I am in receipt of your letter of March 18, 2015. I do not have questions but rather comments regarding your
investigation but first some history. When first contacted about selling my mineral rights, I was told that the drilling
installation was to be at the top of the hill which meant that while I would be able to see the installation, it would be far
enough away so as not to be an eyesore. As you are well aware, this has not been the case. Encana has turned my once
pastoral neighborhood into an industrial site.
Encana began working on the present site, which you apparently are calling "the Bohrer pad," in January 2014.
Although Encana had initially attempted to negotiate the use of our private road, in the end no agreement was reached
and they determined that the only access would be by the back road into the site. However, on numerous occasions
white pickup trucks drove up our road. I watched the trucks and followed them to where they came to a stop at the
drilling site. After observing the trespassing on several occasions, I called Encana to complain. I received a call back
stating that a representative had spoken to everyone at the site and no one had used our road. The call back occurred
while I was looking at the most recent violator parked at the drilling site.
Several weeks later, I looked out my window to see a very wide tiller coming down my road. I had just stepped out of
the shower and so ran back into my bedroom to dress as I was sure it could not possibly get through the gate without
causing damage. By the time I ran outside, the piece of equipment was through the mechanical gate and at the end of
the road. Upon inspection of the gate, I discovered that a piece of wood had been knocked off. As the gate is old and
mechanical, I was unsure what other possible damage might have been done to the gate as it had obviously been hit
hard enough to break off the board. When the driver of the tiller came up the road next to my road, I stopped him and
asked about the board that had been knocked off the gate. His response was that he did not think it had really damaged
anything other than the board but was unsure. He admitted that he had not made any attempt to notify me or any of
the other property owners that he had damaged the gate. I complained to his supervisor that in addition to damaging
the gate,the equipment was trespassing on the road. He stated that although they had been hired by Encana,they had
not been told that they were not to use the road.
If you check your records, you will ascertain that I made no complaints to Colorado Oil & Gas Conservation Commission
or to Encana (other than the two times I contacted Encana as addressed above) during the initial twelve months of work
at the site despite noise, dust, diesel fumes, night lighting, and vibrations. During 2014, I experienced numerous health
concerns that I attribute to the drilling and fracking process and that negatively impacted my life. By February 2015, I
had developed clinical insomnia due to the drilling and fracking operation. I called Encana and said, "Enough already!
You have been disturbing this neighborhood for thirteen plus months. Surely this is enough!" I was told that I should
have complained earlier. Therefore, I decided to call Colorado Oil and Gas Conservation Commission regarding my
concerns about noise and dust. You sent out a representative who told Encana that they had to control the dust. I was
told that the wind was too strong to obtain an accurate reading of the noise level but Encana had agreed to an
"independent" sound survey. There are two interesting things about the eventual sound survey: 1. I was later told by
an Encana employee that he had placed the equipment on my property which surely raises the question as to how
"independent" the survey was; and 2. Although the neighborhood had been racked with noise preceding the survey,
during the time the equipment was on my property, I heard no excessive noise. A cynical person might think that
Encana readily agreed to the survey because they knew they would not be performing work that would have caused
excessive noise during the time the equipment was in place.
I do not have the exact dates of the lighting fiasco but I do know that I called Colorado Oil & Gas Conservation
Commission after several night wherein my neighborhood was lit up to the point that it looked like it was daylight. More
specifically, the north facing wall of my home, enclosed by a high patio wall, had a spotlight directed on it that left a sun
like spot that was many feet in diameter. I am not a lighting expert but I do not believe that there is any way that "all
lighting was directed towards the ground and inwards." That is blatantly absurd. And let us be clear here, at no time did
Colorado Oil &Gas Conservation Commission make any attempt to truly ascertain whether a violation had occurred...
Your practice is to notify Encana when a complaint has been received and they are then allowed to change their
practices before they can be cited. This does not in any way suggest that violations had not occurred. In addition,
Encana puts outs public relations information suggesting that they attempt to work with neighbors. If that is so, why did
I have to complain before they turned their lights away from the residential area to the area north where no homes are
located?
Recently, Encana telephoned residents of the area to inform them that they would be conducting work 24/7 for five
days and residents could expect noise and night lighting during that time. I called Colorado Oil & Gas Conservation
Commission to inform you that Encana had no sound barrier equipment in place. Your representative contacted me to
tell me that he had informed Encana that they could not proceed without sound barrier equipment and that the lights
had to be directed away from the residential area. Apparently, if I had not called Colorado Oil &Gas Conservation
Commission, Encana would have conducted the work without sound barrier equipment which is clearly in violation of
your rules. One is left to wonder why it is left up to a citizen to monitor the drilling practices to see that the regulations
are followed.
This neighborhood has protected wet lands as part of the area. While walking down Sandra Jean Way, I noticed that
fluid of some sort was running down the length of the road and into the wet lands. When I followed the fluid, I found
that it was coming from an area covered with a heavy tarp that was fixed in place. Coming out from under the tarp was
a giant hose that ran across the fracking operation to what looked like a giant outdoor swimming pool. I am not an
expert in the fracking process and had no idea if whatever was in the hose was going to the pool or was going
underground and causing the flooding down the road or what the fluid was. Therefore, since the fluid was running into
the wet lands, I thought it was important to have someone check out what was happening. I was later informed that
there was a hydrant under the tarp and it was leaking fresh water. I was also informed that this was NOT Encana's
problem but rather the water company's problem. Again, do you realize how absurd this is? The hydrant was not
leaking before Encana attached its hose to the hydrant and, regardless of who was ultimately to blame, water was being
wasted. No one was obviously checking the connection.
The blame issue is an interesting one. I was told that your representative has a camera that can see pollution. He
informed me that his camera showed no pollution at the drilling site but did show a large amount of diesel fumes.
When I asked if this was not pollution, I was informed that no it is not pollution and EPA was the agency that dealt with
diesel fumes. Once again, surely you realize that this is absurd.
Several weeks ago, on a Thursday, I decided to take pictures of the drilling operation. While taking the pictures, an
employee of Encana came out and told me that he knew who I was as I was the one who had made complaints. He said
that he wanted me to know that they would finish with the operation that night or early the next day and all but the
permanent installation would be removed the next day. I came home on Friday to find everything was still in place.
Nothing was removed over the weekend and on Monday, I came home to find the drill was back in place. Your
representative was in my driveway and informed me that Encana would be doing a 24/7 operation for the next five days.
This time residents did not receive a telephone call announcing the work. He said that he might be able to get them to
work only in the daytime but, if so, it would extend the operation for up to ten days. I offered no objection as I just
wanted the work done. However, interestingly, no work that I could see was performed during daylight hours but only
at night. During the last ten days, I have not been aware of excess noise, however, at least twice, I been awakened by
vibrations.
There have been so many misrepresentations and outright falsehoods concerning the drilling operation at the Bohrer
pad that I am not surprised that you have closed my complaints without issuing any notice of alleged violation related to
my complaints. I wonder how many other people, who have complained, have run into the same practice of having the
oil company notified that someone has complained and of allowing them to change their practice, at least temporarily,
before any notice of violation is issued. This certainly would skew the information provided to the public regarding
violations at drilling sites and raises ethical issues regarding the practice.

This Warning Letter is to inform you that the oil and gas location or the oil and gas
operations listed above may be in violation of the rules and regulations of the Colorado
Oil and Conservation Commission ("COGCC") and correction action is required.
Alleged Violation:
Operator was performing operations on the Bohrer 19H-0368 location on February 25,
2015 when a COGCC inspector, responding to a complaint, noticed that all lighting was
directed towards the ground and inwards per COGCC Rule 803. However, the COGCC
identified an opportunity for Encana to move some of the lights from the northwest
corner of the location, near the complainant's residence, to the south part of the
location. Moving these lights would not impact worker safety and it would further
reduce lighting issues and nuisances impacting the complainant.
Encana personnel on the location agreed to move the lights and did so immediately.
COGCC inspectors verified the move.

How to Comply with this Warning Letter:
Operator has already complied with the specific request to move lighting from the
northwest corner of the location to the south part of the location. However, the
COGCC requests Encana to better assess placement of lighting on future locations to
minimize the impact to nearby residents to the fullest extent practical.

The Colorado Oil and Gas Conservation Commission (COGCC) received several complaints
from you regarding noise, lighting, and water being dumped at Encana's Bohrer pad. Your
complaints are documented in COGCC document numbers 200426023, 200426407, and
200426408, which can be found on the "Complaints" page, off of our main website
http://coacc.state.co_us/.
The COGCC investigated these complaints and documented the results in COGCC document
numbers 673801824, 673801884, and 200426408, which can be found on the "Complaints"
page, off of our main website http://cogcc.state.co.us/. I have included these inspection
reports with this letter.
The following actions were taken by COGCC staff:
• Discussed these issues with you in more detail.
• Inspected the location on February 25, 2015 (see document number 673801824). As
part of this inspection:
The COGCC attempted to conduct a sound survey but the wind speeds were too
high and temperatures were too low for an accurate reading.
The COGCC asked Encana to move lights from the northwest corner of the
location to the south side of the location to further address your lighting
concerns.
• Inspected the location on March 9, 2015 (see document number 673801884). As part
of this inspection, a sound survey was conducted.
• Discussed these issues with Encana, the operator of the Bohrer pad, and confirmed
the operation that began March 8, 2015 was a workover rig that would be onsite for
five days. We also confirmed that no night time operations would be conducted
during these five days and a sound wall would be installed.

• On March 17, 2015 determined that an additional four days of activities, including
night time operations, would be required for final drill out and flowback. The COGCC
set expectations related to these four days.
• On March 10, 2015, discussed the water dumping concern with both AEtW Water
Services and the Long Peak Water District (see document number 200426408) and
identified the source of the water as a leaking fire hydrant and confirmed the water
was fresh water.
The COGCC did not identify any issues related to noise or illegal dumping of water at the
Bohrer pad during our inspections. Therefore, the COGCC has determined that no violations
occurred related to these items.
During the February 25, 2015 inspection identified above, the COGCC did notice all lighting
was directed towards the ground and inwards per COGCC Rule 803. However, the COGCC
identified an opportunity for Encana to move some lights from the northwest corner of the
pad to the south part of the pad to further address your lighting concerns, which they did
immediately. The COGCC does not believe this is a violation of Rule 803 as written but has
decided to issue Encana a formal warning letter related to lighting.
Based on the above, the COGCC has closed these complaints and will not issue a notice of
alleged violation (NOAV) related to these complaints.

On 2-27-2015, I went back to the Bohrer location to attempt to perform a sound study at the location,Encana had
completed the repair with the rig on location. I observed that Encana adjusted the lights on location by moving the
lights from the NW end of the location to the south end of the location. The adjustable lighting on location was pointed
toward the ground and toward the floor of the rig. Due to the 20 degree temperature I was unable to perform a sound
study on location. I again attempted to contact the complainant at her residence and by phone.See attached photos.

On 3/15/2015, I was contacted by email by Dave Kulmann in reference to a noise complaint he received from Sarah
Sharp of 161 Hensen Drive in Longmont I responded to the complaint and went to the complainant's residence
where I took a sound study approx 25'from the North side of the complainant's home. During the 1 hour long sound
study the winds were calm.See inspections Doc#673801884 for results of sound study and Inspection results.
spoke with Burch from Encana he indicated his crew was only running daylight hour as a form of sound mitigation he
also indicated they had installed the 12 sound walls on the location and he would set up a independent noise study to
check on the compliance of the noise from the frac operation.

the complainant in reference to water being pumped onto the ground at the Bohrer location,according to the
complainant she thought frac water was being pumped out of the large volume tank on location to the Sandra
Jeans Way road. When I went to the location on 3-11-2015 1 met with Keith Sparkx of A&W Water services
and Long Peak water District employees who identified the leaking water at the fire hydrant was on the
Longs Peak Water District side and the water on the ground was fresh water caused by a leaking weep hole
on the fire hydrant.
