RESOLUTION RE: DENIAL OF CHANGE OF ZONE FROM A-AGRICULTURAL ZONE DISTRICT TO I-INDUSTRIAL ZONE DISTRICT FOR CLYDE G. MALARA, ET AL. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was held on the 11th day of July, 1979 at 2 :00 o'clock p.m. for the purpose of hearing the petition of Clyde G. Malara, et al. , 931 Weld County Road #27, Brighton, Colorado 80601 , requesting a change of zone from A-Agricultural Zone District to I-Industrial Zone District for the following described parcel of land, to-wit : A parcel of land located in the Northwest Quarter of the Southwest Quarter of Sec- tion 17, Township 1 North, Range 66 West of the 6th P.M. , County of Weld, State of Colorado, being more particularly described as follows : Beginning at the West Quarter Corner of said Section 17 , and considering the West line of the Southwest Quarter of said Section 17 as bearing South 00°00 ' 00" West, with all other bearings contained herein relative thereto; Thence South 00°00 ' 00" West, along said West Line, 523. 52 feet; Thence North 89°42 ' 10" East, 469. 00 feet; Thence North 00°24 ' 15" West, 523 . 53 feet; Thence South 89°42 ' 04" West, 465. 31 feet to the Point of Beginning. Said described parcel of land contains 5. 614 acres, more or less , and is subject to any rights-of-way or other easements as recorded by instruments of record or as now existing on said described parcel of land. WHEREAS, the petitioners were present, and WHEREAS, Section 8 . 2 and 8 . 3 of the Weld County Zoning Resolu- tion authorizes the Board of County Commissioners to grant a change of zone upon the showing of certain facts by the petitioner, and WHEREAS, the Board of County Commissioners heard the testi- mony and statements of those present and has studied the recom- mendations of the Weld County Planning Commission for denial of the proposed change of zone, and WHEREAS, the Board of County Commissioners hereby finds that the petitioners have not shown changing conditions in the 790030 area to justify the change of zone nor that the original zoning was faulty. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the petition of Clyde G. Malara, et al. for a change of zone from A-Agricultural Zone District to I-Industrial Zone District on the abovedescribed tract of land be, and hereby is, denied. BE IT FURTHER RESOLVED by the Board that the reasons for denial and findings of fact contained in the Weld County Planning Commission recommendations in this matter dated May 15 , 1979 be, and hereby are, adopted as the findings of fact of the Board of County Commissioners in this matter. Further , it hs the opinion of the Planning Commission that the applicant has not adequately demonstrated that the property in question has unique characteristics which distinguishes it from surrounding lands . Additionally , Section 8 . 3 states : "Furthermore , once a change is made , the Planning Commission must recognize the precedent which is established, both in the immediate area and in other parts of the county, for like rezoning of other lands "similarly situated. " It is the opinion of the Planning Commission that the approval of this request would constitute "spot zoning . Within Chapter 1 , Introduction of the Plan , under Section A. , Nature of the Plan, it is stated on Page 2 that : "Further urban development and growth will inevitably occur throughout Weld County . This Comprehensive Plan outlines a course of action which assures urban growth in accordance with the concepts and desires of each existing municipality. At the same time , urban development will take place with a minimum of impact on the environment and with a maximum of economy in providing public utilities and services . The net result is a controlled expansion of our existing municipalities into well planned, coherent communities that blend into and complement the surrounding agricultural environment . " Clyde G. Malara, etal Z-319 : 79 : 3 PLANNING COMMISSION RECOMMENDATION May 15 , 1979 In setting forth the goal of assuring that urban growth is in accordance with the concepts and desires of each existing municipality on Pages 53 and 54 , the Plan states : "The Future Land Use Map ( in back pocket ) shows the general distribution throughout Weld County of areas proposed for eventual urban development . These areas are based on comprehensive plans prepared by individual municipalities in the county . A more detailed picture of proposed urbanization within the planning areas of each of the towns can be found in the comprehensive plan for the town in question . Planning for urban development at the county level must be closely coordinated with planning for each of these municipalities . At the same time , in order for these towns to guide their future growth successfully, they must make their goals and objectives known to the county and to each other . " More specifically, the Comprehensive Plan addresses Industrial development in Chapter Three , Resource Management Policies , Section B, Urban Development , states on Page 62 that : "Industrial development , like commercial development , is encouraged to locate in one of the existing municipalities where such a facility can be accommodated according to the local comprehensive plan. " Further, on Page 65 the following policy is found : "Industrial zoning within the comprehensive planning area of a town shall be subject to the industry ' s compliance with the local comprehensive plan . . . " The City of Fort Lupton Planning Commission has recommended denial of this rezoning request . The Fort Lupton Planning Commission expressed the following reasons in their letter dated March 30 , 1979 as to why they voted unanimously to deny approval of this request : "1 . We are very concerned about the land along old Highway 85 being Industrialized from Brighton to Fort Lupton , There are some very nice homes along this area and an Industrial business at this location would depreicate the value of the homes . It is not good planning to allow "spot zoning" every few hundred feet which only results in uncompatbile land usage . 3 . Fort Lupton ' s General Plan designates this area as Agriculture and we urge you consider the long range effects this would have on our Plan, which in this case , we feel would be detrimental . QUESTION - Is it impractical , impossible, or undesirable to develop the land according to its current zoning classifica- tion? ANSWER - Yes, the land is too small (5. 614 acres) to farm economically and no water available for irrigation . Presently there is a large storage building on subject property that is vacant (formerly used for storage of agricultural products, namely onions. ) Now, owners have made other arrangements for storage purposes because present building is inadequate. Other reasons being that said building can be put to a higher and better use as the area has other commercial enterprises and rezoning this plot of land to commercial would not be detrimental to the surrounding farms and/or businesses already established. 2 . QUESTION - Would the proposed rezoning benefit the entire County by allowing a typical development which is needed and cannot located in other parts of the County? ANSWER - Would benefit by putting an existing vacant building to a good use commercially, and as such, would benefit the County tax-wise, and certainly would not be detrimental to the surrounding neighborhood. 3 . QUESTION - Would the proposed rezoning benefit lands adjoining the area requesting the change? ANSWER - Yes, it would increase the value of the surrounding land. Most certainly, it would not decrease such values. The land and building are located between existing railroad right-of-way and old highway #85 between Ft . Lupton and Brighton and the area is rapidly becoming more and more commercially oriented as physical inspection will show. 4. QUESTION - What features apply to the property requesting rezoning which make it logical to rezone this tract and not to rezone in a similar manner surrounding properties which may have like land use characteristics? ANSWER - Because of the nature of this small tract with an existing empty storage building that can easily be converted to commercial use and can continue to be occupied and used similar to other commercial properties already in this area. 5. QUESTION - Why are other areas in the County already zoned according to the requested classification, unsuitable for the development which is proposed? ANSWER - There are other areas in the County already zoned according to this requested classification ; however , the plot of ground with an already erected vacant building thereon would be highly desirable for the use intended, especially being located between an existing road and a railroad right- of-way , present building already there; why should it remain vacant when same can be put to a beneficial use in an area that is rapidly tending to go commercial as evidenced by the commercial enterprises in the area. z E MALARA ZONE CHANGE WELD COUNTY, COLORADO PAGE -2- 6. QUESTION - What proof of evidence is available that the original rezoning is faulty or that changing conditions in the area justify rezoning at this time? Original zoning certainly was not faulty. Whole area was blanket zoned agricultural originally in order that the whole county could be protected and reasonably zoned. Now, for good cause shown , this request is made for rezoning because this plot of land and vacant building thereon lie in a narrow strip between a railroad right-of-way and old highway #85 and can be easily converted to commercial , thus benefiting the whole are and the County. 7. They voted unanimously to deny approval due to the following reasons: 1. We are very concerned about the land along old Highway 85 being Industrialized from Brighton to Fort Lupton. There are some very nice homes along this area and an Industrial business at this location would depreciate the value of the homes. 2. It is not good planning to allow "spot zoning" every few hundred feet which only results in uncompatible land usage. 3. Fort Lupton's General Plan designates this area as Agriculture and we urge you consider the long range effects this would have on our plan, which in this case, we feel would be detrimental. It is silly to have it agricultural whenthere is no way of watering the land. By the .same token I don 't wart it industrial if it means an oil concern will move in there with noise, lights, and confusion. My home is due south of the land and naturally I would like to keep its value up, and my environment comfortable. I telephoned you regarding the request that if the zoning is changed that the neighbors could be consulted if this new owner wants to sell it to an oil company or some undesirable company. You felt that couldn 't be done. I don' t quite know what to say, I do feel sorry for Mr. Nalara and wouldn' t mind having the pickup shelder builders as my neighbor but I do wish some proviso be put on the change so that an undesirable company couldn 't buy it next.
