The Enviornmental Health Office , under direction of Mr . Glen Paul , and a part of the Weld County Health Department , under direction of Dr . Yoder , issued a. septic tank and leech field permit to Mr . Lynn Brass , 617 Mt . View in La Salle , on 25 June 1976 . We have the following concerns related to this administrative action : 1 . Issuance of the permit violates the terms and intent of Section 3 .1.2 of the Sewage Disposal System Regulations of the County Health Department . This section requires denial of an application if the subject property is within 400 feet of an existing municipal sewer system and the municipality agrees to serve the property. 2 . lssnancetof the permit by Mr . Paul ' s office violates the intent of the County Commissioners standing policy of advising a community of when a utility service is requested for property adjacent and contiguous to the town. 3 . The permit in question was issued without the local elected officials having a chance to advise and comment upon the application . 4 . 'the County Planning Department , under Mr . Gary Fortner , is aware of the County Health policy even though the Health Depart- ment is unaware of their own procedures , and Mr , Fortner is trying to adhere to the regulations , hut in doing so must oppose Mr . Paul and other Health Officials , thus making For a had relationship all the -way around. PLOO79 760375 Moreover, we have the following concerns about the effects of the County Health Department action: 1 . A septic tank and leech field at this site is incopatible with La Salle plans to extend urban services to the larger area in question .2 . The action allows issuance of a County building permit and thus propagation of acounty island , or enclave , directly adjacent to existing Town limits , but which can not be served by the County . 3 . The placement of a leech field in this area directly violates the La Salle Town Board policy directed toward protecting the underground aquifer from pollution , as well as violating many town ordinances regarding sewer service . 4 . The propagation of this parcel as a County island substantially blocks further westerly growth and violates the Comprehensive Master Plan of the Town of La Salle . 5 . As this subject parcel develops (under County jurisdiction) it is solely dependent upon the Town of La Salle for transportation access , police protection and other services which can only be provided by the Town . . .hut the site will not pay any taxes to the Town to pay for these services . 6 . The net effect of this County Health Department action is to violate many basic principles of sound urban development , good planning , and County-City cooperation . In summary , the action taken by the Environmental. Health Section of the County Health Department is , in our opinion , a serious breech of policy. The effect of this action is to have serious impact and rimifi.cations upon the Town in the next few years . But most serious of all , this action clearly degrades the relation- ship between local elected officials and County elected officials . The relationship of trust and cooperation that exists between County and local elected officials , that takes so many years to develop , cannot long endure when promises , understanding, and committments are ignored, abused, and manipulated by insulated bureaucrats who ignore the political obligations of their elected employers . The benign ability of appointed officials to exist and function within a vacumn unchecked by obligations to adhere to the committments of elected officials is , in fact , a critical flaw. . . a weakness of "big" government , and has no place in Weld County Government . In conclusion we petition the La Salle Town Board to join with similiar interests and oppose issuance of the County permit for a septic tank for Mr . Lynn Brass without adherence to the policies and procedures necessary to maintain a good working relationship between County and local elected officials . • Secondly , that the Weld County Commissioners , County Council , Weld County Board of Health and related officials he petitioned to declare this permit invalid; to re-open the case , and analyse this issue in cooperation with local officials . Finally , that the County Commissioners be petitioned to strengthen their direct control over the various departments of the County structure to protect the public from unjustified abuse of power by appointed bureaucrats . And if this requires re-organization or establishment of a strengthened administrative structure , ie . Chief Administrative Officer , that such steps be investigated and evaluated.
