WHEREAS, a public hearing was held on September 20, 1976 in the Chambers of the Board of County Commissioners , Weld County, Colorado, for the purpose of hearing the petition of Rick Hertzke, 4929 West 4th Street, Greeley, Colorado, re- questing a Special Use Permit for a dairy farm on a parcel of land in the Southeast Quarter of Section 2, Township 5 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows : Commencing at the South Quarter Corner of said Section 2 and considering the South Line of said Southeast Quarter to bear South89°29 ' 11" East, with all bearings contained herein being relative thereto; Thence along the South Line of said South east Quarter of said Section 2, a distance of 268 .70 feet to a point on said South Line of said Section 2 ; Thence North 00°51 ' 49" East, 40 . 00 feet to a point on the North Right-of-Way Line of Colorado State Highway Number 257 Spur, Quitclaim Deed recorded in Book 995, Page 458, Reception Number 741532 of the records of Weld County, Colorado, said point also being the True Point of Beginning; Thence North 00°51 ' 49" East, 782. 89 feet to a point on centerline of a United States Bureau of Reclamation Power Line Easement as recorded in Book 1263 on Page 2, being Reception Number 1076164 of the records of Weld County, Colorado; Thence along said Easement centerline a bearing of North 71°40 ' 38" East, 2587 . 73 feet to a point on said Easement centerline; Thence South 03°36 ' 23" West, 1620. 72 feet along said East Line of said Southeast Quarter (SE4) to a point on said North Right-of-Way Line of said Colorado State Number 257 Spur; Thence North 89°29 ' 11" West, 2366. 48 feet along said North Right-of-Way Line to the True Point of Beginning. Said parcel of land contains 65. 923 acres. WHEREAS, petitioner was present, and WHEREAS, the above described parcel of land is located in and Agricultural Zone as set forth in the Weld County Zoning Resolution, and WHEREAS, Section 3 . 3 .E. 4.d of the Weld County Zoning Resolution authorizes such a use in the Agricultural District on the grant of a Special Use Permit by the Board of County Commissioners, and PL0620 760131 WHEREAS, the Board of County Commissioners has considered all the testimony and the statements of those present, has studied the request of the petitioner and has studied the recommendation of the Weld County Planning Commission, and having been fully informed and satisfied that the requested use complies with the Weld County Comprehensive Plan and the provisions of the Weld County Zoning Resolution, NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners that the application of Rick Hertzke for a Special Use Permit for a dairy farm on the above described parcel of land, be, and hereby is, granted subject to the development standards contained in the Special Use Permit. (e) The proposed operation in a dairy and farming oreratiion that will at the start employ /I full time employees and possibly 1 part time employee in thr summer. Effects of operation on the following: Air pollution - None Water pollution - None - Pun-off will go into our own lake and be pumped back onto the land. This is the best possible use of this run-off. Odor - The manure separating enuipment will prevent any build or manure in the main manure producing areas. These are the milk parlor, the holding pen , the feeding areas and the free stall areas. Manure will be flushed from these area-s 'at least once a day into a pit and then processed into a dry solid - material with the linuid portion going into our lake. These areas will account for 85-90% of the manure. This system will keen any odor to a minimum. Noise - None Glare - Lone Mire or other safety hazards- None Traffic - Our oneratian will have very little effect on traffic. (f) Sewage Disposal. - Septic field for houses. Highways has reviewed the proposed Datry Operation, located in the S.C. % of Section 3, -t. 5 N., R. 61 W. along S.H. 257 Spur. The Division-has the following comments. Driveways The Division would request -that the proposed driveway be moved approximately 200 feet to the east. This would increase the sight distance for vehicles turning off of and 'onto the highway. It should be noted that a driveway permit will be required. This is available through Mr. Dave Fraser, District Maintenance Superintendent, whose -office is located at 1420 Second Street, Craeley. He may also be =reached by mail addressed to P. 0. _Box 850, Greeley, Colorado 80631. Future Right 'of Way In reviewing the future traffic demands on thin section of S.R. 257, 150 feet of -right of way is anticipated (75 feet each side of the centerline). The Division would ask that Weld County Planning Canmission give due -consideration to having this additional right of-way preserved by reservation, setback, or dedication (preferably the latter). Environmental It is important to take into consideration what impact the traffic on the highway will have on -noise and air pollution levels at the site of the proposed development. Developers -shall bear the -responsibility for providing those abatement measures that may -be required to meet the minimum onvlronnental standards. As this highway has not been built -or reconstructed since 1970, no air quality or noise impact analysis has been made. As a general rule Soraaeeting noise standards, residential improvements should ;generally be set back a minimum of 170 to 220 Tent from the centerline, and business improvemente should be set hack a minimum of 120 to 170 lest from the -centerline, unless some 'other type of noise abatement measures (walls, earth berms, noise«insulated walls and (ii. The dairy operation on the hereon described parcel shall be limited to the facilities shown which are designed to handle approximately 300 head of producing Lows and 300 mead of repl-acement stock. The east 1321 feet of the hereon described parcel which is currently dry farm land shall be converted to irrigated pasture for the immediate future. This same ground is the area proposed for future expansion of the dairy. Approval of another Special Use Permit shall be required before said future expansion shall be allowed. 2. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 3. There shall be no discharge of wastes into any streams, other bodies of water, or adjacent drainage systems. 5. landscaping shall be in compliance with the recommendations of the Soil Conservation Service. 6. Access shall be limited to the one point shown hereon. A driveway per— mit from the State Highway Department shall be obtained for said access. 7. Construction shall begin within one year of approval by the Board of County _Commissioners. 8. All sewage disposal facilities installed on the site shall conform with all applicable Weld County and state Health Regulations. 9. Two residences shall be allowed as shown. Additional housing for farm labor employees shall be allowed provided the need can be shown for said housing . House #2, as designated hereon, shall be the site for an -appli- cation for a recorded exemption in the future. 10. Seventy-five feet of right-of—way from the centerline of State Highway 257 shall be preserved by setback. 11 . Residential improvements shall be set back a minimum -of 125 feet from the centerline of State Highway 257. 12. Grading shall be done in such a manner so as to prevent drainage from flooding onto the access road to the Missile Park. 13. The Special _Use Permit shall be limited to the plans submitted and governed by the development standards stated above. Any changes to the plans and/or the development standards shall require approval of another Special Use Permit before such changes shall be -allowed.
