RE: EPA INSECTICIDE COMPLAINTS.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the following facts and circumstances have come
to the attention of the Board:
On or about June 25 , 1978, Easton Aerial
Sprayers sprayed a residential area known
as "Aristocrat Ranchettes" to control
grasshoppers. On or about June 20 , 1978 ,
Easton Aerial Sprayers sprayed an onion
field. As a result of such spraying, the
United States Environmental Protection
Agency filed a complaint for each of these
incidents (Docket No. VIII-48C and No.
VIII-49-C) alleging that Charles Easton
violated provisions of the Federal Insecti-
cide , Fungicide and Rodenticide Act.
WHEREAS , the Board feels that the Environmental Protective
Agency was completely unjustified in filing such Complaint, that
such action was arbitrary and capricious , and that the Environ-
mental Protection Agency exceeded its jurisdiction and abused
its discretion.
NOW, THEREFORE, BE IT RESOLVED that the Board of Commis-
sioners of Weld County Colorado demands that the Environmental
Protection Agency withdraw the aforementioned Complaints against
Charles Easton.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 5th day of
February, A.D. , 1979 .

Dear Mrs. Stanley:
I have looked into the problem you brought to my attention
a few weeks ago. All of the information I have gathered to
date has led me to concur that the actions of the EPA against
Mr. Easton are entirely unwarranted.
On Monday, February 5th, I introduced the enclosed resolution
to the Board of County Commissioners, and it was passed
unanimously. Copies of the resolution are being sent to EPA,
the State Department of Agriculture, Mr. Easton, and the
Governor' s Office.
If I may be of further assistance to you, please do not
hesitate to contact me.

Dear Mr. Smith:
A constituent of mine contacted me concerning the complaints filed
against Easton Aerial Sprayers by the Environmental Protection Agency.
At that point, I contacted the Governor's Office for guidance as to
whom I should talk to about this problem.
I later received a call from Mr. Robert Sullivan of the State Department
of Agriculture, who was extremely helpful in gaining information. The
Department of Agriculture sent me copies of reports of the instances
of EPA sanctions of this type throughout Colorado. After reading the
material received from your staff and talking to several people involved,
I introduced the enclosed resolution which was unanimously adopted by
the Board of Weld County Commissioners on February 5, 1979.
Please express my gratitude to your staff for their assistance and
information concerning this matter. Also, please accept my congratulations
on your appointment; I am personally quite pleased to have you as
Colorado' s Commissioner of Agriculture. If I can ever be of assistance
to you or your staff, please let me know.

Dear Mr. Merson:
A constituent has contacted me concerning the complaints filed by
the Environmental Protection Agency against Easton Aerial Sprayers
of La Salle. I have since contacted the State Department of
Agriculture and several people with firsthand knowledge of the
situation, and based on that information, I am convinced that the
actions taken by EPA against Easton Aerial Sprayers is not justified.
Consequently, on February 5, 1979, I introduced the enclosed resolution
which was accepted unanimously by the Weld County Board of County
Commissioners.
I have no objection to controls and restrictions on the use of
pesticides and herbicides. I do, however, believe that those
regulations must be administered with a measure of reasonableness.
This is the area in which we disagree; I am convinced that in the
Easton matter, the EPA has totally failed to exercise a degree of
reasonableness.
It is for that reason that I ask you to direct that this matter be
reviewed, and that EPA withdraw the complaints issued against Easton
Aerial Spraying in light of the lack of substantiation of the complaints.
