Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: This project plans to utilize the site to park 15 trucks used for the oil and gas industry. Employees pick up the trucks in the morning and return them in the evening. This project is west of and adjacent to 35"' avenue and south of 49"' street near Evans. Parcel number 095935000024. Access is from 49th st. Roads: 49th street is owned and maintained by the City of Evans. No Traffic Counts are available for this road. Traffic: The traffic information provided with the submittal indicates there are 15 company trucks that park on the site. 10 employees come to the site in the morning and pick up company trucks and drive to the oil and gas sites. At the end of the day the employees return the company trucks and drive home in their passenger vehicles. Access: Access is from 49th Street which is Evans owned and maintained. Tracking control is required to prevent tracking from the site onto the County Roadway. O Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. O Standard tracking control for accesses onto gravel roads includes double cattle guards at the access point. O Standard tracking control for accesses onto paved roads includes either 300 feet of pavement onsite OR 100 feet of pavement plus double cattle guards. O Alternatives such as recycled AC, gravel/road base, may be considered with lighter traffic impact projects. General Site Plan Requirements: i.e (1A, RMA, City Town Agreement, etc...,offsite auxiliary lanes) -Geohazard Area: This site is NOT in a Geologic Hazard Area. -Floodplain: The project site is NOT within a known floodplain. Drainage Study: A drainage narrative and water quality feature calculations were prepared by Kurt Rollin, PE#24802. The calculations appear to be adequate for sizing the water quality feature. The site plan appears to sheet flow to the south of the parcel and stormwater runoff does not appear to be routed to the water quality feature. Please include proposed grading the shows how the water will be directed to the water quality feature. This site is in a State defined Municipal Separate Storm Sewer System (MS4) area which is a more urbanized area with state mandated, higher water quality requirements. Existing and proposed sites must provide an engineered water quality design as part of the planning process. The design and narrative must be stamped and signed by a licensed professional engineer in the State of Colorado. The applicants will be required to maintain historic drainage flows and run-off amounts on the property. Grading Permit A Weld County Grading Permit will be required if disturbing more than I acre. Contact the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-692-3575. CONDITIONS OF APPROVAL: Prior to recording the plat: A. 49111 Street has been annexed by the City (municipality) of Evans. The municipality has jurisdiction over all accesses within their jurisdiction. Please contact municipality to verify the access permit or for any additional requirement that may be needed to obtain or upgrade the permit. The map shall be amended to delineate the following: A. Label the approved City of Evans accesses on the plat with access permit number if applicable. B. Show and label standard tracking control onto publically maintained roadways on the map. C. Show the accepted water quality feature on the map with volume and label as WATER QUALITY FEATURE, NO-BUILD OR STORAGE AREA. Show how the water will be directed to the water quality feature. D. Show and label the drainage flow arrows, turning radii of 45', and parking and circulation on the map. Prior to Construction: A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to the start of construction. Contact the Planning Department for application information. DEVELOPMENT STANDARDS (NOTES ON THE PLAT) 1. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15,Articles I and II, of the Weld County Code. 2. The historical flow patterns and runoff amounts will be maintained on the site. 3. Weld County is not responsible for the maintenance of onsite drainage related features. 4. This site is located in a State Designated, Municipal Separate Storm Sewer System (MS4)Area which may trigger specific water quality requirements or other drainage improvements if the lot develops further. 5. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized. MEMORANDUM EL �I TO: TIFFANE JOHNSON, PLANNING SERVICES a N T Y FROM: LAUREN LIGHT, ENVIRONMENTAL HEALTH SUBJECT: USR14-0074 DATE: DECEMBER 12, 2014 Environmental Health Services has reviewed this proposal for a Site Specific Development Plan and Use by Special Review Permit for any Use Permitted as a Use By Right, an Accessory Use, or a Use By Special Review in the Commercial or Industrial Zone Districts (employee and commercial vehicle parking and machinery/ tool storage) provided that the property is not a lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. There will be up to 30 employees accessing the site. The applicant's residence is also located on the parcel. The property is served by the City of Greeley for water and the City of Evans for sewer. Portable toilets can be utilized for drivers as it is the policy of this department that portable toilets are allowed when employees or contractors are on site for less than 2 consecutive hours a day. The dust abatement plan indicates access to the property is paved. The area where the trucks will be parked is not paved and if necessary a water truck will be utilized in that location. The waste handling plan indicates that there is a dumpster on site and Northern Colorado Disposal will provide trash removal on a weekly basis. The application states that maintenance and repair of vehicles will not occur on site and there will be no painting or washing of vehicles or equipment. This site is strictly for parking of work vehicles and storage of tools and heavy machinery. We have no objections to the proposal; however, we recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved Waste Handling Plan, at all times. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved Dust Abatement Plan, at all times. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Non-Specified Zone as delineated in Section 14-9-30 of the Weld County Code. 6. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. For employees or contractors on site for less than 2 consecutive hours a day, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 7. This violation was initiated due to the operation of a Commercial business without first completing the necessary Weld County Zoning Permits. This case has been forwarded to the County Attorney's Office and we have initiated legal action; therefore, an investigation fee IS required. Please be advised the property owners are under a court order to appear before the Board of County Commissioners on or before April 1, 2015. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. I have not received a referral from Evans and I have received a number of phone calls from the surrounding property owners who are located within your city limits. The applicants did submit an access permit application to your engineering department but I have not received any information related to access either. The application is a Use By Special Review for a trucking company located at 3600 49th Street. I know we briefly talked about this case about a year ago at our town and county meeting in Platteville. Since then, the landowners have appeared in court and have also resubmitted a revised land use application. I have attached the application material including the letter to the Evans Engineering Department for commercial access. Any information you can provide would be very much appreciated. However, we will not make that determination until we know if the County is actually going to allow this site to have commercial operations. Is this the direction in which Weld County is going?The city is really not amenable to this site being used for commercial purposes, but I have been told by the City Engineer that we can grant a commercial access if/when the county approves a commercial use.
