HomeMy WebLinkAbout20152998.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO SEPTEMBER 14, 2015 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, September 14, 2015, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Julie A. Cozad - EXCUSED Commissioner Steve Moreno - EXCUSED Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly MINUTES: Commissioner Freeman moved to approve the minutes of the Board of County Commissioners meeting of September 9, 2015, as printed. Commissioner Conway seconded the motion, and it carried unanimously. la READ ORDINANCE BY AUDIO: Commissioner Conway moved to read Code Ordinances #2015- 17 and #2015-18 by audio. Commissioner Freeman seconded the motion, which carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. fa CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda as printed. Commissioner Conway seconded the motion, and it carried unanimously. PRESENTATIONS: la 1) RECOGNITION OF SERVICES, SHERIFF'S OFFICE -JUDITH BRUNGARDT: Chair Kirkmeyer read the certificate recognizing Judith Brungardt for her years of service with the Sheriffs Office. Steve Reams, Sheriffs Office, presented Ms. Brungardt with a retirement pin and plaque. He expressed his appreciation for her hard work, being able to organize the chaos in the office and her many years of service with the Sheriffs Office. He stated she has worked here for thirty years and she will be missed. Commissioner Conway concurred with Sheriff Reams and wished her luck in the future. Commissioner Freeman said thank you for a great job, told her to enjoy her retirement, and reminded her there are opportunities in the County. Chair Kirkmeyer stated she appreciates her hard work and dedication to the Minutes, September 14, 2015 2015- 2998 Ob. Page 1 BC0016 job for the Sheriff's Office. Ms. Brungardt thanked everyone for the opportunity to work for the County and for the many friendships formed. (Clerk's note: The meeting was paused for a group photograph.) RECOGNITION OF SERVICES, SHERIFF'S OFFICE - KIMBERLY HIGUERA: Chair Kirkmeyer read the certificate recognizing Kimberly Higuera for her years of service with the Sheriffs Office. Sheriff Reams, presented the plaque and a retirement pin. He thanked her for the great job organizing and managing the Sheriffs Office. He explained she started in booking and worked her way up through the ranks. He thanked her for her service and wished her well. Commissioner Freeman thanked Ms. Higuera for all she has done for the citizens of Weld County. Commissioner Conway thanked her for her twenty eight years of extraordinary service and told her to enjoy retirement. Chair Kirkmeyer stated she agrees with all the comments made by her fellow Commissioners and thanked her for a great job. Ms. Higuera stated she appreciated the opportunity to serve and is also looking forward to her future plans. (Clerk's note: The meeting was paused for a group photograph.) IR PUBLIC INPUT: No public input was given. BIDS: IR 1) APPROVE BID #B1500156, (CNG) TANDEM TRUCK - DEPARTMENT OF PUBLIC WORKS: Rose Everett, Department of Purchasing, stated staff recommends awarding the low bid to Transwest Truck (Auto Truck) for a total of $261,649.00. Commissioner Conway moved to approve said low bid. The motion was seconded by Commissioner Freeman, and it carried unanimously. (Clerk's note: A new memo was submitted after the hearing showing the correct total amount for the bid). • 2) PRESENT BID #B1500162, PERMANENT FLOOD REPAIR - TRM TWO (2) ROADWAYS - DEPARTMENT OF PUBLIC WORKS: Marcia Walters, Department of Purchasing presented the four (4) bids received and stated staff will make a recommendation on September 28, 2015. • 3) PRESENT BID #B1500165, UNIFORMS AND EQUIPMENT - SHERIFF'S OFFICE: Ms. Walters stated staff received three (3) bids and will bring back a recommendation on September 28, 2015. Sterling Geesaman, Sheriffs Office, explained there were some discrepancies after the bidding last year so this is for replacement uniforms in the future and as they wear out and for those uniforms for new employees. Commissioner Freeman clarified and stated this is right for the procurement process, the first bid was fulfilled and it is reasonable to bid for the future. • 4) PRESENT BID #B1500164, CABLING FOR PUBLIC WORKS - DEPARTMENT OF INFORMATION TECHNOLOGY: Ryan Rose, Director of the Department of Information Technology, stated four (4) bids were received and staff will make a recommendation on September 28, 2015. NEW BUSINESS: IR 1) CONSIDER REVOCABLE LICENSE AGREEMENT FOR USE OF STAIRWELL ACCESS AT AUTHORIZE CHAIR TO SIGN - CONSERVATORY GROUP,7TH STREET, GREELEY, AND LLC: Toby Taylor, Director of Buildings and Grounds, presented the revocable lease for the Conservatory Group, LLC, to use the County's stairwell to access their roof during business hours. Commissioner Conway moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Freeman, the motion carried unanimously. 2) CONSIDER REAPPOINTMENT OF DEON HARRIS AS ASSISTANT VETERANS SERVICE OFFICER: Mr. Taylor requested that Mr. Harris be reappointed as the Assistant Veteran's service officer until 2017. Commissioner Conway moved to approve said reappointment. The motion was seconded by Minutes, September 14, 2015 2015-2998 Page 2 BC0016 Commissioner Freeman, and it carried unanimously. Commissioner Conway appreciates all the hard work that Mr. Harris and the Veteran's Office is doing and stated he continues to hear great things about the Office. Commissioner Freeman expressed his appreciation for Mr. Harris' input and willingness to assist with Weld County Bright Futures. IR 3) CONSIDER PROPERTY USE AGREEMENT FOR IPAD AND AUTHORIZE CHAIR TO SIGN - GENE STILLE: Chair Kirkmeyer stated Mr. Stille is a new member of the Planning Commission and this is a typical iPad agreement. Commissioner Conway moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Freeman, carried unanimously. 12 4) CONSIDER MEMORANDUM OF UNDERSTANDING AND AUTHORIZE CHAIR TO SIGN - WATTENBERG IMPROVEMENT ASSOCIATION: Don Warden stated staff and the Town of Wattenberg have been working to improve the water system, and staff is requesting the memorandum of understanding. Commissioner Conway thanked Chair Kirkmeyer for getting the citizens to complete the paperwork for this project. Chair Kirkmeyer thanked Mr. Warden for all his hard work on the project. Commissioner Freeman moved to approve said memorandum of understanding and authorize the Chair to sign. Seconded by Commissioner Conway, the motion carried unanimously. 12 5) CONSIDER FILING OF PROCEEDING IN EMINENT DOMAIN, PURSUANT TO SECTION 38- 1-101, C.R.S., AGAINST M & J DAIRY, LLC: Bruce Barker, County Attorney, explained the landowner requested a court order stating the number of animal units that can be kept on the property. Commissioner Conway moved to approve said filing of eminent domain. Commissioner Freeman seconded the motion, and it carried unanimously. 6) FIRST READING OF CODE ORDINANCE #2015-17, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION, OF THE WELD COUNTY CODE: Mr. Barker presented the code and stated it pertains to the assignment of vehicles and there were recommendations from the Heads of the Departments to add provisions to the Collateral for Improvements Agreement to keep consistency. No public comment was offered concerning this matter. Commissioner Conway moved to approve on First Reading. Seconded by Commissioner Freeman, the motion carried unanimously. Chair Kirkmeyer thanked Barb Connolly for all the hard work on this code. 7) FIRST READING OF CODE ORDINANCE #2015-18, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 3 HUMAN RESOURCES, OF THE WELD COUNTY CODE: Patti Russell, Director of Department of Human Resources, stated the reason for the code is to put into writing what they practice. No public input was offered concerning this matter. Commissioner Freeman moved to approve code ordinance #2015-18 on First Reading. The motion was seconded by Commissioner Conway, and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinances #2015-17 and #2015-18 were approved on First Reading.
