RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT,
USR15-0050, FOR A MINERAL RESOURCE DEVELOPMENT FACILITY, INCLUDING
AN OIL AND GAS SUPPORT AND SERVICE FACILITY (STORAGE YARD FOR TANK
BATTERY EQUIPMENT) IN THE A (AGRICULTURAL) ZONE DISTRICT -
TROY BONNELL
A public hearing was conducted on December 23, 2015, at 10:00 a.m., with the following present:

The following business was transacted:
El I hereby certify that pursuant to a notice dated October 29, 2015, and duly published
November 3, 2015, in the Greeley Tribune, a public hearing was conducted to consider the
request of Troy Bonnell for a Site Specific Development Plan and Use by Special Review Permit,
USR15-0050, for a Mineral Resource Development Facility, including an Oil and Gas Support and
Service Facility (storage yard for tank battery equipment) in the A (Agricultural) Zone District.
Bruce Barker, County Attorney, made this a matter of record.
El Chris Gathman Department of Planning Services, presented a brief summary of the proposal
and stated the majority of the parcel is in the floodplain, however, there is a corner of the parcel
that is out of the floodplain and that is where the business is located. He reviewed the surrounding
property uses. He stated if any construction were to occur in the floodplain, a Flood Hazard
Development Permit would be required. Mr. Gathman stated staff sent out 15 referrals and
received eight (8) indicating no concerns or recommended approval with conditions. He clarified
the site itself is less than an acre and the property is located within the three (3) mile referral area
of the Cities of Greeley, Garden City and Evans, none of which returned correspondence.
Mr. Gathman displayed images of the site and surrounding properties and entered the favorable
recommendation of the Planning Commission into the record as written.
EI Jennifer Petrik, Planning Services Engineer representative, provided a brief overview of the
transportation plans and requirements referencing the relevant County roads and average daily
traffic counts. She reviewed the updated traffic narrative and provided the approved Access
Permit number, AP#15-00457. Ms. Petrik reported the applicant originally planned to access the

site by way of easement but later decided to widen the road and create an access specifically for
his site. She reviewed the requirement for tracking control and stated the application does not
require an Improvements Agreement at this time and regarding the drainage plan, the water
quality feature is acceptable and the site will utilize a pond on-site for excess drainage or runoff
from weather events. Ms. Petrik reviewed the typical Development Standards relevant to Public
Works.
• Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer
provisions stating the existing residence is served by the Central Weld Water District and septic
system and the application indicated that portable toilets will be used for employees. He stated
Development Standards#5-11 address items typical to Environmental Health.
• Troy Bonnell, applicant, stated his intent to provide a temporary to permanent storage facility
for oil field companies in the area and that he wants to maintain good neighbor relationships. He
explained his decision to put the access solely on his property to ensure the good neighbor policy.
Mr. Bonnell also mentioned his efforts to communicate with all the surrounding property owners
in a timely manner and that the response was positive.
• No public testimony was offered concerning this matter.
• In response to Chair Kirkmeyer, Troy Bonnell indicated he has reviewed the Conditions of
Approval and Development Standards and has no concerns.
• In response to Commissioner Cozad, Mr. Bonnell explained the reasoning behind the one
building permit for the cargo containers. He further clarified his method for securing them and that
they are not used to store anything while on his site, but once they are moved to a field location
for oil and gas support, they will store palettes of materials related to tank batteries. Mr. Gathman
interjected the reason for the building permit is the possibility of them being on the site for longer
than six months which is the definition for temporary. After further discussion, the Board agreed
to amend Condition of Approval (COA) #1.A to read, "The applicant shall submit a complete
Building Permit Application to the Department of Building Inspection, if required by the building
code, for any permanent storage container located on-site."
El Chair Kirkmeyer suggested changing Development Standard (DS) #4 to parking area. The
Board agreed. Commissioner Moreno suggested deleting DS #3. The Board agreed.
• In response to Chair Kirkmeyer, Troy Bonnell indicated he has reviewed, and agrees to abide
by, the Conditions of Approval and Development Standards, as amended.
ta Commissioner Moreno moved to approve the request of Troy Bonnell for a Site Specific
Development Plan and Use by Special Review Permit, USR15-0050, for a Mineral Resource
Development Facility, including an Oil and Gas Support and Service Facility (storage yard for tank
battery equipment) in the A (Agricultural) Zone District, based on the recommendations of
Planning staff and the Planning Commission, with the Conditions of Approval and Development
Standards as modified and entered into the record. The motion was seconded by Commissioner

Conway, and it carried unanimously. There being no further discussion, the hearing was
completed at 10:47 a.m.
This Certification was approved on the 28th day of December, 2015.
