Explain, in detail, the proposed use of the property. The applicant operates Gallatin Turf Installation, Inc., and there are 2 divisions: a turf installation division and a trucking division. Both divisions use the Site to park vehicles, trailers and equipment. There are two (2) employees on the trucking side that will come to the site each day and two (2) persons associated with the turf installation side that will come to the site each day. There is a 60' x 80' pole barn for storage of vehicles, materials and supplies. Wernsman Engineering, Inc. has done the structural engineering analysis and will present his report at his earliest convenience. The daily operation of both sides will be as follows: (a) Trucking side — the drivers come in each morning, take their trucks and do the day's runs. They return the trucks at the end of the day, washed, and park them ready to go for the next day. (b) Install side — the crew foremen will come in each morning and grab the materials they will need for the day's work. At the end of each work day, they will return to the yard and prepare the materials for the next day. (c) Land use -- currently, the property is used almost exclusively for parking the work vehicles. However, some limited light maintenance is done in the pole barn. No vehicle washing is done on the property. (d) In addition, there is a plot of land approximately 4 acres in the southwest corner of the property that the Applicant may lease in the future. (e) Applicant plans to build a home for himself and his family on the site and MAY, at some point in the future, erect a 40' x 40' barn for personal horses on the south part of the property. (f) Applicant plans to farm the north side of the property. (A) Proposed conceptual future use of the property. The applicant MAY, at some point in the future, erect a second 60' x 80' shed (actual size may vary) to store his tractor trailer trucks. The applicant will apply for any necessary building and other permits. (a) Trucking side — Applicant hopes to expand his business and theorizes that it may hold up to 6 semi-trucks in the future. (b) Install side — Applicant has no plans to increase the number of trucks, but would like to increase his business to three (3) crews, not two, meaning 3 foremen, not two. As before, the foremen would come onto the site each morning, gather their supplies, leave to do their jobs, return to unload the truck in preparation for the next day's work and go home each night. 2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan. The subject property is currently zoned A (Agricultural). One essential goal of the Comprehensive Plan is "to support all forms of the agriculture industry and, at the same time, to protect the rights of the private property owners to convert their agriculture lands to other appropriate land uses." Sec. 22-2-10.B. Conversion of agricultural land to a residential, commercial or industrial use "should be accommodated when the subject site is in an area that can support such development, and should attempt to be compatible with the region." Sec. 22-2- 20 G.2. A.Policy 7.2. The proposed use on the site would be highly compatible with the surrounding region, and the area can support such development. The proposed use is not offensive in nature, and impacts to environmental resources such as air, water, noise and public health, if any, should be minimal. The property is fenced and is kept neat in appearance. There is some landscaping around the fenced perimeter. These features are in conformity with Section 22-2-150 F.I.Goal 6, which calls for minimizing incompatibilities between industrial use and surrounding properties, supporting visual and sound bather landscaping, and ensuring that industrial properties are free of derelict vehicles, refuse, and other unsightly materials. The site will have a relatively small footprint, and while there will potentially be some impact on issues such as traffic in the area, these impacts will not change the basic agricultural character of the surrounding area. The site's contribution to Weld County will enhance the County. Furthermore, Section 22-2-150 D. 1. Goal 4 states, "All new industrial development should pay its own way." The proposed use here meets these criteria, in that all improvements will be paid for without any request from the County for funds. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. The property is zoned "A" (Agriculture), as are all the properties immediately surrounding this site. Many of the property owners surrounding the site have semi trucks that they operate. This use is compatible with the surrounding zoning. 4. What type of uses surround the site - explain how the proposed use is consistent and compatible with surrounding land uses. The lots immediately adjacent to the site are agricultural, with some other small owner agricultural and other businesses within the surrounding 2 mile radius. The proposed use of the site is consistent and compatible with these uses, and is permitted under Section 23-3-40 of the Weld County Code. The proposed use will have a positive impact on Weld County as a whole, and will have little or no impact in terms of government obligations, or changes to the agriculture character of the surrounding properties. 5. Describe, in detail, the following: a. Number of people who will use this site: 1 . Trucking side — There are two (2) employees on the trucking side that come to the site twice each day. In the future, applicant may increase this to three (3) drivers. Conceptually, the applicant MAY someday increase this to 5 or 6. These drivers come onto the site twice each day in the morning to get their respective trucks and in the evening to park their trucks for the evening. 2. Install side - There are two persons associated with the turf installation side. Like the semi truck drivers, they come onto the site in the mornings, get their supplies and head out to the job sights. They return in evenings to unload. The Applicant would like to expand his business over the next years to include up to 3 crews and therefore 3 foremen. PLEASE NOTE: ONLY THE FOREMEN COME ONTO THE SITE (2 CURRENTLY, 3 IN THE FUTURE) ON A BRIEF BASIS (30 MINUTES OR LESS). 3. Customers do NOT come to the site. 4. The owner (and in the future his family) will be on the site once the family residence is erected. b. Number of employees proposed to be employed at this site: 1 . NO employees will be employed to work at the site itself. c. Hours of operation: 1 . The applicant proposes that the hours of operation be 24/7. That said, the overwhelming majority of business is conducted between 4:00 a.m. and 10:00 p.m. Generally, almost all business is conducted during the normal business hours of 6:00 a.m. to 6:00 p.m. d. Type and number of structures to be erected (built) on this site: 1 . One 60' x 80' pole barn for storage of vehicles, materials and supplies. Applicant is applying for all necessary permits. 2. Conjecturally, the applicant MAY, at some unknown point in the future, erect an approximately 60' x 80' pole barn (actual size may vary) to store his tractor trailer trucks. The applicant will apply for any necessary building and other permits. 3. Applicant proposes to erect a residence on the property for himself and his family. A garage for personal use may be attached or associated with this residence. 4. Conjecturally, the applicant MAY, at some unknown point in the future, erect a 40' x 40' barn for personal use for personal horses. e. Type and number of animals, if any, to be on this site: 1 . IF, and only IF, the above-mentioned barn should be built, the applicant would keep 2-3 horses for personal use. f. Type and number of vehicles (size, weight) that will access this site. 1 . Trucking side - The applicant currently owns 4 semi-trucks but only runs 2-3 of them. The GVWR is 80,000 pounds. The drivers park their personal vehicles on the property while they drive. At the present time, that is 2 personal vehicles plus the applicant's pickup truck. At no time are the drivers' personal vehicles and the semi trucks parked on the property at the same time. 2. Installation side - The applicant proposes 3-4 heavy-duty pickup trucks for the installation side. This number may increase to 5 should the business expand. Currently, the install division has 3 pickups: two 3500 GMC diesel and one 2500 GMC gas. These picks all have a GVWR (With Trailer) of 26,000 pounds. 3. Personal use — the applicant and his wife each have personal vehicles that they will park on the site when they erect their residence on the property. g. Who will provide fire protection to the site: 1 . Nunn Fire District will provide fire protection to the site. They are in the process of completing the Fire District Notification form. h. Water source on the property (both domestic and irrigation): 1 . Domestic — The North Weld County Water District provides water to the site via a 3/4" tap. Their letter of approval is attached. 2. Irrigation — N/A — it is dry land. i. Sewage disposal system on the property (existing and proposed): 1 . There is no existing sewage on the site, and the current proposed use does not require that any be installed. Because there will not be more than two (52) employees on site, and each of the employees will be on site for less than two (2) hours. Therefore, applicant will install a port-a-let on the site with appropriate hand sanitizer and provide bottled water on the site. 2. For the conceptual future plans of the applicant, applicant MAY build a bathroom in a pole barn (provided applicant builds a second pole barn), which will have a septic system and leach field. Applicant will pull all necessary permits for these projects should these plans move forward. These ideas are conceptual only. j. If storage and warehousing is proposed, what type of items will be stored: 1 . Trucks and pallets and tubes 6" x 48" that roll the sod around. Sod laying machines, trucks, trailers, 2 polyurethane tanks from Agfinity for new motor oil and new hydraulic oil. 6. Explain proposed landscaping for the site. The landscaping shall be separately submitted as landscaping plan map as part of the application submittal. Applicant plans to line his driveway at 50' intervals with trees. These are not required as they are inside of his grounds but will be in conformity with county code nonetheless. 7. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. 8. Explain how the storm water drainage will be handled on the site. A storm water drainage plan is being drafted by Eric Wernsman. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. The site is almost completely constructed. 10. Explain where storage and/or stockpile of wastes will occur on this site. As per the waste handling plan, there will be no storage or stockpile of wastes on the site. 11 . Please list all proposed on-site and off-site improvements associated with the use. TRAFFIC NARRATIVE The proposed project will obtain access off WCR 29. The southeast corner of the property is at the intersection of CR 29 and CR 94. However, CR 94 does not continue toward the west and therefore does not run along the south border of the property. The northeast corner of the property is about 3` of a mile south of CR 96. CR 29 is currently utilized primarily by semi trucks, farm vehicles, area residents and other associated traffic. CR 94 and CR 96 also carries commercial, farm and residential traffic. The peak hours for traffic on CR 29 and CRs 94 and 96 are estimated to be from 6:00 to 7:30 a.m. and from 5:30 to 7:00 p.m., assuming the highest peak rates would be associated with peak commute hours. The proposed use will contribute approximately 8 trips per day of semi trucks and trailers and 4 trips per day of pickup trucks used for work. A conceptual future use would theoretically add 12 total trips per day of semi trucks and 6 total trips per day of pickup trucks used for work. While a majority of these trips will come in to the subject property from the South on CR 29 and leave to the South on CR 29, it is anticipated that some trips will come from and leave toward the North as well. These trips represent a minimal increase in daily traffic on Highway 29. The majority of the trips to and from the proposed use will occur between 6:00 a.m. and 6:00 pm. The drive into the property is road base and ends with a semi-truck turnaround. The drive is sufficiently wide for trucks to enter and exit the property. WASTE HANDLING PLAN 1 . Currently, trash and refuse on the property are to bestored in a 3-yard dumpster, which is taken away by: Northern Colorado Disposal, Inc., P. O. Box 2146, Greeley, CO 80632, (970) 353-4000. 2. Truck tires are to be recycled by Schroeder Tire & Rubber, LLC. They take the tires away immediately, so no old tires are stored on the site. Schroeder Tire & Rubber, LLC, 1205 Hope Ave., Pierce, CO 80650, (970) 834-2212. 3. Other waste from light maintenance to vehicles, including waste oil, is to be handled by Empire Truck Center. The Applicant brings their waste oil immediately to its facility. Waste oil is to be dumped into appropriate containers, lids are placed immediately on the containers, and the containers are taken to Empire Truck Center. Containers are to be stored in the pole barn on the concrete slab floor until they are transported, and would not be left in the pole barn for more than 2-3 days. Truck maintenance, including disposal of used batteries, is to be handled by: Alltruck Sales, 2308 1st Ave. Ct., #1 , Greeley, CO 80631 , (970) 352-5550. SPILL CLEANUP Cleanups on the shop floor are to be immediately covered in Floor Dry to be absorbed, and the Floor Dry is subsequently swept up and disposed of into garbage bags and taken to an appropriate disposal site. Cleanups (i.e. spills) outside, and particularly near the fuel tanks, are to be scooped up, bagged and taken to an appropriate disposal site. Waste is to be stored on the concrete slab floor of the pole barn until it is transported and is stored for a period of no more than 2-3 days. There could be from 1 -3 bags stored. FUEL TANKS Exhibit " 1 " attached shows photographs of the fuel tanks, which are owned by AgLand. They will sit on a concrete slab inside a galvanized metal enclosure provided by AgLand. The fuel tanks are rated for fuel storage and are owned, provided, re-filled and maintained by AgLand, as shown on Exhibit " 1 ." The applicant owns over 500 ft. of hose and has a power washer, along with other hookups. On hot, windy or dry days, applicant will hose down the property so that dust will be abated. Vehicle speeds are restricted to reduce the amount of dust generated. DRAINAGE STUDY A drainage study and a proposal for a water quality feature are being conducted and drawn up by Eric Wernsman of Wernsman Engineering. Wet-stamped, signed study and plans will be submitted as soon as they are complete. GRADING AND CONSTRUCTION STORMWATER PLAN The determination has been made that the Applicant's project will disturb less than I acre of land. POSSIBLE FUTURE CONCEPTUAL SECOND ACCESS During the pre-application meeting, the idea was put forward for Applicant to possibly have a second access for the property at the southern boundary. This access would be shared with an oil & gas company. Public Works has determined that the Applicant would need to get a non- exclusive license agreement in place in order to use the oil & gas road that runs east-west along the south boundary of the road. Applicant would then need an Access Permit for access onto Highway 29. The Applicant has determined that he has no plans for the foreseeable future to move forward with a second access for the property. If his plans should ever change, Applicant would then submit all necessary applications, documentation and fees to enter into a non-exclusive license agreement and obtain an access permit.
