A public hearing was conducted on August 5, 2015, at 10:00 a.m., with the following present:
Commissioner Barbara Kirkmeyer, Chair
Commissioner Mike Freeman, Pro-Tem
Commissioner Sean P. Conway
Commissioner Julie A. Cozad
Commissioner Steve Moreno
Also present:

The following business was transacted:
El I hereby certify that pursuant to a notice dated June 19, 2015, and duly published
June 24, 2015, in the Greeley Tribune, a public hearing was conducted to consider the request
of Kenneth and Sandra Brooker, do Criswell Trucking, LLC, for a Site Specific Development
Plan and Use by Special Review Permit, USR15-0018, for Mineral Resource Development
Facilities, Oil and Gas Support and Service (truck parking and storage of oil and gas
construction and maintenance equipment) in the A (Agricultural) Zone District. Bruce Barker,
County Attorney, made this a matter of record.
Diana Aungst, Department of Planning Services, stated a letter was received from the
applicant, dated July 8, 2015, requesting to withdraw the application due to the unfavorable
recommendation of the Planning Commission, the expense of the Improvements Agreement,
and the access point required by the Town of Firestone. In response to Chair Kirkmeyer,
Ms. Aungst clarified the road repairs that were being requested by the Town of Firestone. In
response to Commissioner Cozad, she stated the case is in violation and that Bethany Pascoe,
Zoning Officer, is assisting them toward compliance. Lastly, in response to Commissioner
Conway, she explained the applicant does realize there are consequences to being in violation
and they are working toward compliance by removing the trucks.
No public testimony was offered concerning this matter.
Commissioner Conway moved to accept the request of Kenneth and Sandra Brooker, do
Criswell Trucking, LLC, for a Site Specific Development Plan and Use by Special Review
Permit, USR15-0018, to withdraw the application for Mineral Resource Development Facilities,

Oil and Gas Support and Service (truck parking and storage of oil and gas construction and
maintenance equipment) in the A (Agricultural) Zone District. The motion was seconded by
Commissioner Moreno, and it carried unanimously. There being no further discussion, the
hearing was completed at 10:08 a.m.
This Certification was approved on the 10th day of August, 2015.
