HomeMy WebLinkAbout20150962.tiff HEARING CERTIFICATION DOCKET NO. 2015-41 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT FINAL PLAN MINOR AMENDMENT, PUDF15-0001 (FORMERLY KNOWN AS PF-1129) TO REMOVE THE BUILDING ENVELOPE ON LOT 2, BLOCK 1 OF THE HOME RANCH PUD - ROBERT AND KAREN NOLAN A public hearing was conducted on April 15, 2015, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway - EXCUSED Commissioner Julie A. Cozad Commissioner Steve Moreno Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Brad Yatabe Planning Department representative, Kim Ogle Public Works representative, Wayne Howard Health Department representative, Lauren Light The following business was transacted: C I hereby certify that pursuant to a notice dated March 27, 2015, and duly published March 30, 2015, in the Greeley Tribune, a public hearing was conducted to consider the request of Robert and Karen Nolan, for a Site Specific Development Plan and Planned Unit Development Final Plan Minor Amendment, PUDF15-0001 (formerly known as PF-1129) to remove the building envelope on Lot 2, Block 1 of the Home Ranch PUD. Brad Yatabe, Assistant County Attorney, made this a matter of record. Chair Kirkmeyer advised Robert Nolan, applicant, since Commissioner Conway was not able to be present, he had the option of continuing this matter to a date with the full Board present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Conway will listen to the record and make the determining vote. Mr. Nolan indicated he would like to proceed. El Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and stated the applicant is within the three (3) mile referral area of the Towns of Severance and Windsor and referrals were received from both municipalities indicating no conflicts. Mr. Ogle clarified the Change of Zone (COZ) for The Homestead Planned Unit Development (PUD), later known as The Home Ranch, was approved by the Board of County Commissioners on September 3, 2007, and in the application materials the building envelopes were not required by planning staff or the Utility Board; however, the final plat was recorded with building envelopes dilineated and, upon purchase of the property, the Nolan's realized the building envelope on Lot 2 was causing an issue with further development. They are requesting the removal of the building envelope to assist them in moving forward with development of the site. In response to Chair Kirkmeyer and Commissioner Cozad, Mr. Ogle stated because the final plat was approved by the Board, it must come before the Board to remove anything from the final plat, per the director of Planning Services regarding procedure. Wayne Howard, Department of Planning Services Engineer, provided a brief overview of the transportation plans and requirements. Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions. G No public testimony was offered concerning this matter. G In response to Commissioner Cozad, Mr. Ogle clarified staff did not add any notes to the plat, just updated the language. la In response to Chair Kirkmeyer, Robert Nolan indicated he has reviewed, and agrees to abide by, the Conditions of Approval, as presented. G Commissioner Cozad moved to approve the request of Robert and Karen Nolan for a Site Specific Development Plan and Planned Unit Development Final Plan Minor Amendment, PUDF15-0001 (formerly known as PF-1129) to remove the building envelope on Lot 2, Block 1 of the Home Ranch PUD, based on the recommendations of Planning staff, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Freeman, and it carried unanimously. There being no further discussion, the hearing was completed at 11:00 a.m. This Certification was approved on the 20th day of April, 2015.
