RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 108 - JIM' S
WATER SERVICE OF COLORADO, INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 6th day of February, 1974 , the Board of
County Commissioners of Weld County, Colorado adopted a Resolution
in which Recorded Exemption number 108 for Jim' s Water Service of
Colorado, Inc. was approved, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado has been informed by the Weld County Department of
Planning Services that said Recorded Exemption number 108 now
needs to be amended due to a typographical error in the typed
legal description, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado deems it advisable and in the best interests of Weld
County that the amendment to Recorded Exemption number 108 be
approved.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the legal description
of Recorded Exemption number 108 for Jim' s Water Service of Colo-
rado, Inc. be, and hereby is, amended to read as follows:

RE: Amendment to Recorded Exemption #108
Dear Commissioners :
The attached materials are in reference to a request from Jim' s Water
Service of Colorado, Inc. , for an amendment to recorded exemption #108.
The property is described as Pt . NINE* Section 31, TIN, R66W of the
6th P.M. , Weld County, Colorado. This property is located at the
southeast corner of the intersection of County Road 4 and U. S. Highway
85.
The request is to amend recorded exemption #108 by correcting a typo-
graphical error in the typed legal description on the recorded exemp-
tion plat . On the original recorded exemption plat there was a 10
foot discrepancy between what was shown on the survey and the typed
legal description. The request , if approved, would eliminate the 10
foot discrepancy.
Based on the information submitted, the Department of Planning Services
Staff recommends approval of this requested amendment since the amend-
me c.rrects an incorrect legal description.

Dear Mr.. Chuck Cunffley;
Jim's Water Service of Colorado, Inc. recently bought
McKinley Oil Service, on County Road # 4 and Highway 85.
During the loan transaction, an error was found in the Deed
to the land by Security National Bank. The descrepancy was
in typing, as it stated, one measurment in the paragraph was
10 feet different than the diagram at the bottom of the sheet.
We have gone back to Clyde Malara, the owner, and to the
surveyor, Leonard McCoy, and have it all corrected and now
need you to record it correctly. Thank you.
