RE: ACTION OF THE BOARD CONCERNING ZONING PERMIT FOR A SECOND
SINGLE-FAMILY DWELLING, ZPSD15-0001 - 5258 RANCH, LLC, C/O PETE GRANT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 9th
day of March, 2015, considered the request of 5258 Ranch, LLC, do Pete Grant, 3892 Tayside
Court, Timnath, Colorado 80547-2245, for a Zoning Permit for a Second Single-Family Dwelling,
and
WHEREAS, said permit is for a structure located on a parcel of land being more
particularly described as follows:
Part of the SW1/4 of Section 19, Township 7 North,
Range 67 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendation of
the Weld County Department of Planning Services and all of the exhibits and evidence
presented in this matter and, having been fully informed, finds that this request shall be referred
back to staff to work with the applicant to gain a clearer understanding of the intended use,
determine whether the structure will be occupied on a regular basis (which would prompt
completion of the ZPSD) or just for occasional events and visits (which may be determined to be
a Use by Right or a Use by Special Review), and then process the request accordingly.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of 5258 Ranch, LLC, do Pete Grant, for permission to
place a second single-family dwelling on the above described parcel of land, be, and hereby is,
referred back to staff.

THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 23-4-600
of the Weld County Code.
2. It is the opinion of the Department of Planning Services' staff that the applicant has shown
compliance with Section 23-4-610 of the Weld County Code as follows:
a. Section 23-4-610.A.1. —Compatibility with surrounding area, harmony with the character
of the neighborhood and its effects upon the immediate area.
b. Section 23-4-610.A.2. --The proposed use is consistent with Chapter 22 and any other
applicable code provisions or ordinance in effect.
c. Section 23-4-610.A.3. --The uses which will be permitted will be compatible with the
existing surrounding land uses.
d. Section 23-4-610.A.4. —The general health, safety and welfare of the inhabitants of the
area and the County.
This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral entities.
The Department of Planning Services' staff recommendation for approval is conditional upon the
following:
1. A building permit will be required, for any new construction per Section 29-3-10 of the Weld
County Code. A building permit application must be completed and submitted. Buildings and
structures shall conform to the requirements of the various codes adopted at "ma of narmfr
2015-0648
application. Currently the following has been adopted by Weld County: 2006 International
Building Code; 2012 International Energy Code; 2006 International 2011 National Electrical Code;
and Chapter 29 of the Weld County Code. The structure will require ICC/ANSI A117-1-2009
Standards for Accessibility. A plan review shall be approved and a permit must be issued prior to
the start of construction.
2. Prior to receiving a certificate of occupancy, the home shall be connected to an approved sewage
system and a legal water supply.
3. The second single family dwelling shall be occupied by a family member or a primary caregiver.
Failure to comply will result in revocation to the permit.
4. The second dwelling will not be used as an income source by the applicant for rental purposes.
5. All zoning permits for a second dwelling for family members or a caregiver shall be transferable
by the applicant and/or owner to any successor; as long as the use is remains for family or
caregiver.
6. All proposed or existing structures will or do meet the minimum setback and offset requirements
for the zone district in which the property is located. Pursuant to the definition of setback in the
Weld County Code, the required setback is measured from the future right-of-way line.
7. No building or structure as defined and limited to those occupancies listed as Groups A, B, E, F,
H, I, M and R in Section 302.1 of the 2006 International Building Code, shall be constructed within
a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any
construction within a 200-foot radius of any tank battery or 150-foot radius of any wellhead shall
require a variance from the terms of the Section 23-3-10 of the Weld County Code.
8. Any future structures or uses on site must obtain the appropriate zoning and building permits.
9. Effective April 25, 2011, Building Permits issued on the proposed lots will be required to adhere to
the fee structure of the Weld County Road Impact Program. (Ordinance 2011-2)
10. Effective April 25, 2011, Building Permits issued on the proposed lots, will be required to adhere
to the fee structure of the County Facility Fee and Drainage Impact Fee. (Ordinance 2011-2)
11. The existing home is served by an existing on-site wastewater treatment system (G-910222).
The applicant is proposing to utilize the existing septic system for the proposed second dwelling.
Review by WCDPHE indicates that the existing septic system must be upgraded to accommodate
the additional bedrooms and living space. A repair permit is required to upgraded and connect
the second residence to the existing septic system.
12. A repair permit is required to upgrade and connect into the existing On-site Wastewater
Treatment System (OWTS) and shall be installed according to the Weld County On-site
Wastewater Treatment System Regulations.
13. Pursuant to Chapter 15, Articles 1 and II of the Weld County Code, if noxious weeds exist on the
property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All other vegetation,
other than grasses, need to be maintained at a maximum height of 12 inches until the area is
completely developed.
14. The applicant shall maintain compliance with Section 23-4-600 of the Weld County Code at all
times.
NOTICE
Pursuant to the zoning laws of the State of Colorado and the Weld County Code, a public
hearing will be held in the Chambers of the Board of County Commissioners of Weld County,
Colorado, Weld County Administration Building, 1150 O Street, Assembly Room, Greeley,
Colorado 80631, at the time specified.
If a court reporter is desired, please advise the Clerk to the Board, in writing, at least five
days prior to the hearing. The cost of engaging a court reporter shall be borne by the requesting

1 . Water supply statements addressing the following
a Domestic use. The statement will include evidence that a water supply of sufficient quality,
quantity and dependability will be available to serve all proposed lots. A letter from a water
district, municipality, or a well permit are examples of evidence for domestic use. (Example -

2 A statement explaining that the proposed lot will have an adequate means for the disposal of sewage in
compliance with the requirements of the underlying zone district and the Weld County Department of

Water Supply
- Domestic water is serviced by North Weld County Water District. See attached recent bill. This
tap is expected to be used for the new structure as well. There is also a well on-site for irrigation
and agricultural on the existing property. Please reference attached well information.
Sanitary Disposal
- There is also a septic system on-site that is expected to meet the demand of the proposed
building in addition to those of the existing property. Please reference attached septic permit.
Current Use
- There is currently one house and 3 out buildings on the property. The outbuildings are used for
agricultural and/or storage purposes. There are no other living quarters on the property.
Unique Characteristics
- There are wetlands on the southwestern corner of the lot. There is also a drainage ditch running
parallel with the southeastern property line from a pond to/or near the wetlands.

To Whom It May Concern :
North Weld County Water District provides domestic water service to the property located at 38094 WCR 13,
Fort Collins, CO. The current owner of the property is The 5258 Ranch, LLC. The current service provides a 3/4" meter
that should provide adequate service to the proposed second residential dwelling on the same property. The current
Meter provides a Water Allocation of 2.5 and Plant Investment Allocation of 3 which yields 570,000 and 684,000 gallons
respectively per year without surcharge rates. Surcharge rates are detailed below.
Water to /service isplaced on the physical property, defined by a legal description. In case of a Recorded

Exemption, the water tap shall only serve the parcel that the water tap is located on. Service shall NOT cross the legal
description of one parcel to serve the other parcel, unless an easement has been recorded for the water service and has
been approved by the District.
The District guarantees treatment and delivery of water purchased. All water that is delivered with surcharge
is subject to water availability. Water purchased through the District shall be 70% delivery of an Acre-Foot of water
(228,000 gallons), if the allotment for Colorado-Big Thompson (CBT) project water, which is determined by the Northern
Colorado Water Conservancy District, is 50% or greater. North Weld County Water District will restrict the delivery as
necessary when the CBT allotment is less than 50%. A portion of the Raw Water Fee is utilized by the District to
construct storage reservoirs.
The Plant Investment Fee pays for the infrastructure required to deliver 1 AFU (228,000 gallons). If usage
exceeds the number of Plant Investments that were purchased, an additional Plant Investment Surcharge will be applied
to your account. Plant Investments may be purchased to increase the amount of water to be delivered and avoid the
Plant Investment Surcharge. Refer to table below for current Plant Investment Surcharge schedule.
] Water Surcharge
Surcharge will be assessed when an account's year to date usage exceeds their annual allotment. Currently surcharge is
$2.00 per 1,000 gallons. This fee is to recover the District's cost to obtain additional water rights for delivery. All water
that is delivered with surcharge is subject to water availability.
Plant Investment Surcharge
When an account's year to date usage exceeds their Plant Investment Allotment (U of Equivalent Taps x 228,000
gallons), a surcharge will be assessed. The transfer of additional water will not remove this charge. Additional Plant
Investments must be purchased to increase the allotment and reduce the Plant Investment Surcharges.
