a Geologic Hazard Area.
Floodplain:
This area IS NOT in a FEMA regulatory floodplain.
CONDITIONS OF APPROVAL:
A. An Improvements and Road Maintenance Agreement is required for offsite improvements at this
location. Road maintenance including dust control, damage repair, specified haul routes and future
traffic triggers for improvements will be included. (Department of Public Works)
B. The plan shall be amended to delineate the following:
1. County Road 6 is a gravel road and is designated on the Weld County Road Classification Plan as

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant
to Chapter 15, Articles I and II, of the Weld County Code. (Department of Planning Services-Engineer)
2. The site shall be maintained to mitigate any impacts to the public road including damages and/or
offsite tracking. (Planning and Engineering)
3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized.

4. The historical flow patterns and runoff amounts will be maintained on the site. (Department of Planning

5. Weld County is not responsible for the maintenance of onsite drainage related features. (Department

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Use by Special Review Permit for any use permitted as a use by
right, an accessory use, or a use by special review in the commercial or industrial zone
districts (heavy equipment - trucking and truck repair shop along with outside
equipment/vehicle storage and staging), provided that the property is not a lot in an
approved or recorded subdivision plat or lots parts of a map or plan filed prior to
adoption of any regulations controlling subdivisions in the A (Agricultural) zone district.
The application indicates there are 10 employees. There are 2 full time employees who
will remain on site for maintenance duties and 8 drivers. The application indicates a
portable toilet and bottled water provides water and sewer.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final
disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions. The applicant shall operate in accordance with
Chapter 14, Article 1 of the Weld County Code.
4. Fugitive dust should attempt to be confined on the property. Uses on the
property should comply with the Colorado Air Quality Commission's air quality
regulations.
5. This facility shall adhere to the maximum permissible noise levels allowed in
the Non-Specified Zone as delineated in Section 14-9-30 of the Weld County
Code.
6. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. For employees or
contractors on site for less than 2 consecutive hours a day, and 2 or less full
time employees on site, portable toilets and bottled water are acceptable.
Records of maintenance and proper disposal for portable toilets shall be
retained on a quarterly basis and available for review by the Weld County
Department of Public Health and Environment. Portable toilets shall be
serviced by a cleaner licensed in Weld County and shall contain hand
sanitizers.
7. Process wastewater (such as floor drain wastes) shall be captured in a
watertight vault and hauled off for proper disposal. Records of installation,
maintenance, and proper disposal shall be retained.
8. Any vehicle or equipment washing areas shall capture all effluent and prevent
discharges in accordance with the Rules and Regulations of the Water Quality
Control Commission, and the Environmental Protection Agency.
9. All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling. All chemicals must be stored secure, on an
impervious surface, and in accordance with manufacturer's recommendations.
10.The facility shall comply with all provisions of the State Underground and Above
Ground Storage Tank Regulations.
11.The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

Subject: USR15-0047 Referral
Upon review of my case files and computer, an active Zoning Violation (ZCV15-00082)was noted. This
violation was initiated due to the operation of a commercial trucking operation without first completing the
necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court
Magistrate through the Violation Hearing process. Since this application was submitted prior to an actual
court date being scheduled, NO investigation fee is required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staff's policy to no longer accept staff initiated complaints.
This violation was initiated on May 22, 2015. I have heard from 2 (two) separate complainants.
If this application if approved by the Board of County Commissioners and once a plat is recorded will
correct this outstanding violation. If this application is denied,all but 1 (one)Commercial Vehicle shall be
removed from the property 30 (thirty)days of denial or the violation will proceed in court accordingly.

documents submitted ssith the application packet for Case lit iSR15-0047. and herehc submit the
following comments relative thereto:
I . 1 his property is NOT in the Fort Lupton Fire Protection District, as indicated by the
applicant. The property is wholly ycithin the jurisdiction of the Greater Brighton Fire
Protection District. All applications tier building permits shall be reviewed/approved H this
olficc.
2. Fire department access roads shall: have a minimum unobstructed (e.g. by parked vehicles)
width of 20 feet: unobstructed vertical clearance of 13 feet 6 inches: and he constructed of an
all '+rather .surface capable of supporting the implied loads of District apparatus. The
minimum requirement for tire access road construction is 6 inches of compacted Class 6
road-base, equivalent or better. and graded smooth to provide a minimum travel speed of 35
miles per hour.
3. Dead-end tire department access roads exceeding 150 feet in length shall be provided vyith an
approved means tor the turning around of District apparatus.
4. Plans for the lire department access road (driveway) shall he submitted to and approved H
the District prior to issuance of any building permits.
5. Addressing shall he provided at two locations: at the entrance to the driveway on ('R 6. and
at the entrance to the site. Numerals shall he a minimum of4 inches in height with a '%, inch
stroke width. and mounted on a contrasting background. Addressing at the drivesv as entrance
on CR 6 shall he readily discernable from both directions of approach.

Dear Mr. Ogle:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11,
2011 memorandums to county planning directors, this office will only perform a cursory
review of the referral information and provide informal comments. The comments do not
address the adequacy of the water supply plan for this project or the ability of the water
supply plan to satisfy any County regulations or requirements. In addition, the comments
provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
The application is for a Site Specific Development Plan and Special Review Permit for Heavy
Equipment Trucking and Repair Shop along with outside equipment vehicle storage and staging
in the Agricultural Zone District. The Applicant indicated that currently there are 10 total
employees at the site and they may employ 4 additional employees in the future. The proposed
source of water for the commercial business on property will be from a new commercial well.
Any well permit application for the proposed well would be evaluated at the time it is received
in this office.
