RESOLUTION
RE: REQUEST BY JOHN GABLE FOR REPLACEMENT OF CULVERT UNDER COUNTY
ROAD NO. 29.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado has received a request from John Gable for the replace-
ment of a culvert running under County Road No. 29 just off
Kelly Lane by County Road No. 2 , and
WHEREAS, it has been reported by the Weld County Engineer
that the culvert had been removed due to the fact that it had
apparently been abandoned, was rusted out, full of dirt and of
no value, and due to the traffic problem created, it was removed,
and
WHEREAS, the Weld County Engineer has recommended that when
the owners of the ditch construct the necessary structures to make
this system workable, and leave such structures with a 15" stub
C.M.P. , that the County of Weld should replace the old tube be-
tween the two structures, but only on Kelly Lane in Bil-Lar
Subdivision.
NOW, THEREFORE , BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the request for re-
placement of the culvert by Mr. John Gable, be and hereby is
denied until such time that the owners of the ditch construct
the necessary structures to make this system workable, and leave
such structures with a 15" stub C.M.P. , and then the County of
Weld will replace the old tube between the two structures, but
only on Kelly Lane in Bil-Lar Subdivision.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 29th day of
June, A.D. , 1977.

John Gable letter

The John Gable letter has been referred to this office
for a recommendation.
The County Engineer and I made an on site inspection of
this request . The old culvert was removed due to the
fact it had apparently been abandoned, was rusted out ,
full of dirt and of no value. Due to the traffic problem
created it was removed.
Investigation indicates this ditch had been used some time
ago , but someone had removed the necessary structures , one
being on private land, as evidenced by concrete piled on
west side of road. County records indicate that section
line known as County Road 29 is not a county road, only
that portion east of section line leading to Kelly Lane is
maintained by the County.
This office would recommend that when owners of the ditch
construct the necessary structures to make this system
workable, and leave such structures with a 15" stub C.M.P. ,
the County will replace the old tube between the two structures
only on Kelly Lane in Bel-Lar Subdivision .
