FACILITY - SALTWATER INJECTION FACILITY IN THE A (AGRICULTURAL) ZONE
DISTRICT-COLORADO STATE LAND BOARD, CIO BILL BARRETT CORPORATION
A public hearing was conducted on January 21, 2015, at 10:00 a.m., with the following present:

The following business was transacted:
IIEJ I hereby certify that pursuant to a notice dated November 26, 2014, and duly published
December 1, 2014, in the Greeley Tribune, a public hearing was conducted to consider the
request of Colorado State Land Board, Go Bill Barrett Corporation, for a Site Specific
Development Plan and Use by Special Review Permit, USR14-0069, for Mineral Resource
Development Facilities, Oil and Gas Support Facility, including a Class II Oilfield Waste
Disposal Facility — Saltwater Injection Facility in the A (Agricultural) Zone District. Brad Yatabe,
Assistant County Attorney, made this a matter of record.
Fei Kim Ogle, Department of Planning Services, presented a brief summary of the proposal
and stated the site is located on a 3.2-acre Subdivision Exemption parcel created for oil and gas
support service, is not within the three (3) mile referral area of any municipality, and the
proposed facility is bordered by agriculture. There are no residences in the general area and no
correspondence has been received concerning this application. He displayed the site layout and
reviewed the facility operations to include the projected life span of thirty (30) years, at which
time it will be capped off per regulations of the COGCC (Colorado Oil and Gas Commission).
Mr. Ogle reviewed the referral agency responses, and entered the favorable recommendation of
the Planning Commission into the record as written. He requested a correction to Condition of
Approval #5.F, and displayed photographs of the site. In response to Commissioner Cozad, Mr.
Ogle confirmed this is for a Bill Barrett well, not a commercial facility.

L Wayne Howard, Department of Planning Services Engineer, provided a brief overview of
the transportation plans and requirements. He detailed the location and average daily traffic
counts in the area. The traffic narrative indicates one employee per day, and on average up to
20 round truck trips per day. A Weld County Access Permit, AP14-00069, has been granted
and staff has requested improvements to that access. The applicant is required to submit
various plans and retain certain permits pertaining to Conditions of Approval and Development
Standards to include a Drainage Narrative, an Offsite Improvements and Road Maintenance
Agreement, a Grading Permit, and a CR 46 Non-exclusive License Agreement.
Fi Heather Barbare, Department of Public Health and Environment, reviewed the water and
sewer provisions stating there are no full time employees on-site. The applicant has agreed to
provide portable toilets and bottled water during construction and operation of the facility. Ms.
Barbare detailed the areas of compliance and noncompliance regarding the necessity of
submitting various plans and retaining certain permits as required by the Department of Public
Health and Environment to meet the Conditions of Approval and Development Standards. In
response to Commissioner Moreno, Ms. Barbare defined APEN.
Doug Dennison, Bill Barrett Corporation, represented the applicant and confirmed this is
not a commercial facility. He displayed a PowerPoint presentation that included details about
the facility, site map, description of the proposed operation, haul route and site access and
layout. Mr. Dennison clarified the well had originally been drilled as a test well and Bill Barrett
Corporation went back to COGCC to get the required permit to make it an injection well. He
detailed the concern addressed during the Planning Commission hearing regarding spill control
because of the close proximity to a riverside reservoir, and affirmed the facility is primarily
designed to prevent spills with sensors in the containment containers which alert remotely and
instantly to contain and minimize impact should there be a problem. The final layer of protection
regarding spill control is the landscaping berm. The application to convert this well to an
injection well is still awaiting approval with the COGCC and once it is approved the applicant will
follow up with the County regarding the financial assurance and completion of the Conditions of
Approval.
In response to Commissioner Cozad's questions, Mr. Dennison conveyed that it is the standard
process of the COGCC in regard to the conversion of a test well to an injection well to consider
seismic activity before granting approval. Further, he clarified that the Skata system is tied into
their offices in both Greeley and Evans which both have the ability to shut the system down;
however, as stated above, the system has sensors and remote capabilities to automatically shut
down when there is a problem. The response time to get an employee to the site would be a
maximum of one hour.

El In response to Chair Kirkmeyer, Mr. Dennison indicated the applicant has reviewed, and
agrees to abide by, the Conditions of Approval and Development Standards, as amended.
El Commissioner Cozad moved to approve the request of Colorado State Land Board, Go
Bill Barrett Corporation, for a Site Specific Development Plan and Use by Special Review

Permit, USR14-0069, for Mineral Resource Development Facilities, Oil and Gas Support
Facility, including a Class II Oilfield Waste Disposal Facility — Saltwater Injection Facility in the
A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning
Commission, with the Conditions of Approval and Development Standards, as amended. The
motion was seconded by Commissioner Moreno, and it carried unanimously. There being no
further discussion, the hearing was completed at 10:26 a.m.
This Certification was approved on the 26th day of January, 2015.
