Box 758 Greeley, Colorado 80631 RE: Partial Appeal of Assessor's decision of June 30th, 2015, Tax valuation of Acct# R3553505, 3510 WCR 55, Keenesburg, CO To Whom It May Concern: This letter is to inform you that Mr. Derek M. Richter and Ms. Elizabeth L. Darling, have retained the Law Office Of Daniel Schaefer, as their legal representation in the above matter, and hereby officially appeal the 2015 Real Estate Property Notice of Valuation and partially the Assessor's decision (Notice of Determination) in regard to their original appeal. Please find attached to this letter additional information substantiating my client's claim that the valuation of their property value is grossly misrepresented and in error: 1) On May 29th, 2015 Appellant timely appealed the original Tax Valuation by the Weld County Assessor's Office. A Copy of the tax valuation and the letter of Appeal is attached to this Formal appeal. 2) On July 1st, 2015, Appellant's received the Notice of Determination by the Weld County Assessor's Office, which conceded an error in the valuation for both the residence on the premises, as well as the valuation of the agricultural support buildings. 3) This timely filed appeal to this honorable Board is filed in response to a partial contest of the aforementioned letter of Determination. In summary, we agree and concede to the valuation of the Agricultural residence and land in the amount of$341,526.00 (residence) and $10,378.00 (Ag Land). However, the valuation of the Agricultural support buildings remains grossly unjust and not in conformity with other properties similar situated or the overall value of the buildings. In order to understand our clients appeal, we would like to mention the following case facts: 4) in 2014 the Weld County Assessor's office sent Appellant's a Notice of Valuation, attempting to raise the valuation of the property by$205,631.00, which was an over 62% increase in valuation amount. 14650 Benton Street, Broomfield,Colorado 80020 USA,daniel@danschaeferlaw.com (+1)720.206.7894 5) Upon timely appeal our clients and Weld County settled the dispute and agreed to a total valuation of $350,000.00, or an overall reasonable increase of 5.55%. This stipulated valuation amount was ratified by the Board of Equalization on July 23`d, 2014 and accepted on July 31St, 2014. (attached) 6) In the attached signed stipulation, Weld County admitted that:"... Value was reduced after making corrections to the basement square footage and the finish square foot of the basement. " (see stipulation agreement at§6). 7) From the stipulation it is obvious that the agreement was to re-adjust the valuation amount of the Ag Residence to an appropriate amount that would increase the overall valuation amount to $350,000.00 and leave the values of Ag Land and Ag Buildings unchanged. Hence, the valuation amounts for the Ag Residence should have been $322,278.00 as per stipulation agreement, while Ag Buildings should have remained at$20,323.00. 8) However, instead of raising the valuation amount the Ag Residence to the agreed amount, the stipulated increase was added to the Ag Buildings only, increasing existing structures that had never been improved since 2003 from $20,323.00 to $53,226.00, which resulted in an unprecedented 161.9% increase in valuation of these structures. This increase was and is not substantiated, is unconscionable and was not agreed to in the stipulation. 9) After the timely filed appeal this year, Weld County admitted error and adjusted the Ag Residential value to $341,526.00, which we believe to be appropriate under the circumstances, and Appellants would stipulate that this is a fair value for this tax valuation period. 10) While also admitting error as to the valuation of the Ag building valuation, the Weld County Assessor's office failed to adjust the valuation in any kind of substantial or meaningful manner. The valuation was reduced by only 4.59%. However, since this reduction was after an overall increase of 161.9% the year prior, the County Assessor Office, in essence increased our client's agricultural building value by over 157%over its 2013 recorded value of$20,323.00. 11) According to a national housing market study (attached), the Weld County/Greeley market only increased in this valuation period by an average of 8%. The Keenesburg market appears much less in increase and substantially more volatile. Hence, my client's position is that the Keenesburg market only increased by a maximum of 8% above 10%to any of the non-improved buildings is not appropriate or substantiated by appropriate valuation. 12) Further, a detailed analysis of valuation records in Weld County of the Appellant's neighbors revealed our clients appear to be above average in the per sqft price for any outbuildings. The Appellant's sqft price for their outbuildings is approximately$8.17/ft2 (6,370ft2/$52,096.00). „'' -2- 13) A close comparison to neighbors reveals that the average price per sqft grossly varies from $2.05/ft2 (See R1032802) to $12.32/ft2 (See R4217306). The most common area of price per sqft appears between $2.50/ft2 to $4.50/ft2 (See, for example, R2227403 at $2.89/ft2 and R0254393 at $4.03/ft2). Hence, while it is difficult to establish a fair median, or appropriate average price per sqft based on the comparisons (Due to other valuation errors (see R4217306)) it appears to be around $4.00/ft2. 14) Another measure of appropriate valuation is overall market increase or decrease and the adjustment to the properties in question, based on the Weld County market. Here, the Appellant's Agricultural Buildings valuation in 2013 was $20,323.00, which both parties at the time agreed to be reasonable, fair and appropriate. However, in 2014, the Weld County Assessor's Office increased this valuation by over 161%. Appellant's position is that this increase was both unsubstantiated and unconscionable. Even if the taxes paid in 2014 are beyond appeal, it is unconscionable to continue to force the Appellants to pay for such increase in the new year which is still appealable. instead the valuation has to be readjusted to an appropriate level. If one assumes an overall increase of 10% in 2013 and 10% in 2014, the property value of the Agricultural buildings should not be over $24,590.00. Appellants do not advocate that Weld County's market increased by such numbers, but rather want to point out even though there was a lack of market increase of 20% over the last two years, the Assessor's office deemed the Appellant's property to have increased to $54,606.00 (prior to appeal), which Is unsubstantiated. Even the upon appeal Weld County Assessor's only deemed it necessary to re- adjusted the valuation to $52,096.00. 15) Appellants concede that value has increased over the last two years, but not to such unprecedented degree. Appellant respectfully submits to this Board that property value of the Agricultural buildings is approximately $23,000.00 and would stipulate to this value in the interest of resolving this matter expediently. Therefore, our clients would respectfully agree and stipulate to the readjusted residence (Ag Residence) valuation of$341,526.00, but appeal, ask and pray for relief from this body from the grossly mis-valued agricultural support buildings (Ag Buildings)from $52,096.00 to $23,000.00.
