RESOLUTION RE: APPROVE PARTIAL VACATION OF MINOR AMENDMENT TO USE BY SPECIAL REVIEW PERMIT, MUSR15-0002 - ANDERSON SOUTH FARM, LLC, C/O JAMES ANDERSON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution #2011-2350, dated August 31, 2011, the Board did approve the request of Anderson South Farm, LLC, 6876 County Road 5, Erie, Colorado 80516, for a Minor Amendment to the Site Specific Development Plan and Amended Use by Special Review Permit #1232 for a Recreational Facility with uses similar to those seen at guest farms and fairgrounds to allow ten (10) fire pits with hay bale seating around each pit, two pedal cart tracks, a train station for the barrel train, and a pumpkin made out of fiberglass, or another suitable building material, on top of an existing silo, in the A (Agricultural) Zone District, on the following described real estate, being more particularly described as follows: Lot A of Recorded Exemption #281; located in Section 32, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board has received a request from AGPROfessionals, LLC, on behalf of the property owner, Anderson South Farm, LLC, to partially vacate Minor Amendment to Use by Special Review Permit, MUSR-0002, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said partial vacation, conditional upon the following: 1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant shall submit a revised plat, titled "Partial Vacation of Minor Amendment to Use by Special Review Permit, MUSR-0002", conforming to Section 23-2-260.D of the Weld County Code. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Minor Amendment to Use by Special Review Permit, MUSR-0002, be, and hereby is, partially vacated, with the abovementioned condition, with said plat to be titled and recorded as Partial Vacation of Minor Amendment to Use by Special Review Permit, MUSR-0002. Anderson South Farm LLC is requesting a partial vacation of MUSR-0002 for proposed Lot B of RECX15-0059. RECX15-0059 was conditionally approved by the Weld County Planning Department on July 23, 2015. If the partial vacation is approved, the applicant is required to submit a revised USR map per Section 23-2-280 of the Weld County Code. The Department of Planning Services is recommending approval of this partial vacation.
