Are you comments referring to potential impacts on these properties or are these comments referring to potential impacts to the Cactus Hill Ditch? 1 I have checked our records and could not find specifically identify on our maps that the Cactus Hill Ditch is located on the proposed solar farm site. Some irrigation easements are shown on the property (per the attached RE-3992 plat) but are not specifically called out/identified as belonging to Cactus Hill Ditch. If Cactus Hill Ditch is located on this property — could you please point out the location on the attached maps. It looks like the have reconfigured their plans a bit. The one concern that I have is the drainage ditches that removes runoff and waste water from our parcel across their parcel . Because of the fencing that they are going to have on the property they indicated that they would be responsible for the maintenance of those two areas, since they will make it difficult for cleaning these drainage ditches. The following conditions should beplaced on the t e plat: 1 . The drainage ditches have a 40 foot easement from the center of the drainage ditch . This should be sufficient for cleaning purposes. 2 . The duty for maintaining the easement should run with the property; however in the event that it is not maintained the property owners above the easement should be allowed to maintain it and charge the property owner for the maintenance. 3 . That they will abandon their current easements for the shared road and irrigation ditches on the west side of their property line since they no longer intend to irrigate the property. It looks like they intend to remove the ditches and holding ponds. These are the only conditions I would advise . Also, when I looked at the documents you have Larimer and Weld as the ditch company, it should be Water Supply and Storage Company. If I were the ditch company I would request that as 40 foot road be established on the upper side of the ditch with proper drainage into the ditch . Those drainage areas should be armored in order to protect the upper side of the ditch .
